15. Warranty provision:

Warranty Amended for Government Use Standard Warranty Period

The Warranties with respect to any Equipment shall remain in effect for the following period of time after inspection and acceptance of the Equipment to the Customer Site: (1) twelve (12) months for each

AccuVein vein illumination device; (2) ninety (90) days for any battery; and (3) twelve (12) months for all other Equipment.

Warranty matters will be coordinated with the appropriate government agency(ies).

The above warranty with periods and language will be a supplement to the government solicitation warranty clauses below:

52.212-4 (o) (TAILORED) Warranty: The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract. In the event that the terms of the contractor's standard commercial warranty conflict with the warranty terms contained in this clause, the terms of this clause will govern this contract, unless some other resolution is specified in the award document.

52.212-4 (p) (TAILORED) Limitation of liability: Except as otherwise provided by an express warranty, the contractor will not be liable to the Government in a breach of warranty action for consequential damages resulting from any defect or deficiencies in accepted items. In the event that the terms of the contractor's standard commercial warranty/limitation of liability clause(s) place greater limits on the contractor's liability than do the terms contained in this clause, the terms of this clause will govern the contract.

Return Goods Policy Amended for Government Use:

1. AccuVein will gladly process returns in the event of a shipping error made by AccuVein or if the item is damaged upon receipt. In this event, AccuVein will pay for the return of items shipped in error as well as the initial freight charges. The customer shall comply with AccuVein’s standard procedures and requirements relating to the return of any equipment. Shortages must be reported to Customer Service within ten (10) days after inspection and acceptance of order to earn a full refund less any restocking fees. No other returns are accepted.

2. All returns of damaged goods must be authorized in advance by AccuVein’s Customer Service

Department at 1-888-909-8888 and be assigned a Return Authorization number.

3. The Return Authorization will only be valid for thirty days (30) days.

4. Purchaser must provide its name, address, account number, purchase order number, quantity and description with serial numbers from equipment. The return authorization number shall be clearly marked on the outside of the box.

5. There is no restocking fee for errors made by AccuVein.
