Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: _36C263-18-AP-3103_____________
1. Contracting Activity: Department of Veterans Affairs, Network Contracting Office 23 (NCO 23), 4801
Veterans Drive, MN 56303. Organization Activity: Minneapolis VA Health Care System, One Veterans Drive Minneapolis, MN 55417, 618-19-1-4025-0002.
2. Nature and/or Description of the Action Being Processed: This procurement is for a 6-month sole source firm fixed price purchase order for the lease and usage of copiers for the Minneapolis VA from Konica Minolta Buisness Solutions in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: This 6-month purchase order is for the lease of copiers and their usage at the Minneapolis VA Health Care System. The copiers are used throughout the facility and CBOCs for printing, copying, scanning and faxing.
4. Statutory Authority Permitting Other than Full and Open Competition: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2).
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The Minneapolis VA Health Care System currently leases copiers from Konica Minolta through VISN 23 BPA VA263-13-A-0070 which expires on 9/30/2018. VISN 23 is in the process of awarding a new long-term copier lease through the Government Printing Office (GPO). That contract has not been awarded yet and will require additional time for implementation and phase-in of the new copiers. The Contracting Officer working on the new GPO contract has requested VISN 23 to award 6-month contracts to Konica Minolta for continuity and continued usage of the existing copiers at each medical center. This 6-month contract will allow for continued usage of the current Konica Minolta copiers until the new GPO contract is awarded and phase-in of the new and phase-out of the existing copiers is completed. No other vendors are able to provide copiers during this period as the copiers currently in place are from Konica Minolta.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: This is a 6-month order for continuity to continue to utilize the copiers located at the Minneapolis VA until the new long term, competitvely competed, GPO contract is awarded and phased-in.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Price is anticipated to be fair and reasonable as the current BPA pricing will continue to be used.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: No market research was conducted as this is a 6-month procurement for continuity of copier usage for VISN 23. VISN 23 has a BPA (VA263-13-A-0070) with Konica Minolta that expires on 9/30/18. VISN 23 has requested a new contract for copiers through the Government Printing Office (GPO) which has not been awarded yet. Additional time is needed for the award and implementation/Phase in of the new GPO contract. The CO working the GPO contract has requested that VISN 23 award a 6-month contract to Konica Minolta for the continued usage of the existing copiers until the GPO contract is awarded and new copiers can be placed at each facility. No market research was conducted as there are no other vendors that could provide copiers to VISN 23 until the GPO contract is implemented due to the time and logistics involved in replacing the over 700 copiers currently in place in VISN 23 by Konica Minolta.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: NA
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Konica Minolta Business Solutions.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A new long term contract for VINS 23 copier leases was competitively solicited through the Government Printing Office and is anticipated to be awarded and phased-in over the next 6 months.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
13. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:
a. Contracting Officer or Designee’s Certification (required): I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.

b. One Level Above the Contracting Officer (Required over SAT but not exceeding $700K): I certify the justification meets requirements for other than full and open competition.
