JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
General Services Administration (GSA) Federal Acquisition Service (FAS)
Office of Professional Services and Human Capital Categories (PSHC) Office of Contract Operations (OCO)
1) Identification of Agency and Contracting Activity:
The General Services Administration Federal Acquisition Service, Office of Professional Services and Human Capital Categories, Office of Contract Operations (GSA) makes this Justification and Approval (J&A) for other than full and open competition pursuant to Federal Acquisition Regulation (FAR) 6.302.

2) Nature and/or Description of Action Being Approved:
This sole source justification is made for solicitation and award to Apex Logic, Inc. for contract management software supporting the GSA OASIS program.
This award will result in a Firm Fixed Price (FFP) contract for Symphony procurement suite licenses and customization/integration. The estimated period of performance includes one, seven-month base period and up to two six-month option periods with an estimated total value of $648,000.00. Contract award will be made to:

3) A Description of Supplies/Services Required to Meet Agency’s Need:
In Fiscal Year 2019, GSA's One Acquisition Solution for Integrated Services (OASIS) is undergoing a substantial re-solicitation process to on-ramp new OASIS contractors. The on-ramps require a customized solution to reduce extensive man-hour requirements for evaluation of offers. Market research indicates that Symphony contract management software allows for a collaborative workflow between ordering agency, client agency, and industry partners to create, compete, evaluate, and administer task order requirements to support GSA's requirement.
4) Identification of the Statutory Authority Permitting Other Than Full and Open Competition:
FAR 6.302-5(b)(5) - Authorized or Required by Statute, Sole Source Awards Under the HUBZone Act of 1997 - 15 U.S.C. 6570.
5) Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited:
The Symphony software platform is a proprietary software product of Apex Logic, Inc. Through market research, it was determined that the manufacturer does not have any authorized resellers, nor are the licenses available on any existing contracts. The contractor is a certified HUBZone small business, verified via SBA Small Business Dynamic Search on March 1, 2019.
6) Description of Efforts Made to Ensure that Offers are Solicited From as Many Potential Sources as Practicable:
Symphony software licenses are commercially available. As such, a streamlined solicitation for commercial item procedures, in accordance with FAR 12.603 will be used to synopsize and solicit the requirement on FedBizOpps, and will serve as the Government’s notice of intent to sole source the acquisition. The justification for other than full and open competition will be made publicly available within 14 days after contract award, as required by FAR 6.303-1 and 41 U.S.C. 3304(f).
7) Contracting Officer Determination that Anticipated Price will be Fair and Reasonable:
Market research, published commercial pricing, and historical information will be used to evaluate the contractor's proposal to determine pricing fair and reasonable. In accordance with best practices, the Contracting Officer will request a discount from commercially available pricing.
8) A Description of the Market Research Conducted and the Results or a Statement of the Reason Market Research was not Conducted:
Based on market research conducted in accordance with GSAM 510, FAR 8.002, and FAR 10, no software licenses were found to be available from mandatory or preferred sources of supply. See Market Research Memorandum dated March 1, 2019.
9) Any Other Facts Supporting the Use of Other Than Full and Open Competition:
As outlined in the GSA Acquisition Letter MV-19-04, a security controls assessment of the Symphony Express information system was conducted at the Federal Information Processing Standards (FIPS) in accordance with National
Institute of Standards and Technology (NIST) Special Publication 800-37 Revision 1, “Guide for Applying the Risk Management Framework to Federal Information Systems”, and the General Services Administration (GSA) IT Security Procedural Guide CIO-IT Security-06-30, “Managing Enterprise Risk”.
As a result, an Authorization to Operate (ATO) letter was issued by GSA on August 6, 2018 with a formal declaration that the Symphony platform has adequate security controls which provide a satisfactory level of security in the system. The ATO is in effect for one year and will require renewal prior to option exercise.
10) A Listing of the Sources, if any, That Expressed, In Writing, An Interest in the Acquisition:
To date, the Contracting Officer has not received any statements of interest regarding the proposed sole source effort.
11) A Statement of the Actions Taken to Remove or Overcome Barriers to Competition:
The proposed contract action is limited to 19 months, including all options. For future acquisitions, GSA will conduct market research and encourage additional industry comment to identify additional providers for similar software licenses. If it is determined that there are more capable contractors or products that could fulfill the Government's requirement at that time, GSA will conduct a competitive acquisition.
