I. Contracting Activity.
The contracting organization that is responsible for the proposed contract action is the Air Force Test Center (AFTC), Directorate of Contracting, Enterprise Acquisition Branch (PZIEA), 5 South Wolfe Avenue, Edwards AFB CA 93524-1185. The contracting officer for this acquisition is Matthew D. Chartier. This is a Justification for Other than Full and Open Competition.
II. Nature and/or description of the action being processed.
The proposed action will result in a new Firm-Fixed Price (FFP), commercial contract. The proposed source is:
Rohde & Schwarz USA, Inc.
6821 Benjamin Franklin Drive Columbia, MD 21046
III. Description of supplies/services required to meet agency needs.
Remove and install existing spectrum monitoring and direction finding system to include all associated equipment from Ford Box Van into a Dodge Ram Truck. Survey of vehicles and equipment will need to be accomplished for development of move plan, system integration (to include testing), final system verification testing and certification.
IV. Statutory authority permitting other than full and open competition.
The statutory authority permitting this action is 10 USC 2304(c)(1) which specifies that, “the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or service will satisfy the needs of the agency” as implemented by Federal Acquisition Regulation (FAR) Part 6.302-1(a)(2)(iii)(A).
V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
This service will allow us to physically track, find and resolve issues during flight test missions at Edwards AFB, R2508 Range complex, AF Plant 42 and other DoD Installations as required.
a. (FAR 6.302-1) - This acquisition is for specialized services as described in Para III above. The requirement can only be satisfied by Rohde & Schwarz USA due to their specialized experience with the Rohde & Schwarz supplies and their services to support this program. Rohde & Schwarz USA, Inc. installed their equipment purchased in the past into the Ford van, and has provided maintenance for the equipment and software updates for the past 5 years.
Rohde & Schwartz is the only known company that is capable to accomplish System Integration & Testing from moving their system from one vehicle to another. Services also include System Verification Testing for Certification; this service can only be accomplished by the manufacturer of the existing system in order to facilitate a seamless transfer.
Additionally, a requirement of moving the system to a new vehicle requires system software installation and Rohde & Schwarz carries proprietary data rights to their software that runs the system, therefore this requirement cannot be feasibly split into separate requirements. Contract Award would cause a substantial duplication of cost that is not expected to be recovered through full and open competition; if a new system would have to be procured, market research estimates would cost the government upwards of $450K for a new system and implementation of it.
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
A Request for Information (RFI) was posted on FedBizOps (Solicitation Number: 412TW-SRF-F1S0AE2). Rohde and Schwarz was the only vendor that responded to the RFI. The following information was provided in their response to the RFI. From this information, it was determined they did meet the government's need.
Rohde & Schwarz USA will provide the following as part of the system integration move:
- PNEUMATIC Locking Ultra Heavy Duty Mast systems (quantity 2)
- Form Factor Spectrum Monitoring R&S ARGUS System Controller

- Ruggedized Rack System for housing Customer Furnished Equipment
- ZAVAD GNSS GPS & Compass System integrated to new vehicle system
- Patch Panel for Rack to Antenna equipment
- 115 VAC portable diesel generator with its own primary main fuel tank
- Custom Modifications for items listed above to fit in the vehicle
- Removal and shipment of GFP from existing Ford Van to Flower Mound facility
- Shipment to Flower Mound facility and back to Edwards AFB of Dodge Truck
- Engineering, Technician and Project Management services
- Design Review
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated price will be determined fair and reasonable based on comparison of proposed prices with independent Government cost estimates and information other than cost and pricing data. Furthermore, the program manager will provide a technical evaluation analyzing the proposed information.
VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
As described in Section VI above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries. It was determined that only one contractor can accomplish all areas of the requested requirement.
IX. Any other facts supporting the use of Other Than Full and Open Competition.
The initial acquisitions by various program offices or commercial customers purchased the items as commercial-of-the-shelf (COTS) items; therefore, the Government only received commercial data rights. As a result, descriptions suitable for full and open competition have not been developed and are not available.
X. List of any sources that expressed, in writing, an interest in the acquisition.
See section VI above
XI. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before making subsequent acquisitions for the supplies or services required.
Market research will continue throughout the contract period. If it is determined to be beneficial and competition becomes available, the government will use full and open completion for any future acquisition.
XII. Certification by the Contracting Officer.
As evidenced by my signature above, I have determined this document to be both accurate and complete to the best of my knowledge and belief.
