Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

• Description: MiPACS Dental Diagnostic Imaging Software Licenses & Support

Acquisition Plan Action ID: 36C262-23-AP-3531

1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office 22 (NCO 22) in Long Beach, CA, seeks to procure the supplies / services listed in purchase request 691-23-2-4685-0037 at/for the Greater Los Angeles VA Healthcare System (GLAVAHCS) located in Los Angeles, CA.

2. Brief Description of Supplies / Services required and the intended use / Estimated Amount:

Purchase an additional 20 MiPACS Dental Diagnostic Imaging Software Licenses & Support to supplement the existing 145 licenses already in use for dental imaging.

Estimated Cost: $17,920.00 USD

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

Due to the proprietary nature of equipment / software, only the application developer, Lead Technologies, Inc. (dba MediCor Imaging) – Original Equipment Manufacturer (OEM) can provide the supplies / service to meet agency need. 20 additional software licenses (dental imaging) are needed for new workstations due to increased patient demand. 145 licenses are currently in use at the West Los Angeles Dental Clinic. New licenses cost $800 per seat for a total of $16,000.00 plus the annual software maintenance service of $1,920.00. It would be cost prohibitive to reprocure a new dental imaging system.

4. Description of market research conducted and results or statement why it was not conducted:

Limited market research (MR) performed due to proprietary equipment / technology / software and critical / unique nature of requirement. Results from SBA VetCert query by applicable North American Industry Classification System (NAICS) code 811210 identified 79 SDVOSB / VOSB vendors who could potentially perform the requirement. RFI 36C26223Q1420 revealed only the original equipment manufacturer (OEM), Lead Technologies, Inc. as capable of meeting agency need.

VA Rule of Two does not apply. SBA Rule of Two does not apply. There is NO reasonable expectation that 2 or more qualified SDVOSB / VOSB / SB vendors can, could or would submit offers to meet agency need. Conclusion – recommend single / sole source award to Lead Technologies, Inc. (dba MediCor Imaging) – OEM, a SAM registered small business concern IAW FAR Part 13.
