Warranty Provision:

Limited Commercial Warranty:

PINNACLE™, HELIX™, and SUMMIT™ STAIR LIFTS

Harmar Mobility, LLC warrants to the original purchaser of a Pinnacle, Helix, or Summit

Stairlifts manufactured by us to be free from defects in material and workmanship for a

3-year period (Pinnacle/Summit), 2-year period (Helix) on all component parts of the lift.

The gear rack on Pinnacle stair lifts will offer an extensive warranty of 10-years. Harmar

Mobility offers a 1-year labor warranty for purchases through Harmar’s FSS contract.

Exceptions to this Limited Warranty are:

• Batteries are warranted for a 1-year period

• Damage resulting from improper installation or operation

• Negligence, alterations, abuse or misuse of the equipment

• Fire, flood, acts of God

• Torn or dirty upholstery

• Shipping damage

• Parts used that are not supplied by Harmar Mobility, LLC

• Labor fees for installation work, travel, repair, or service calls (after 1-year)

No warranty is extended, express or implied, whether of merchantability or fitness for a particular purpose, after expiration from the date of original purchase of the unit. Harmar

Mobility, LLC and its dealers shall not be liable for any consequential, special or incidental damages arising out of the purchase or use of the unit or resulting from the breach of this Limited Warranty, or any implied warranty. The limit of liability of Harmar

Mobility, LLC and its dealer hereunder shall be the unit’s purchase price. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, or legal remedies, so these above limitations may not apply to you. All warranty claims must be reported to the dealer from whom the lift was installed as they have responsibility for handling your warranty claim. The dealer is to contact the Service Department of Harmar Mobility, LLC and provide the serial number of the lift along with a description of the events leading to the warranty claim. It is permissible to have any repairs or replacement work done as a result of any defects in material and workmanship by someone other than the Dealer under this Limited

Warranty. However, the Limited Warranty does not cover any charges or expenses assessed by any such other person or company performing such repairs or replacement work. All parts used to replace defective materials must be genuine Harmar Mobility, LLC parts to be covered by this Limited Warranty. This Limited Warranty gives you specific legal rights, and you may have other rights which vary from state to state.

Harmar will not, under any circumstances, be liable for the loss of the use of its products or loss of time. Defective parts must be returned, if requested, prepaid, to Harmar for inspection prior to credit or replacement. At Harmar’s discretion, any part found to have been modified, over-stressed, damaged by accident, or misused is not covered by this warranty.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES OR CONDITIONS,

INCLUDING ALL IMPLIED WARRANTIES OR MERCHANTABILITY OR FITNESS FOR

A PARTICULAR PURPOSE, AND THERE ARE NO WARRANTIES THAT EXTEND

BEYOND THE DESCRIPTION OF THE LIMITED WARRANTY DESCRIBED HEREIN.

This warranty supplements the clauses below:

CLAUSES FOR ADDENDA 52.212-4

52.212-4 (o) (TAILORED)

Warranty: The Contractor warrants and implies that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract. In the event that the terms of the contractor’s standard commercial warranty conflict with the warranty terms contained in this clause, the terms of this clause will govern this contract, unless some other resolution is specified in the award document.

52.212-4 (p) (TAILORED)

Limitation of liability: Except as otherwise provided by an express warranty, the contractor will not be liable to the Government in a breach of warranty action for consequential damages resulting from any defect or deficiencies in accepted items. In the event that the terms of the contractor’s standard commercial warranty/limitation of liability clause(s) place greater limits on the contractor’s liability than do the terms contained in this clause, the terms of this clause will govern the contract.

Limited Commercial Warranty:

HIGHLANDER™ SERIES

RESIDENTIAL-COMMERCIAL-ENCLOSED PLATFORM LIFTS

Harmar Mobility, LLC warrants to the original purchaser of a Residential-Commercial-

Enclosed Vertical Platform Lifts (RPL/CPL/EPL) manufactured by us to be free from defects in material, mechanical and electrical components (parts) for a period of one (1) year (RPL) and (2) years (CPL/EPL), provided that the products have been installed, maintained and operated properly by an Authorized Harmar Distributor and trained

Installer. Harmar Mobility offers a one-year labor warranty for purchases through

Harmar’s FSS contract.

Exceptions to this Limited Warranty are:

• Batteries are limited to one (1) year warranty with a Harmar-supplied/approved charger

• Damage resulting from improper installation or operation

• Negligence, alterations, abuse or misuse of the equipment

• Fire, flood, acts of God

• Shipping damage

• Parts used that are not approved by Harmar Mobility, LLC.

• Labor fees for installation work, travel, repair, or service calls (after 1-year)

• Additional parts/labor related to code compliance that were not identified on the original order

• Outdoor installation within 10-miles of a coastline offers 90-days warranty

(RPL/CPL/EPL) and expressly excludes rust after 30 days. Warranty is extended to

180-days with Premium Protection Option.

• Outdoor installation greater than 10-miles of a coastline offers 6-months warranty

(RPL) and 1-year warranty (CPL/EPL) and expressly excludes rust after 30 days.

Warranty is extended to 1-year (RPL) and 2-years (CPL/EPL) with Premium

Protection Option.

• Due to the nature of steel construction being permanently placed in an outdoor environment and its inherent unpredictability, minor paint defects and cosmetic rust are not covered after 30 days by Harmar’s Limited Warranty.

• Harmar enclosures, when used, are designed to protect a CPL and its users from being directly affected by the elements. It is NOT intended nor designed to be completely waterproof.

This warranty starts on the date of initial product installation (not to exceed 90 days from the date of manufacture), provided the warranty certificate is completely filled out and returned to Harmar within ten (10) days of installation. Harmar and its dealers shall not be liable for any consequential, special or incidental damages arising out of the purchase or use of the unit or resulting from the breach of this Limited

Warranty, or any implied warranty. The limit of liability of Harmar and its dealer hereunder shall be the unit’s purchase price. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, or legal remedies, so these above limitations may not apply to you. All warranty claims must be reported to the dealer from whom the lift was purchased as they have responsibility for handling your warranty claim. The dealer is to contact the Technical

Services Department of Harmar and provide the serial number of the product along with a description and evidence of the defect(s) supporting a warranty claim. It is permissible to have any repairs or replacement work done as a result of any defects in material and workmanship by someone other than the Dealer under this Limited Warranty. However, the Limited Warranty does not cover any charges or expenses assessed by any such other person or company performing such repairs or replacement work. All parts used to replace defective materials must be genuine Harmar parts to be covered by this Limited

Warranty. This Limited Warranty gives you specific legal rights, and you may have other rights which vary from state to state.

52.212-4 (p) (TAILORED)

Limitation of liability: Except as otherwise provided by an express warranty, the contractor will not be liable to the Government in a breach of warranty action for consequential damages resulting from any defect or deficiencies in accepted items. In the event that the terms of the contractor’s standard commercial warranty/limitation of liability clause(s) place greater limits on the contractor’s liability than do the terms contained in this clause, the terms of this clause will govern the contract.

Return Goods Policy:

No returns will be allowed after 30 days on stock items, and custom parts are not returnable. No returns will be accepted without prior authorization and a Harmar Return

Merchandise Authorization (RMA) number which can be obtained direct by Harmar (see phone or email procedure below). Once the RMA is authorized and issued, a credit will be given prior to the actual return.

Serial numbers are assigned to the End User and documented on invoice paperwork, so clearly mark RMA number on all return documents and the address label of each package being returned. Returned merchandise must include all original parts, shipping materials, blank warranty cards, accessories and documentation and be in as-new condition. If a return is a result of an error by the ordering entity, a 25% restocking fee and freight charges will apply. If the return is due to Harmar error, no restocking fee or return freight will be charged. RMA numbers cannot be extended or re-issued.

• Returns requested due to End User Expiration will be automatically accepted with

NO restocking fees. If the product is custom built, Harmar will only issue credit for common parts, if applicable.

• Returns requested due to End User Refusal will be assessed a 25% restocking fee. Harmar maintains a robust process to interview and evaluate each End User and their needs which includes a thorough review of the product, its features, and user requirements. When product is refused due to End User preference, Harmar will attempt to convince End User to proceed with install, but if unsuccessful, a restocking fee will apply.

• Returns requested due to PO Expiration will be closely monitored by Harmar.

If the End User is unable to accommodate the product installation within 70 days from PO date for any reason, Harmar will provide a disposition letter to the

Purchasing Agent. Harmar will review the disposition options and assist in making a decision up to day 180 from the PO date. If no decision can be made within 180-days, Harmar will close the opportunity and issue RMAs to have products returned to Harmar.
