JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

SOLICITATION SPE7L323Q0717

DLA Land & Maritime Justification for Other Than Full & Open Competition (November 2021)

Product Specialist, Robert Holobaugh, certified the following on 03/28/2023:

This item is an AMC/AMSC of 3/C. This item supports the following weapon systems: M4 Carbine, is a critical application item and is not a Critical Safety Item (CSI). This item is a Barrel, Carbine for the M4 Carbine. COLT (13629) is the only approved source capable of making this item due to previous quality issues from other sources.

The Government does have the data or drawings for full and open competition but due to item being an atomic super kid and quality issues under previous procurements, Engineering Support Activity designated this NSN back to a 3/C sole approved source to COLT. The approved source is the only source approved by the design control activity. There are no current 339’s out to the Engineering Support Activity (ESA) and per Product Specialist, commerciality cannot be determined. It is not Commercial-off-the-shelf but OEM indicates there are similar commercial items. Technical Data Certification is attached.

6. Efforts to ensure that offers are solicited from as many sources as practicable are:

The acquisition will be synopsized for 3 days prior to the solicitation opening. At the completion of the synopsis period, the Purchase Request (PR) will be solicited on the internet for 10 days via the DLA Internet Bid Board System (DIBBS).

7. I hereby determine that the anticipated cost to the Government will be fair and reasonable.

A price analysis will be conducted using historical pricing, the Producer Price Index (PPI), and learning curve analysis. Cost or pricing data in accordance with FAR 15.403-4 will be requested if the offer exceeds the $2M threshold for obtaining cost data, however, it is anticipated that this procurement will not exceed that threshold.

Offerors may be requested to submit information other than cost or pricing data for determining price reasonableness. Based on the above techniques, the Contracting Officer anticipates that the cost to the Government will be fair and reasonable.

8. Market Research/Efforts to Obtain Competition:

Market research consisted of review of past procurements, market surveys received from interested parties, and internet sources.

AEROPRECISION WILL BE SUBMITTING SAR PACAKGE FOR FUTURE PROCUREMENTS.

12. Previous Justification for Other than Full and Open Competition IS attached:

Procurement history reflects awards dating from 04/01/2020 to 04/04/2023. Majority of contract history are delivery orders from SPE7L120D0017. SPE7L120D0017 was issued to create an administrative contract number to allow DLA Land and Maritime Columbus, Ohio to issue delivery orders against contract SPRDL1-18-D-0052.

DLA Land Warren, Michigan issued SPRDL1-18-D-0052, but subsequently transferred ordering authority and contract administration to DLA Land and Maritime, Columbus. All terms and conditions contained in SPRDL1- 18-D-0052, and all modifications thereto, were incorporated into SPE7L120D0017. SPRDL1-18-D-0052 would not pull up in Records Management and therefore buyer could locate file to see if J&A were included in contract documents.

I hereby certify that the information contained in this justification is accurate and complete to the best of my knowledge and belief. If not exceeding $750,000, this signature serves as the approval.
