Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID:___36C263-22-AP-0451___________________

1. Contracting Activity: Department of Veterans Affairs, NCO 23, St Cloud VA Health Care System, Supply Team, St Cloud MN.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

NWIHCS, Omaha requires a temporary MRI to provide medical imaging services to the Veterans within the NWIHCS service area. Construction has been delayed and there is currently a Mobile MRI on site and a Bridge Contract needs to be awarded to ensure continuity of service. The estimated amount of this contract is $242,845.14 for a two -month period with two, two month continuation options.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

NWIHCS currently leases a temporary MRI system from PHILIPS ELECTRONICS NORTH AMERICA CORPORATION, PHILIPS HEALTHCARE, A DIVISION OF PENAC to provide imaging services for the Veterans within the service area.

The unit has all the necessary medical gas, water, and IT connections needed for operations and is configured to allow for safe access without leaving the facility. To do this, modification of the facility was required. The removal of the current system to accommodate a new/alternate one, would require approximately a month for alterations to make the passage useable.

The staff has been trained on the current system and have been utilizing it for the past 4 years +. Contracting for a new MRI system will require additional training, which has been affected by the COVID19 pandemic. Travel to and from training sites is not yet approved, and a number of vendors cannot send their training staff out to VA sites to provide onsite training. Additionally, training on a new system would take time that the staff does not have due to the pending shut down of our primary MRI suite for renovation.

NWIHCS is currently in the process of constructing an MRI suite which will house two fixed MRI units within the facility. There will be a short period of an additional month between when the current contract ends, and construction is complete. The original need was from 1 August 2021 to 31 December 2021. However, due to unforeseeable logistics issues associated to the COVID 19 pandemic, there will be a requirement to provide continued services.

4. Description of market research conducted and results or statement why it was not conducted:

Market research was not conducted as this Mobile MRI is already in place. The length of time required for a new contract acquisition and the length of time required to facilitate the move, set-up, and connection of required items would render the bridge contract moot. NWIHCS would not be able to provide MRI services to the Veteran community.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief. Note: COs are required to make a determination of price reasonableness IAW FAR 13.106-3.
