JUSTIFICATION AND APPROVAL (J&A)

FOR OTHER THAN FULL AND OPEN COMPETITION

COVID19 LODGING SUPPORT- OAHU, HAWAII

1. Contracting Activity

The Naval Supply Systems Command (NAVSUP), Fleet Logistics Center Pearl Harbor (FLCPH), Code 200.

2. Description of the Action Being Approved

Execution of contract award under an urgent and compelling basis in support of the precautionary measures to prevent the potential introduction of COVID19 onboard the ship prior to deployment.

3. Description of Item or Service

The contract will provide commercial lodging, meals, incidentals, and laundry services to accommodate military personnel in support of precautionary quarantine efforts for the on Oahu, Hawaii. Lodging shall consist of single occupancy rooms for all crewmembers. Food and beverages shall be served three times per day with disposable materials. Personal Laundry services shall be provided daily during each occupant’s quarantine period. Standard incidentals shall be included such as linens and wifi internet. The quarantine period for each crewmember is 15-days (14 day quarantine plus time to receive test results).

4. Statutory Authority Permitting Other Than Full and Open Competition

5. Rationale Justifying Use of Cited Statutory Authority

The is scheduled for an upcoming deployment and is required to quarantine its crewmembers before departure as a precautionary measure to prevent the spread of COVID19. This will allow the ship and its crewmembers to be in good health as they begin their deployment.

The primary concern is the health and welfare of our warfighters before they depart for deployment aboard the . The other is the primary mission of the J . Enforcing urgent preventative measures prior to deployment will ensure proper prevention of COVID19 amongst crewmembers while aboard which will allow the to provide uninterrupted warfighter mission capabilities the United States Navy and the country depends upon. This is especially important as it directly relates to the readiness, agility and ability to protect our nation in this unstable global environment.

NAVSUP FLCPH received the requirement on 29 July 2020, with an anticipated performance start of 2 August

2020 in order to accommodate deployment schedule. With such a short timeline to solicit under the given circumstances, the services required are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits quotes.

6. Description of Efforts Made to Solicit Offers from as Many Offers as Practicable

Under FAR 5.202(2), this contract action is exempt from the requirement to post on the Government wide point of entry (GPE), as this is an urgent requirement.

The contracting office determined that the only viable course was to move forward under urgency procedures to solicit from a limited number of sources. The contracting team conducted market research on several local hotels via cold calls. Request for quotes were sent via email directly to 10 local hotel vendors on Oahu on 30

July 2020. Due to the need to execute an authority to proceed within three days, it was not viable to pursue a full and open competitive environment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies/services covered by the J&A will be fair and reasonable. The fair and reasonable determination will be based on comparison with the Joint Travel Regulation (JTR) Oahu per diem rates, the commercial pricing rates of the hotels, and analysis of other related charges to the opening of hotels that were previously closed due to COVID-

19 restrictions on Oahu.

8. Actions to Remove Barriers to Future Competition

NAVSUP FLCPH would solicit through full and open competition for all future similar requirements if given sufficient lead-time since there are multiple known viable sources available.
