BTE Technologies Commercial Warranty Amended for Government Use
BTE Technologies, LLC. (“BTE”) and the Customer agree that the following terms and conditions will apply to the service of BTE Equipment.
52.212-4 (o) (TAILORED)
Warranty: The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract. In the event, that the terms of the contractor’s standard commercial warranty conflict with the warranty terms contained in this clause, the terms of this clause will govern this contract, unless some other resolution is specified in the award document.
52.212-4 (p) (TAILORED)
Limitation of liability: Except as otherwise provided by an express warranty, the contractor will not be liable to the Government in a breach of warranty action for consequential damages resulting from any defect or deficiencies in accepted items. In the event that the terms of the contractor’s standard commercial warranty/limitation of liability clause(s) place greater limits on the contractor’s liability than do the terms contained in this clause, the terms of this clause will govern the contract.
COVERAGE, USE AND SERVICE: Warranty applies to all units purchased. All Customer Service support, technician labor and material necessary to repair the BTE Equipment and its attachments are covered. The warranty applies to one (1) unit only. If multiple units are purchased, warranty applies to each unit individually for one (1) year.
BTE will, without additional charge, repair the Equipment and return it to proper working condition in accordance with company criteria. The Customer will pay for loss or damage caused by the use of the Equipment for other than its intended purpose or unauthorized alterations and attachments made by the Customer. The Customer shall use the Equipment solely for its intended purpose and in the prescribed manner. The Customer shall be responsible for all loss and damage caused by Customer's negligence and shall pay for any repair or replacement and shipping costs made necessary by Customer's negligent act. Any maintenance resulting from other than normal operations of the Equipment, including Customer's fault, or misuse of the Equipment, will be invoiced to Customer as an additional charge.
The BTE Commercial Warranty Amended for Government Use:
TECHNICAL SUPPORT by TELEPHONE, EMAIL, and REMOTE LOGIN: Access to unlimited technical support through telephone, email, remote login (if available) and video. Technical support is limited to calibration instructions, software support, diagnosis of damaged components, and remote support for component replacement.

SOFTWARE UPDATES AND CORRECTIONS: This warranty includes BTE software updates and corrections when available and if necessary but does not include BTE upgrades or computer operating system upgrades (such as for
MS Windows).
TRAINING: During the term of this warranty, two (2) registrations per year for BTE’s Level Two Training Course ($990.00 value) are included at no additional charge. Training at the Customer site is available for up to 10 participants at a discounted rate of $1,100.00 per day plus reasonable travel and accommodation expenses.
PARTS AND LABOR: The repair of and/or replacement of all hardware and electrical components for the Equipment are included in this warranty. Replacement components will be provided only after the Equipment has been properly diagnosed through BTE's Customer Service department. Replacement components may be refurbished. For components that require the use of advanced technical skill, tools not provided by BTE, and/or weighs above 40 pounds, BTE will provide a technician at no additional charge to the Customer. Components that are shipped as a complete module and do not require technical skill or additional tools to install, to include computers, monitors, cables and modular electronic control boxes, will be installed by the Customer. This warranty does not cover consumable items such as printer cartridges, paper or batteries nor does it cover any cosmetic repairs that do not hinder the overall performance or functionality of the Equipment.
NEW ADD-ON PARTS DISCOUNT: During the term of this warranty, the Customer is entitled to a 35% discount off the retail cost for all add on parts not previously included with the Customers system or covered by this Agreement.
SHIPPING: For replacement parts covered during this warranty, BTE will pay the shipping charges to the Customer location and the return shipping charges to BTE when applicable.
REPLACEMENT PARTS: If a BTE Customer Service representative determines that a replacement part is necessary, the following steps ensue:
• BTE will ship the required part(s) to the Customer using standard courier service. Should the Customer wish expedited shipping, the Customer will be responsible for the additional shipping charge.
• Customer will ship the defective part(s) within 15 days to BTE’s Hanover, MD facility using a prepaid return label, provided by BTE.
• If the defective part(s) is not received by BTE within the allotted time, the Customer will be billed for the full retail price of the replacement part(s) minus the customers 35% parts discount.
• Parts that have been lost or damaged through negligence or abuse the Customer will be billed for the full retail price of the replacement part(s) minus the customers 35% parts discount.

BTE Technologies Implementation Plan for Government Use
The purpose of this document is to outline the steps BTE will employ to ensure all BTE products shipped are installed and fully operational.
- The BTE Sales Representative will provide the Site Requirements for any unit quoted or purchased by the Government. The Site Requirements outline the space required for the unit, the type of environment (temperature and humidity) required and the type of power required to operate the unit.
- BTE will send a Shipping Checklist with the BTE Order Acknowledgement, within 48 business hours of receipt of a purchase order from the Government. The Shipping Checklist is to be completed by the Government to confirm all needs are met for the equipment purchased. The Site Requirements will be included with the Shipping Checklist to verify all requirements are met, prior to shipment. BTE must receive the completed Shipping Checklist at least 3 days prior to equipment ship date. The equipment will not ship without the returned Shipping Checklist. A BTE representative will send reminders via email and will call the contacts on the order, if the Shipping Checklist is not received.

Installation Policy for Government Use
The purpose of this document is to describe the policy and state the conditions of the installation provided for all BTE products. Installation is included with all new BTE products placed into service within the 50 United States, to ensure proper setup and use of the BTE equipment in a clinical setting. For new BTE products utilized beyond the 50 States, installation is included but additional fees may be assessed when delivering overseas.
Once the equipment has been delivered by BTE’s shipping company, freight forwarder, or to the Government’s point of exportation, the Government shall contact BTE customer service at 1-800-331-8845 option 3, and do nothing else with the equipment until the authorized BTE representative arrives. Unboxing/unpacking and final assembly of your equipment is included in the purchase price of all units. BTE will do all of this for you. In the event BTE will not be performing “in person assembly” by request of the Government, BTE will include installation instructions which are located in the BTE Equipment User Manual, and online tutorials for assembly.
The BTE Installer will work with the Government to coordinate the final assembly and installation, for a date suitable to that clinic and staff’s schedule. Typically, the installation and setup of the equipment will take 2-4 hours, and the training, taking another 2-4 hours, will immediately follow that same day or the following. BTE will not send a representative on two separate occasions since installation and training are to be accomplished during one 1-2-day visit.
BTE Technologies Return Goods Policy Amended for Government Use
In accordance with 52.214-4 Contract Terms and Conditions – Commercial Items (OCT 2018)(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or Is not possible, the Government may seek an equitable price reductions or adequate consideration for acceptance of nonconforming supplies or services. The Government may exercise its post – acceptance rights-
(1) Within a reasonable time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition of the item, unless change is due to the defect of the item.
The purpose of this document is to describe the policy and state the conditions for returning non-defective goods.
RETURN POLICY:
BTE will accept product returns, so long as the following conditions are met:
- BTE must authorize the return of all products and assign an RMA number prior to the customer shipping material back to BTE.
- BTE Customer Service must be contacted within 30 days of acceptance to request an RMA number at 1-800- 331-8845 option 3.
- After the RMA is received, the product must be received by BTE within 14 calendar days.
- If the product is sent to BTE for return without the RMA number, the product will be refused.
- A 25% restocking fee will be charged on returns. If product was shipped in error by BTE, BTE will be responsible for the return freight.
- If the product is received damaged or defective, the Government will notify BTE of the damage or defective product and obtain the RMA. BTE is responsible for return freight charges.

BTE Technologies Training Policy for Government Use
The purpose of this document is to describe the policy and state the conditions of the training provided for all BTE products. Training is included with all new BTE products placed into service within the 50 United States, to ensure proper setup and use of the BTE equipment in a clinical setting. For new BTE products utilized beyond the 50 States, training is included but additional fees may be assessed when delivering overseas.
Once the equipment has been delivered by BTE’s shipping company, freight forwarder, or to the Government’s point of exportation, the Government shall contact BTE customer service at 1-800-331-8845 option 3, and do nothing else with the equipment until the authorized BTE representative arrives. Unboxing/unpacking and final assembly of your equipment is included in the purchase price of all units. BTE will do all of this for you. In the event BTE will not be performing “in person training” by request of the Government, BTE will offer remote training and tutorials.
The BTE Installer/Trainer will work with the Government to coordinate the final assembly and training, for a date suitable to that clinic and staff’s schedule. Typically, the installation and setup of the equipment will take 2-4 hours, and the training, taking another 2-4 hours, will immediately follow that same day or the following. BTE will not send a representative on two separate occasions since installation and training are to be accomplished during one 1-2-day visit.
The training provided serves to educate the BTE equipment users on the functions and use of both the software and hardware. At the completion of training, the BTE Trainer will conduct a Clinical Competency Review for the specific BTE Device to ensure all aspects of training were covered and that the users are comfortable getting started with utilization of their new BTE equipment.
In addition to our on-site training, BTE offers educational training courses for the EvalTech, Primus, and SIM II.
These courses are held throughout the year at our Baltimore office address 7455-L New Ridge Road, Hanover MD 21076. The two-day courses are scheduled on a Thursday and Friday with the exception of the EvalTech courses, which are 2 ½ days and begin on Wednesday afternoon. Please read the prerequisite requirements below if registering for an EvalTech Level 2 course.
Included with purchase a facility is entitled to 2 course registrations and one (1) hotel room for two (2) nights. BTE will provide lunch each day and offers a complimentary dinner on Thursday night. The cost of travel is the Government’s responsibility. Only one person per purchase, however, the rooms are double occupancy.
Instructions to register for a training course online: You will need the equipment’s serial number.

The host hotel in Baltimore provides a free shuttle to and from the airport and the course location (BTE office). After the registration is completed online and the course is confirmed a room will be reserved in the attendee’s name.

Additional information needed to register for an EvalTech Level 2 course:
EvalTech Users:
The Level 1 course is offered at the time of installation and training for the system. The Level 1 Competency Test must be taken following that training (after some time using the equipment to become familiar) and an ≥ 85% grade must be achieved in order to attend the Level 2 course in Baltimore, MD. A Level 1 Competency Test must be submitted and passed as a prerequisite for Level 2 Course registration.
The focus of the Level 2 course is on clinical applications; therefore, it is offered to licensed/registered/certified clinicians only. Class size is limited, and the course is very lab intensive.
If the clinician has not done so already, please access the EvalTech study materials under the Support Tab/EvalTech to help with taking the Level 1 Competency Test. The password for accessing the Study Materials and the Level 1 Competency Test is “evaltrain” and is included with the system’s installation information.
Level 1 Competency Tests must be received by BTE no later than 2 weeks prior to a Level 2 Course date.
Please allow additional time to retake the test, should that be necessary. A BTE Clinical Specialist/Instructor will contact the applicant to inform them of their test grade.
BTE Technologies PRO Extended Warranty Policy Amended for Government Use
BTE Technologies, LLC. (“BTE”) and the Customer agree that the following terms and conditions will apply to the service of BTE Equipment.
