About this file
This document is a Justification and Approval for Other Than Full and Open Competition for a contract opportunity issued by the Department of Veterans Affairs. The contract is for perpetual syngo.via software licenses from Siemens Medical Solutions USA, Inc. to be used with Siemens CT, SPECT/CT, and PET/CT imaging systems at various VA medical centers. The software licenses will be for a base period of one year and four option years, with an estimated total value of $550,000. A sources sought notice yielded no responses, and Siemens was determined to be the only responsible source able to provide the required licenses as the equipment OEM. The notice of intent to sole source will be posted to allow any other potential sources to express interest by January 3, 2020, but award is expected to be made to Siemens as the sole-source provider.

Accordingly, Siemens Medical Solutions USA, Inc. is the only firm capable of providing the supplies and services described in Section III above without the Veteran’s Health Administration experiencing substantial duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements. This acquisition is essential to the Government’s requirements due to the medical equipments that the software will be utilized for (Siemens’ products) , thereby precluding consideration of a product manufactured by another company.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Sources Sought Synopsis: A sources sought synopsis for brand name or equal was issued on 11/18/2019 to 11/25/2019 under 36C26120Q0129. No repsonses were received by the closing date of the sources sought posting.
Other Actions: Although no responses were received during the period of the sources sought posting, an Intent to Sole source will be posted to ensure that offers are solicited from as many potential sources as deemed practicable.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: The anticipated cost will be considered fair and reasonable and based on similar requirements, since there are no identical awards made for this software application. Negotiation will likely take place to ensure the final contract price will be fair and reasonable.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research efforts include VIP, FPDS, VA NAC catalog, Contract Opportunities, SAM, and consulting the manufacturer . Since there is limited information on this software application suite, a Sources Sought was posted on 11/18/2019 to 11/25/2019 for brand name or equal. No responses were received. There is no reasonable expectation that two or more SDVOSBs/VOSBs have the capability to meet this requirement, and the Supreme Court Kingdomware mandate’s “Rule of Two” was not met; nor do two or more other small business categories have the capability to fulfill the requirements.
As described in Section 6 above, market research, in accordance with FAR Part 10, was conducted by synopsis of the proposed acquisition, advising industry of the pending acquisition and soliciting inquiries from interested parties.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A
