2. Nature and/or Description of the Action Being Approved: A Firm‐fixed price contract to provide two each Steris V‐PRO maX 2 Sterilizers to include: consumables, installation, and 1st year services, for the surgery department at the Minneapolis VA Health Care System.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: Two each Steris V‐PRO maX 2 Sterilizers (Item Number: VP50001101), consumables (Item Numbers: 10092606, 886037, LCB044, LCB045, LCB046, PB011, PCC061, and PCC071), installation (Item Numbers: SE600962, and SE6009621) , 1st year services (Item Number: SE6009810000103), and Trade‐In Value of two existing Sterilizers.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.
Code § 8127(c), as implemented by FAR 6.302‐5 (Authorized or Required by Statute). COs may use the non‐competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below:

5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Steris V‐PRO maX 2 Sterilizers offers the “Fast Non Lumen Cycle” and produces a terminal sterilization solution in 16‐ minutes, in addition to the standard three cycles that the other company offers (Lumen, Non Lumen, and Flexible Cycles). Steris is currently the only manufacturer that offers a 16 minute cycle, with comparable sterilizers offering a 25 minute cycle, which is 9 minutes longer and not acceptable when a patient is waiting for an instrument. The purchase of this equipment will reduce the need for Immediate Use Sterilization, which the VA has been directed to limit is use in accordance with VHA Directive 1116 (2).

This is a Brand name only purchase of the Steris V‐PRO maX 2 Sterilizers and related components.
1st American Medical Distributors, Inc. is the sole SDVOSB distributor of these items for the
Manufacturer, Steris. 1st American Medical Distributors, Inc. is a verified Service‐Disabled
Veteran‐Owned Small Business (SVOSB), and is the only authorized SDVOSB distributor for Steris.
This requirement is being sole sourced to a SDVOSB as authorized by 38 U.S.C. 8127.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart
5.2 and, if not, which exception under 5.202 applies:
A source sought was issued to confirm that there were no other vendors that can provide a Fast Non Lumen Cycle of 16 minutes, and no instrumentation was identified that has the required characteristics. Steris currently has one authorized Service Disabled Veteran Small Business distributor, American Medical Distributors, Inc. Only this SDVOSB was reviewed, as the government is not willing to accept Grey Market Items. Sole sourcing to American Medical Distributors, Inc. is in the best interest of the government, as they are the only SDVOSB that can provide a sterilizer with the required characteristics.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: A comparison will be made to the prices found reasonable on previous purchase IAW FAR 13.106‐3 (a)(2)(ii).
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market Research was conducted on the Vetbiz registry, using NAICS code 339113, and 384 results were returned. Steris currently has one authorized Service Disabled Veteran Small Business distributor, American Medical Distributors, Inc.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: None.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required: In the future, should additional sterilizers be needed, the government will conduct market research to determine if additional sources can be found that have the required characteristics, and if so any future procurement will be through a competitive solicitation.
