Justification and Approval (J&A)
For Other Than Full and Open Competition
Acquisition Plan Action ID: 36E776-19-AP-0022
1. Contracting Activity:
Department of Veterans Affairs, VISN 22, SAN DIEGO VAMC Medical Center through purchase request 664-19-1-5034-0038 to Program Contracting Activity Central (PCAC).
2. Nature and/or Description of the Action Being Processed:
This limited source justification is for the procurement of Metering Services at the San Diego
VA Medical Center. Currently the Medical Center’s sub-metering system is not communicating to the national system as intended. The awarded contractor will identify which meters are working properly and which need repaired, calibrate the meters, and then tie-in to the national metering system. The procurement will be a new contract through a firm-fixed-price award.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
Locate all advanced metering systems, devices, units, and associated peripheral equipment
(electrical, water, natural gas, steam). Determine if all meters are properly connected to the system and properly powered. Determine if all metering data is being reported in “real- time” events to the VA Corporate -Wide Advance Utility Metering Database. Determine if the VA internal phone network (supporting of the advanced metering systems) is properly functioning.
Contractor is to calibrate all meter types (electric and non-electric). Contractor is to provide complete communication and connection from all submeters to the national metering network monitoring system (VA Corporate -Wide Advance Utility Metering Database).
4. Statutory Authority Permitting Other than Full and Open Competition:
41 USC §3304(a)(5), 38 U.S.Code § 8127, as implemented by FAR 6.302-5 (Authorized or
Required by Statute). COs may use the non-competitive (sole source) procedures authorized in
VAAR 819.7007 or 819.7008 up to $5M. Check the specific VAAR clause used below:

or
( ) 819.7008 Sole source awards to a verified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the
Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
Authorized or Required by Statute (FAR 6.302-5) - PL 109-461, Veterans First Contracting Act, permits a Contracting Officer to sole-source to a Service-Disabled Veteran-Owned Small
Business up to $5M. Venergy Group LLC is a SDVOSB verified by the Center for Verification and Evaluation (CVE). Venergy Group has a team of integrators that are currently in the process of integrating all mechanical and electrical meters into the BMS/Johnson Controls System for
VISN 10/11. The Venergy Team has been assessing meters at over 100 VAs nationwide to determine if the meters are properly installed, connected and function correctly in the Advanced
Utility System and Database. Venergy Group has also been replacing, repairing, calibrating and integrating/reintegrating meters that are not working properly to the AUMS.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Authorized or Required by Statute (FAR 6.302-5) - PL 109-461, Veterans First Contracting Act, permits a Contracting Officer to sole-source to a Service-Disabled Veteran-Owned Small
Business up to $5M. In accordance with VAAR 819.7007(b), the contracting officer’s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer. A determination that only one SDVOSB concern is available to meet the requirement is not required.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The contracting officer believes the anticipated cost will be considered fair and reasonable by requiring a detailed breakdown from the contractor and comparing it to the independent government cost estimate (IGCE). This will allow the Contracting Officer to compare and see the number of units and the unit pricing. Since the solicitation will be issued as a Request for Quote, the contracting officer has the authority to enter into discussions and negotiate the price, if necessary. Venergy Group LLC has completed similar projects for the VA at a fair and reasonable price so there is historical data that can also be utilized in negotiations.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
This was previously issued as a SDVOSB set-aside. Venergy Group LLC was the only vendor to submit a quote; however, no award was made due to price. Venergy indicated they are still interested in providing services.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
None
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
In accordance with VAAR 819.7007(b), the contracting officer’s determination whether to make a sole source award is a business decision wholly within the discretion of the contracting officer.
A determination that only one SDVOSB concern is available to meet the requirement is not required.
12. Requirements Certification:
I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
