Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Items are to be delivered to Multiple CMOP locations for the National CMOP.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The National CMOP, 5049 S. 13th Street, Leavenworth, KS 66048, Consolidated Mail Outpatient Pharmacy is requesting approval to purchase BRAND NAME specific NDC’s for Levetiracetam in multiple MG. This is a new procurement and will be a firm fixed price contract. The total estimated value for this request is $**REDACTED**.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Within the VHA brand name products may be prescribed by physicians when in their clinical judgment, the brand name product will provide a better therapeutic outcome for patients. Brand name products are requested when there is a clinical requirement for the item. In this case, the brand specific item is requested on the list above. The Pharmacy Benefits Management Services requires that this product be used with certain patients due to the unique fillers that it contains. No other brand can be consumed by the patients without adverse reaction. The requesting pharmacy indicated these items could be obtained from multiple businesses. At this time, the physicians have stated the above-mentioned name brand products are the only brand that will meet the specific needs of the patients, however, we are still competing this amongst distributors.
4. Description of market research conducted and results or statement why it was not conducted:
After searching NAC & GSA, there are no available contracts for any of the items requested. A search of the Center for Veteran Enterprise Vendor Information Pages indicates there are 58 SDVOSB vendors which are engaged in the manufacture of pharmaceutical items. A query at the SBA Dynamic Search portal returned 97 possible small business vendors. However, these vendors are not engaged in manufacture, but are distributors for large business wholesalers. Because the Government is not allowed to do business using Wholesale Trade or Retail Trade NAICS codes, searches must be conducted using the manufacture NAICS code of 325412 Pharmaceutical Preparation Manufacturing.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
