(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

a. Only One Responsible Source (FAR 6.302-1) – Name Brand. The Surgery service line determined the Stryker system as the only one capable of meeting the needs of the facility through hands on trails conducted by end users in the surgery service line. The bulk of the requirement was ordered through DoD eCAT. It is essential to the function of the overall system that the remaining components being ordered through this requirement must have full interoperability with the Stryker brand components ordered through another source (eCAT).

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The contracting officer contacted Stryker to discuss the requirement, and was able to confirm that no other equipment is compatible. The facility is willing to purchase name brand (Stryker) equipment from any source that offers the products at fair market price.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost will be considered fair and reasonable based on competition between the various SDVOSB distributors for the product.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: The surgery service line conducted hands on trials of three brands (Stryker, Karl Storz, and Olympus) of surgical video systems to determine the best overall system for the facility needs. The Stryker brand was determined to best meet the facility needs.

About 80% of the requirement was placed through a DoD eCAT order. This requirement is for the balance of system equipment not available through DoD eCAT.

Market research for this requirement consisted of: Internet search, including GSA and Fed Biz Opps; discussions with Bio-med peer/ counterparts around VISN 23. The Stryker equipment requested in the IGCE and specifications must be procured to maintain interoperability with the Stryker system components ordered through eCAT.

Stryker sells the requested products directly, and has multiple possible SDVOSB partners. There is the potential to purchase from other Stryker business partners we may not aware of through market research.
