PERFORMANCE WORK STATEMENT
PERFORMANCE WORK STATEMENT FOR THE OPERATION OF PORT SECURITY BARRIERS
IN SUPPORT OF NORFOLK NAVAL SHIPYARD PORTSMOUTH
1.0 SCOPE. Commander, Navy Region Mid-Atlantic, Regional Security Program seeks marine services to support operations of the Navy Anti-Small Craft Barrier (ASCB) at Norfolk Naval Shipyard (NNSY) Portsmouth, Virginia.
2.0 REFERENCES. CNIC Instruction 3500.1, Shore Installation Management Basic Boat Coxswain Program
3.0 REQUIREMENTS. The contractor shall provide all supervision, administrative and technical support, labor, and subcontractors to schedule, coordinate, and assure effective completion of all services for Operation and Inspection of ASCB and Government resources.
3.1 BARRIER OPERATION.
The contractor shall provide crews qualified to operate Government furnished tug type workboats and a buoy handling platform (if required) for scheduled, unscheduled, and emergent unannounced operation and tending (keeping a barrier open or closed) of ASCBs, and other waterfront requirements to include barrier inspections, movement of paint floats, camels, barges, fenders, and oil response booms as directed by Port Operations. The Contractor will operate the ASCBs without interfering with vessel traffic and causing no hazards to navigation.
3.1.1 The contractor shall have a boat crew on call-back at all times with a one (1) hour response time for emergent requirement, after normal working hours.
3.1.2 The contractor shall ensure that the barrier system is:
a. Opened prior to scheduled vessel movements.
b. Closed upon completion of the movement that required the opening.
c. Tended for special evolutions such as stern gate marriages, training, drills, exercises, and maintenance as directed by Port Operations.
d. Supported for unannounced and emergent events that require immediate opening and closing of the barriers regardless of scheduled barrier operations.
e. Validated and verified that the barrier gates are latched properly daily.
f. Barrier gates should only be connected on soft lines if the gate is inoperable, pending ATFP sustainment repair or when weather conditions present safe barrier operations.
3.1.3 Based on historical data, the Government estimates the following barrier moves annually:
a. Regular Moves - 1000
b. Overtime Moves - 200
c. Monthly Moves - 84
d. Monthly Overtime Moves - 17
3.1.4 The Government will publish a harbor movement plan for tasks no later than 1430, barring any unforeseen changes, for the following day’s work. Friday’s plan will include weekend and holiday requirements, if any.
3.1.5 In environmental conditions equivalent to sea state 2 or winds at greater than 25 knots, the contractor, as the subject matter expert, has the authority to exercise their own judgment on the safety of the requested evolution and shall communicate the safety concerns to the COR for a decision during heavy weather, hurricanes, tropical storms, nor’easters, and winter storms. The ASCBs may need to be relocated.
3.2 ANTI-SMALL CRAFT BARRIER REFURBISHMENT SUSTAINMENT SUPPORT (ASCB).
Naval Facilities Command Engineering and Expeditionary Warfare Center (NAVFAC-EXWC) is responsible for the installation and sustainment of ASCB Waterfront Barriers at Norfolk Naval Shipyard. The barrier boat operators shall support NAVFAC-EXWC with the refurbishment of the ASCB system. The support shall consist of towing or controlling PSB strings during installation or refurbishment task.
3.3 BARRIER INSPECTION, MAINTENANCE AND REPAIR.
Contractor shall be responsible to provide sustainment efforts for the Norfolk Security Barrier system. The Government will provide material necessary to perform routine maintenance and repair. The Contractor is responsible for performing inspection and routine maintenance and repair in accordance with the manufacturer's technical and operator's manuals and other guidance provided by the Navy. The Contractor shall request clarification of any conflicts in referenced documentation. Routine tasks include, but are not limited to the following:
a. Daily Integrity Inspection of Security Barrier system
b. Nets Assembly (repair/replace)
1. Damaged nets
2. Zip-ties
3. Lap-links
4. Net support wire assembly
5. ½” Nylon ropes uses for module-to-module net connections.
6. Termination lanyards
7. Net connection shackles
8. Repair/Replace broken net termination posts and support brackets. (Bolt-on only)
c. Navigation lights and warning signs (repair/replace)
d. Chain Latch Consumable Components (repair/replace)
1. Worn or damaged chain latch connector tow lines, safety lines, and retrieval lines.
2. Damaged or missing locking bars and counter weights
e. Buoys
1. Replace damaged bolt-on cleats. (Bolt on only)
2. Marine growth removal.
f. In case of any ASCB system deficiencies or emergent repairs that are not rectifiable by the Contractor, the Contractor shall initiate the following actions and reporting procedures:
1. Notify Contracting Officer’s Representative
2. Notify Waterfront Security Office (WSOC)
3. Notify Navy Technical Representative at Naval Facilities Engineering Command
(NAVFAC)/OCSF
3.4 BARRIER BOAT INSPECTIONS AND MAINTENANCE.
The Contractor shall inspect the barrier boats daily in accordance with the Manufacturer’s Technical and Operator Manuals and Industry Standards. The Contractor shall request clarification of any conflicts between Government’s provided direction and manufacturer or industry standards from the Contracting Officer’s Representative. The Contractor shall annotate in the boat log and immediately report all discrepancies that the Contractor is unable to resolve. The Contractor shall submit a barrier boat work-order repair/maintenance request to the Port Operations Boat Repair Office. The Contractor is not responsible for barrier boat repairs.
3.4.1 DAILY INSPECTIONS. The following is the minimum requirements for daily inspections.
a. Pre-Start:
1. Check engine’s crankcase lube oil levels. Oil level should be at full mark, add as required.
2. Check engine’s jacket water levels. Water should be no less than 1” below expansion tank fill, add water/antifreeze solution as needed.
3. Strip the fuel tanks of water, sediment and any other foreign matter. Drain water and sediment from fuel/water separators.
4. Inspect the engine cleaners or silencers to ensure that they are not restricting the flow of air to the engines. Clean as required to ensure proper operation.
5. Check transmission lube oil level, level should be visible on dipstick.
6. Check steering fluid levels, add fluid as required.
7. Ensure that the neutral safety switch is functioning properly by starting engine in gear.
8. Check propeller shaft packing to ensure proper drip. Drip should be light and constant but not a steady stream.
9. Check propeller shaft packing gland nuts, studs, rudder boot, hose clamps, hold-downs to hull and packing. Add packing/adjust as needed.
10. Ensure electric bilge pumps, automatic emergency bilge pumps, mechanical bilge pumps, piping and valves are operating properly.
11. Check bilges throughout the boats. Pump clean any bilges with 4 or more inches of fluid.
12. Check fuel levels, add as required.
13. Ensure operational gear is secured and properly stowed.
b. Start Up: Check engine’s oil pressure. If engine oil pressure is below 10 PSI at idle after 10 second immediately secure engines.
c. Post Start Up:
1. Inspect engine’s hoses, fittings, pumps, valves and components for oil and fuel leaks.
2. Check engine’s fresh water cooling system hoses, fittings, pumps, and engine components for any sign of leaking.
3. Ensure that the electrical tachometers are functioning properly.
4. Check transmission lube oils at normal temperature in neutral with engine at idle speed. Oil should show full on dipstick, add oil as required.
5. Check transmission for oil leaks in the piping, hoes, pump, filters and components.
6. Check mufflers and exhaust piping for water exhaust and exhaust gas leaks.
7. Ensure communication equipment is present and in good working order.
8. Ensure navigational equipment is present and in good working order.
9. Ensure safety Equipment is present and in good working order.
10. Ensure voltmeters are working properly. Inspect voltmeter and alternator.
d. Post Shutdown and Secured:
1. Ensure that the shore power cable is properly plugged in, the cable is not tangled and cannot get caught between the boat and the pier, and the boat is receiving the correct power.
2. With shore power plugged in ensure battery charger and block heaters are working properly.
3. Ensure A/C sea suction valves are closed and all associated raw water cooling system lines, piping hoses and composite for leaks. Take appropriate action to repair any leaks.
4. Check propeller shaft packing gland. Ensure proper drip. (Drip should be light and constant but not a steady stream.) Adjust or repack packing gland as needed.
5. Check bilge levels. Level should not be more than 4”. Pump out as needed.
6. Ensure all unnecessary 12/24 volt DC electrical systems are secure.
3.4.2 MONTHLY INSPECTIONS. The following is the minimum requirements for inspections to be completed once a month on each boat.
a. Pre-Start:
1. Check rudder quadrants and linkage for warn or damaged parts.
2. Check rudder post packing. Add packing or adjust as needed.
3. Check shaft coupling bolts, nuts, and pins, tighten as necessary.
4. Ensure all exhaust lagging is in place and in good condition. Adjust or reattach as required.
b. Start Up:
1. Inspect foundation bolts for soundness and tightness on all machinery foundations.
2. Lubricate all steering linkage fittings or sooner if needed.
3. Inspect all fire extinguishers for proper charge and stowage. Replace low charge extinguishers and properly stow extinguishers as required.
4. Clean A/C simplex strainer.
c. Post Start Up:
d. Check the starter cables and connections. Clean, tighten and lubricate the connections as required to ensure proper operation.
3.4.3 QUARTERLY INSPECTIONS. The following are the minimum requirements for inspections to be completed once a quarter on each boat.
a. Inspect engine’s belts for wear, tear, damage and cracking.
b. Inspect, clean and lubricate all the hatch covers, manhole covers and doors securing gear and ensure proper operation.
c. Clean lubricate the fittings, gears etc. on the winches. Clean and preserve any corroded area on the winches.
d. Check the cleats, chocks, bits and hoisting pads for damage.
e. Inspect fenders, pusher pads, ladders and handrails for damage.
f. Inspect hatch covers, manhole covers, and doors for damage and proper operations of single acting and quick acting securing devices. Ensure that hatch covers, manhole covers and doors can be properly secured.
g. Inspect winches for proper operation. Lubricate fittings, gears etc. as required.
3.4.4 MAINTENANCE. The Contractor shall assist the Government in the following maintenance requirements. The Contractor is responsible for documenting the operating hours and assisting the NNSY Port Operations Office when required maintenance is due in accordance with 3M maintenance requirement card (MRC). Maintenance shall include but not be limited to:
a. Change fuel filters and fuel/water separators.
b. Change air filters.
c. Change transmission oil and filter.
d. Remove the old antifreeze solutions from the engines, flush the system until clean. Refill the cooling system with the correct amount of antifreeze solutions.
e. Prep, Prime and Paint of work boat.
3.5 DESCRIPTION OF WORKING HOURS:
3.5.1 Regular Hours: A boat crew shift equates to an 8-hour work day, Monday – Friday, excluding Federal Holidays. The contractor is expected to provide continuous boat crew support through rotating shifts during the working hours of 0500 through 2000 (05:00 AM-8:00 PM) unless otherwise directed, excluding Federal Holidays. The government will adjust the start times on a daily basis with a minimum twenty-four (24) hour notification, when feasible, or as soon as schedule changes.
3.5.2 Federal Holidays:

3.6 PLACE OF PERFORMANCE. Norfolk Naval shipyard Portsmouth, Virginia
3.7 MANAGEMENT AND ADMINISTRATION.
3.7.1 INSURANCE. During the period commencing with the delivery and terminating with the redelivery of each Vessel the Contractor shall secure full form Protection and Indemnity (P&I) marine insurance coverage (including War Risks and pollution liability coverage) on each ship. The insurance coverage shall cover all liabilities (other than liability for loss of or damage to Government cargo carried onboard the ship) in an amount of at least $3,000,000 per ship per incident, and shall cover all liabilities for pollution from oil or hazardous substances in an amount of $5,000,000 or up to the P&I club limit per ship per incident.
Except as provided herein the, Contractor shall be responsible for the cost of such insurance, including deductibles and any supplemental calls.
The United States of America shall be named as an Additional Assured under the insurance policies, and the Underwriter must expressly agree to waive any rights of subrogation against the United States of America. The Cover note must show the risks insured, expressly name the United States of America as an Additional Assured, and contain a notation that the underwriters agree to waive any rights of subrogation against the United States of America, state the amount of insurance deductibles (if any), and exclusions (if any) for basic, war risk, and pollution coverage.
The United States of America is the Owner of the Vessels under this Contract and might be held liable for damages arising from or related to the operation of these Vessels. Consequently, the Contractor agrees to completely indemnify and hold harmless the United States, even in cases where the United States of America is found to be negligent, from any and all liability (including pollution liability), which would be covered by the customary full form P&I insurance if the Vessels were privately owned.
To the extent that the United States is held jointly and severally liable with the Contractor, the United States shall be responsible for that portion of liability which exceeds the amount of the Contractor’s required P&I insurance coverage per Vessel per incident, unless the liability was caused in whole or in part by any willful misconduct or lack or good faith by any of the Contractor’s shore-based managers, project manager, boat captain, crew members, or equivalent representatives.
The Government shall retain such risks of property loss or damage to the said Vessels and associated fixtures, as would be covered by an American Hull Institute policy. The Government shall also retain the risk of property loss or damage to any Government cargo loaded on the Vessels. The Contractor shall notify the Contracting Officer of all incidents within the scope of such coverage, by the most expeditious means within six hours of the discovery of the incident. The Contractor shall submit claims for reimbursement for repairs and other expenses, pursuant to the Government’s undertakings, to the Contracting Officer in accordance with applicable billing instructions. Mark any such claim as an “Insurance Claim.” As operators of public Vessels of the United States, the Contractor may become involved in the litigation maintainable against the United States under the Public Vessels Act, 46 U.S.C.
App. §§ 781-790 (PVA), Section 782 of which incorporates the not inconsistent provisions of the Suits in Admiralty Act, 46 U.S.C. App. §§ 741-752 (SAA). The control of litigation on behalf of the United States is, however, reserved by law to the Attorney General and U.S. Department of Justice Attorneys. 28 U.S.C.
§§ 501-530.
The Contractor shall provide the Government with immediate notice of any legal action, libel in admiralty, or claim of any nature whatsoever which may be brought against the Government, the Vessel, the Contractor, or the Contractor's underwriters and arises during the performance of and/or as a result of this Contract. The Contractor shall also provide the Government with immediate notice of any legal action brought by the Contractor that arises from, or is related to the performance of this Contract. Such notice shall include copies of any summons and complaint or of any notice to show cause, notice of motion, or notice of petition which may be brought, made, or filed in any District court of the United States or in any other court purporting to have jurisdiction thereof; and such notice shall be sent by the fastest mail service provided by the United States Postal Service to:

Thereafter, the Contractor shall ensure that its underwriters and its attorneys and counsel cooperate with Government counsel in maintaining the defense of any such action or application for relief.
The Contractor will provide the Contracting Officer with copies of the insurance policies and binders covering these ships and such other documentation as is necessary to establish that the insurance coverage is in full force and effect. The Contractor will not terminate the insurance without the Contracting Officer's prior written approval and will promptly notify the Contracting Officer of any pending change or threatened cancellation of the insurance.
The Government will have the right to require the Contractor to secure additional customary Marine Insurance coverage including increases in the amount of P&I coverage. In such event, the Contractor will exercise its best efforts to obtain such additional insurance coverage at reasonable rates and in any event the Contracting Officer's approval is required prior to final placement of the insurance. The cost of such additional insurance will be for the Government's account.
3.7.2 PERMITS AND LICENSES. The Contractor shall obtain all required permits, licenses, and authorizations to perform work under this contract and comply with all the applicable federal, state and local laws and regulations.
3.7.3 MANAGEMENT:
3.7.3.1 The Contractor shall manage the total work effort associated with the services required herein to meet the performance objectives and standards. Such management includes but is not limited to planning, scheduling, cost accounting, report preparation, establishing and maintaining records, and quality control. The Contractor shall provide staff with the necessary management expertise to assure contract performance.
3.7.3.2 The Contractor shall assign a Project Manager as the government’s direct point of contact (POC) for all contractor task direction. This individual will manage all contractor employees on site.
An alternate Project Manager will be required during periods of the manager’s absence. The Project Manager shall be available for communications of routine and emergent requirements at all times.
The Project Manager shall attend daily scheduling meetings to discuss daily requirements for barrier operation.
3.7.4 CREW QUALIFICATIONS.
The contractor shall provide experienced, qualified, and capable personnel to perform the work in this contract. Personnel shall be fully knowledgeable of all safety and environmental requirements associated with the work they perform. Personnel shall speak, read, and comprehend English to the extent that they can read and understand printed regulations, detailed written orders, operating procedures, training instructions and materials. Sleeping while on duty is prohibited. The contractor shall ensure that all contractor personnel have received proper safety training, appropriate to their respective jobs and Crew personnel shall meet training standards of the Contractor’s insurer, be a U.S. Citizen, eligible and cleared for base access.
Key Personnel: Project Manager - The Project Manager shall obtain and maintain a Secret Clearance during contract period of performance. The contractor shall provide the Project Manager’s resume to the Government.
Qualifications must include an in-depth waterfront and boat operations experience. Qualifications must include any of the listed Merchant Marine Credentials: Master Any Gross Ton, Master 1600 GRT Chief Mate Any Gross Tons or equivalent service qualifications.
Non-Key Personnel: Boat Captain - Shall possess and maintain a U.S. Coast Guard 50 Ton Master License during contract period of performance; minimum of two years’ experience as a 50 Ton Master and eligibility for a CONFIDENTIAL security clearance. Must possess Transportation Workers Identification Card (TWIC).
Non-Key Personnel: Boat Crew - Crew members shall possess and maintain required U.S. Coast Guard Licenses during contract period of performance; shall have a minimum of two years’ experience as Boat crew/captain and eligibility for a CONFIDENTIAL security clearance. Must possess TWIC.
It is the contractor’s responsibility to maintain their Key and Non-Key Personnel boat licenses.
Standardized training must be conducted to support Navy Mission Essential Task. The guidance delineated in the CNIC Instruction 3500.1 applies to military, civilian and contractor personnel. In accordance with CNIC Instruction 3500.1, contractor personnel assigned as coxswains shall attend the five-day Shore Installation Management Basic Boat Coxswain (SIMBBC) training courses CIN# S-540-1007, or possess their U.S. Coast Guard Operator of Uninspected Passenger Vessel License (OUPV), commonly referred to as “the six pack “license. Upon satisfactory completion of the SIMBBC training course or after having obtained an OUPV License, personnel shall complete the appropriate portions of the SIMBBC Personal Qualification Standard outlined in reference (c), or vessel familiarization training as required by the installation Commanding Officer (CO). All crew members must be second-class swim qualified or have US Coast Guard approved Water Survival certification.
3.7.5 EMPLOYMENT OF NAVY PERSONNEL RESTRICTED.
During performance of this contract, the Contractor shall not use as a consultant or employee (on either a full or part time basis) any active duty military or civilian Navy personnel without the prior approval of the Contracting Officer. Such approval may be given only in circumstances where it is clear that no laws and no Department of Defense (DoD) or Navy instructions, regulations, or policies might possibly be contravened, and no conflict of interest or appearance of a conflict of interest will result. There shall be a clear distinction between Government employees and contractor employees. Contractor employees will identify themselves as contractor personnel by introducing themselves or being introduced as contractor personnel and displaying distinguishing badges or other visible identification for meetings with Government personnel. In addition, contractor personnel shall appropriately identify themselves as contractor employees in telephone conversations and in formal and informal written correspondence.
3.7.6 SECURITY CLEARANCE.
3.7.6.1 The Contractor shall obtain all required corporate and personnel Security Clearances (including interim clearances). The Contractor shall complete all necessary forms and provide other information as required by the Defense Industrial Security Clearance Office (DISCO) for the purpose of initiating clearance requests at the time of award. The Contractor shall ensure that a list of all personnel with Security Clearances is maintained current, including clearances that are pending and will be made available to Contracting Officer and CNRMA upon request. All contractor personnel will complete Questionnaire for National Security Positions (SF86) via the OPM Electronic Questionnaire for Investigations processing (e-QIP) tool. DISCO will adjudicate to national security standards, make the eligibility determination and record in (JPAS). All Contractor employees are required to have a SF-86 NACLC adjudicated for Confidential clearance eligibility.
The Contractor shall collect, review and submit all applicable documents to DISCO to initiate and complete the NACLC adjudication. All Contractor personnel shall undergo and receive a favorable NACLC. The Government may allow interim approvals.
3.7.6.2 Facility Clearance: A Facility Clearance is required at the time of award. The Contractor shall furnish the information required on the DD Form 254, Contract Security Classification Specification Form.
3.8. INSTALLATION ACCESS:
All Contractor personnel are required to obtain access to the installation by participating in the Defense Biometric ID System (DBIDS). Contractor personnel are to immediately report instances of lost or stolen badges to the COR.
3.8.1 DEFENSE BIOMETRIC ID SYSTEM (DBIDS). DBIS is a program in which Contractor personnel who enroll, and are approved, are subsequently granted access to the installation for a period up to one year, or the length of the contract, whichever is less, and are not required to obtain a new pass from the Base Pass and Identification Office for each visit. The Government performs background screening and credentialing. Throughout the year, the Contractor employee must continue to meet background screening standards. Periodic background screenings are conducted to verify continued DBIS participation and installation access privileges. Any time invested, or price(s) paid, for obtaining DBIS credentials will not be compensated in any way or approved as a direct cost of any contract with the Department of the Navy.
3.8.2 QUALITY CONTROL INSPECTION AND SURVEILLANCE.
The Contractor shall establish and maintain a Quality Control (QC) inspection system in accordance with the FAR Clause 52.246-4, INSPECTION OF SERVICES-FIXED PRICE, to ensure the work performed conforms to the contract requirements. The Contractor shall maintain a file of all scheduled and performed QC inspections, inspection results, and dated and details of corrective and preventive actions. The file will be the property of the Government and made available during the Government’s regular working hours.
The contractor shall turn over the file to the Contracting Officer within five calendar days of the completion/termination of the contract.
3.8.3 SAFETY INSPECTIONS AND MONITORING.
The Contractor shall conduct inspections of its work areas, job sites and work crew to ensure that all Contractor operations are being conducted safely. These inspections will ensure the site is safe and free of job-site hazards, Contractor personnel are utilizing/wearing proper Personal Protective Equipment (PPE), safe work practices and processes are being followed and ensure workers are familiar with the hazards covered in the respective AHA for that work activity. The Contractor shall inform the COR verbally and in writing immediately of any known discrepancies that may impact operations, pose a hazard to navigation or be a potential safety hazard to equipment and or personnel.
3.8.4 ACCIDENT AND DAMAGE REPORTING.
The contractor will notify the COR of all damages, all barrier gate breaks to include incidents of damage to property, accidents, mishaps, and near misses that occur on or related to Government property as soon as practical, but not later than four hours. All accident written reports must be submitted to the COR within twenty-four (24) hours of the accident.
4.0 GOVERNMENT SPACES AND GOVERNMENT EQUIPMENT.
The Government will provide the space listed below. Contractor shall provide furniture, office automation equipment, phone and phone service off base.
4.1 Shared Conex box space with government personnel approximately 30 square feet in size with lighting and HVAC, at Norfolk Naval Shipyard, Norfolk VA for boat crew.
4.2 Shared Space - Communal heads, lounges will be available for shared use with the Government.
5.0 GOVERNMENT RESOURCES.
There will be a joint initial inspection of Government resources; and periodic joint inspections through the life of the contract. Equipment lost or damaged due to contractor neglect will be replaced by contractor at no cost to the Government.

6.0 REQUIRED REPORTS.
6.1 The Contractor is required to provide crew rosters to the Government by the fifth of every month. Crew roster shall include full name, contact numbers, employment category, and employment title. The contractor is required to submit written accident reports to the COR within twenty-four (24) hours of the accident.
6.2 In case of safety hazard, the contractor notifies the COR as soon as practical and will prepare a written statement about safety hazard.
6.3 The contractor is required to submit daily boat usage logs which include hours used and barriers attended information in the format provided.
a. Barrier Boat daily inspection sheets by 1200 noon.
b. Barrier Boat inspection daily, monthly, quarterly inspection.
c. Norfolk daily boat status report
d. Weekly barrier boat repair work-order submission report
e. Provide monthly identified discrepancies. Equipment includes ASCB, Boats, and radios.

7.0 ENTERPRISE-WIDE CONTRACTOR MANPOWER REPORTING APPLICATION (ECMRA)
The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract via a secure data collection site. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:
(1) W, Lease/Rental of Equipment;
(2) X, Lease/Rental of Facilities;
(3) Y, Construction of Structures and Facilities;
(4) D, Automatic Data Processing and Telecommunications, IT and Telecom- Telecommunications Transmission (D304) and Internet (D322) ONLY;
(5) S, Utilities ONLY;
(6) V, Freight and Shipping ONLY.
The contractor is required to completely fill in all required data fields using the following web address: sam.gov.
Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year. Contractors may direct questions to the help desk, linked at sam.gov.
8.0 ABILITYONE CLOSE-OUT:
NAVSUP FLC Norfolk may utilize contractor support through the AbilityOne Program, as needed, to perform contract closeout functions for this acquisition. Information, including business sensitive/confidential or proprietary data, that the offeror/contractor provides to the Government or information already in the possession of the Government may be viewed and utilized by the AbilityOne Program support contractor personnel during the course of its contract performance. The information that may be made available to the support contractor may include, for example, pricing and technical proposals, historical contract, pricing and performance information, Commercial Asset Visibility (CAV) reporting information and similar data/information.
By submission of a proposal in response to this solicitation, the offeror/contractor and its subcontractors consent to a release of their business sensitive/confidential or proprietary data to the Government's AbilityOne Program support contractor personnel in order to perform close out services. Prior to the release of any such information to the support contractor, the support contractor will have in place with the Government a Non-Disclosure/Non-Use Agreement in accordance with the terms of the AbilityOne Program support contract.
Offerors may execute their own Non-Disclosure Agreement with the AbilityOne Program (AbilityOne contact information available from the contracting point of contact). The support contractor must provide copies of the executed agreements to the Contracting Officer and the Contracting Officer's Representative (COR) for the support contract; and the offeror/contractor for this acquisition must provide copies of the executed Agreement to the Contracting Officer for this acquisition. If the offeror/contractor seeks such a Non-Disclosure Agreement with the AbilityOne Program support contractor, the Agreement must be executed no later than the date of final delivery under the resulting NAVSUP FLC Norfolk contract.
9.0 CONTRACTOR UNCLASSIFIED ACCESS TO FEDERALLY CONTROLLED FACILITIES,
SENSITIVE INFORMATION, INFORMATION TECHNOLOGY (IT) SYSTEMS OR PROTECTED
HEALTH INFORMATION:
Executive Order 13467, Reforming Processes Related to Suitability for Government Employee, Fitness for Contractor Employees and Eligibility for Access to Classified National Security Information, Homeland Security Presidential Directive (HSPD)-12, requires government agencies to develop and implement Federal security standards for Federal employees and contractors. The 5 CFR 32 Part 157 in concert with DoD Manual 1000.13, Vol 1, implements the Federal Standards.
APPLICABILITY
This text applies to all DoD sponsored individuals who require CAC eligibility (or login and P/W if acceptable per contract) for: Physical access to DoD facilities or non-DoD facilities on behalf of DoD; Logical access to information systems (whether on site or remotely); or remote access to DoD networks that use only the CAC logon for user authentication, or access to sensitive and protected information. This applies to the Office of the Secretary of Defense, the Military Departments, the Office of the Chairman of the Joint Chiefs of Staff and the Joint Staff, the Combatant Commands, the Office of the Inspector General of the DoD, the Defense Agencies, the DoD Field Activities and all other organizational entities within the DoD (hereinafter referred to collectively as the "DoD Components").
Each contractor employee providing services at a Navy Command under this contract is required to obtain a Department of Defense Common Access Card (DoD CAC). Additionally, depending on the level of computer/network access, the contract employee will require a successful investigation as detailed below.
ACCESS TO FEDERAL FACILITIES
Per HSPD-12 and implementing guidance, all contractor employees working at a federally controlled base, facility or activity under this clause will require a DoD CAC. When access to a base, facility or activity is required contractor employees shall in-process with the Command’s Security Manager upon arrival to the Command and shall out-process prior to their departure at the completion of the individual’s performance under the contract.
START-UP PERIOD
All contractor resource onboarding documents must be submitted via the prime contractor. The prime contractor shall make all necessary preparations to assume full responsibility for productive performance of the performance start date.
Definition of productive:
a. Visit Authorization Request (VAR)
b. Contractor Information Sheet (CIS)
c. Completed EQIP (Electronic Investigation)
d. All contractor resource(s) must have an active JPAS profile.
e. Common Access Card (CAC)
Note (1): Invoicing by the contractor will begin as of the commencement of the performance period of services and no reimbursement will be paid by the government for efforts expended during the start-up period.

(ERP).
ACCESS TO DOD INFORMATION TECHNOLOGY ( IT) SYSTEMS
In accordance with (IAW) Secretary of the Navy (SECNAV) M-5510.30, contractor employees who require access to DoN or DoD networks are categorized as IT-I, IT-II, or IT-III. The IT-II level, defined in detail in SECNAV M- 5510.30, includes positions which require access to sensitive information. Sensitive information includes information protected under the Privacy Act, to include Protected Health Information (PHI). All contractor employees under this contract who require access to Privacy Act protected information are therefore categorized no lower than IT-II. IT Levels are determined by the requiring activity’s Command Information System Security Manager (ISSM)/Information Assurance Manager (IAM).
Contractor employees requiring privileged or IT-I level access, (when specified by the terms of the contract) require a Single Scope Background Investigation (SSBI) or T5 or T5R equivalent investigation , which is a higher level investigation than the National Agency Check with Law and Credit (NACLC)/T3/T3R described below. Due to the privileged system access, an investigation suitable for High Risk national security positions is required. Individuals who have access to system control, monitoring, or administration functions (e.g. system administrator, database administrator) require training and certification to Information Assurance Technical Level 1, and must be trained and certified on the Operating System or Computing Environment they are required to maintain.
Access to sensitive IT systems is contingent upon a favorably adjudicated background investigation. When access to IT systems is required for performance of the contractor employee’s duties, such employees shall in-process with the Navy Command’s CSM and ISSM/IAM upon arrival to the Navy command and shall out-process prior to their departure at the completion of the individual’s performance under the contract. Completion and approval of a System Authorization Access Request Navy (SAAR-N) form is required for all individuals accessing Navy Information Technology resources. The decision to authorize access to a government IT system/network is inherently governmental. The contractor supervisor is not authorized to sign the SAAR-N; therefore, the government employee with knowledge of the system/network access required or the COR shall sign the SAAR-N as the “supervisor.”
The SAAR-N shall be forwarded to the Command’s Security Manager at least 30 days prior to the individual’s start date. Failure to provide the required documentation at least 30 days prior to the individual’s start date may result in delaying the individual’s start date.
When required to maintain access to required IT systems or networks, the contractor shall ensure that all employees requiring access complete annual Cyber Awareness training, and maintain a current requisite background investigation. The Contractor’s Security Representative shall contact the Command Security Manager for guidance when reinvestigations are required.
INTERIM ACCESS
The Command's Security Manager may authorize issuance of a DoD CAC and interim access to a DoN or DoD unclassified computer/network upon a favorable review of the investigative questionnaire and advance favorable fingerprint results. When the results of the investigation are received and a favorable determination is not made, the contractor employee working on the contract under interim access will be denied access to the computer network and this denial will not relieve the contractor of his/her responsibility to perform.
DENIAL OR TERMINATION OF ACCESS
The potential consequences of any requirement under this clause including denial or termination of physical or system access in no way relieves the contractor from the requirement to execute performance under the contract within the timeframes specified in the contract. Contractors shall plan ahead in processing their employees and subcontractor employees. The contractor shall insert this clause in all subcontracts when the subcontractor is permitted to have unclassified access to a federally controlled facility, federally-controlled information system/network and/or to government information, meaning information not authorized for public release.
CONTRACTOR’S SECURITY REPRESENTATIVE
The contractor shall designate an employee to serve as the Contractor’s Security Representative. Within three work days after contract award, the contractor shall provide to the requiring activity’s Security Manager and the Contracting Officer, in writing, the name, title, address and phone number for the Contractor’s Security Representative. The Contractor’s Security Representative shall be the primary point of contact on any security matter. The Contractor’s Security Representative shall not be replaced or removed without prior notice to the Contracting Officer and Command Security Manager.
BACKGROUND INVESTIGATION REQUIREMENTS AND SECURITY APPROVAL PROCESS FOR
CONTRACTORS ASSIGNED TO NATIONAL SECURITY POSITIONS OR PERFORMING SENSITIVE
DUTIES
Navy security policy requires that all positions be given a sensitivity value based on level of risk factors to ensure appropriate protective measures are applied. Contractor employees under this contract are recognized as Non- Critical Sensitive [ADP/IT-II] positions when the contract scope of work require physical access to a federally controlled base, facility or activity and/or requiring access to a DoD computer/network, to perform unclassified sensitive duties. This designation is also applied to contractor employees who access Privacy Act and Protected Health Information (PHI), provide support associated with fiduciary duties, or perform duties that have been identified as National Security Positions. At a minimum, each contractor employee must be a US citizen and have a favorably completed NACLC or T3 or T3R equivalent investigation to obtain a favorable determination for assignment to a non-critical sensitive or IT-II position. The investigation consists of a standard NAC and a FBI fingerprint check plus law enforcement checks and credit check. Each contractor employee filling a non-critical sensitive or IT-II position is required to complete:
• SF-86 Questionnaire for National Security Positions (or equivalent OPM investigative product)
• Two FD-258 Applicant Fingerprint Cards (or an electronic fingerprint submission)
• Original Signed Release Statements
Failure to provide the required documentation at least 30 days prior to the individual’s start date shall result in delaying the individual’s start date. Background investigations shall be reinitiated as required to ensure investigations remain current (not older than 10 years) throughout the contract performance period. The Contractor’s Security Representative shall contact the Command Security Manager for guidance when reinvestigations are required.
Regardless of their duties or IT access requirements ALL contractor employees shall in-process with the CSM upon arrival to the command and shall out-process prior to their departure at the completion of the individual’s performance under the contract. Employees requiring IT access shall also check-in and check-out with the Navy Command’s ISSM/IAM. Completion and approval of a System Authorization Access Request Navy (SAAR-N) form is required for all individuals accessing Navy Information Technology resources. The SAAR-N shall be forwarded to the Navy Command’s Security Manager at least 30 days prior to the individual’s start date. Failure to provide the required documentation at least 30 days prior to the individual’s start date shall result in delaying the individual’s start date.
The contractor shall ensure that each contract employee requiring access to IT systems or networks complete annual Cyber Awareness training, and maintain a current requisite background investigation. Contractor employees shall accurately complete the required investigative forms prior to submission to the Command Security Manager. The Command’s Security Manager will review the submitted documentation for completeness prior to submitting it to the Office of Personnel Management (OPM); Potential suitability or security issues identified may render the contractor employee ineligible for the assignment. An unfavorable determination is final (subject to SF-86 appeal procedures) and such a determination does not relieve the contractor from meeting any contractual obligation under the contract. The Command’s Security Manager will forward the required forms to OPM for processing. Once the investigation is complete, the results will be forwarded by OPM to the DoD Central Adjudication Facility (CAF) for a determination.
If the contractor employee already possesses a current favorably adjudicated investigation, the contractor shall submit a Visit Authorization Request (VAR) via the Joint Personnel Adjudication System (JPAS) or a…
