Justification and Approval (J&A) For
Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C261-19-AP-2157
1. Contracting Activity: Department of Veterans Affairs, VA Sierra Pacific Network (NCO 21), VA Palo
Alto (VAPAHCS) is requesting approval of a Justification for Other Than Full and Open Competition for the requirement specified in 2237 Number 640-19-2-522-0022.
2. Nature and/or Description of the Action Being Processed: The VA Palo Alto Health Care System (VAPAHCS) has a need for a Scanco Pre-Clinical Viva Micro CT80 scanner, which will allow the research facility to continue to provide support to the overall mission of the patient health care system.
The Research Department already owns a micro CT scanner of the same make and model, and is requesting a Sole Source procurement of this item. Research personnel have undergone extensive training in order to become skilled users of this scanner for their work, and if a different make and model were procured their training would not be applicable.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: VAPAHCS has a need for a
Pre-clinical Scanco Viva CT 80 In vivo Micro CT Scanner, including: Micro CT Scanner, Animal Monitoring and Gating, Operating Software, HP Integrity Server (included), and On-site installation and training.
4. Statutory Authority Permitting Other than Full and Open Competition:
(X) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per FAR 6.302-1;
( ) (2) Unusual and Compelling Urgency per FAR 6.302-2;
( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;
( ) (4) International Agreement per FAR 6.302-4 ( ) (5) Authorized or Required by Statute FAR 6.302-5;
( ) (6) National Security per FAR 6.302-6;

FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2).

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
a. Only One Responsible Source (FAR 6.320-1)-This is a Sole Source procurement to continue using existing equipment in the Research facility. Only Scanco manufactures, installs and supports the existing Micro CT Scanner, as it is highly specialized equipment. If some other Micro CT Scanner is procured in lieu of this one, it would incur a substantial duplication of cost to the government by requiring the research scientists who use this equipment to undergo lengthy training, and after that, a time-consuming learning curve, in order to become proficient on the new equipment. Scanco is a small business vendor that specializes in a turnkey system for the 3T equipment and software for rodents. If the requested make and model of Micro CT, the ScanCo Viva CT80, is procured, the research scientists already have the same make and model, and use it frequently, so the extra cost and time will not be incurred by the government.
b. In addition, the ScanCo Viva CT80 possesses the following capabilities which are useful to the research scientists: field-of-view (80 mm); resolution (5 μm); Cone-beam in vivo microCT; Fully shielded, No external shielding required, Integrated Heating Chamber;
Integrated Animal Monitoring Unit, Temperature Monitoring, Integrated Observation Camera, Heart Rate Monitoring, Interchangeable Monitoring Units; Integrated Respiratory Gating Unit; Integrated Touch Display; X-Ray source is Sealed, Air-cooled, Maintenance-free, 30 - 70 kVp; Detector is 3072 x 400, elements (~100% fill factor), 48 μm pitch;
Resolution ‹ 14 μm (10% MTF), 5 - 160 μm nominal isotropic (pixel size); Image matrix is 512 x 512 to 8192 x 8192 pix; Max. scan size is 80 x 145 mm (ØxL) in one scan Up to ~450 mm length with multiple scans; Max. specimen size is 90 x 500 mm* (ØxL); Min. scan time is 20 s; Electrical is 100 - 230 V / 50 - 60 Hz, 400 W; Dimensions are 1750 x 1230 x 910 mm (HxWxD); Weight 400 kg (standard hood).
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A market search was conducted by sdoing a VIP search which resulted in (1) interested SDVOSB vendor. A sources sought was posted on GSA eBuy and (1) response was received by an SDVOSB vendor. Market Research revealed Scanco as the only source for a Pre- Clinical Viva Micro CT80 scanner that the research department needs and they are the only authorized supplier and provider of maintenance services of this equipment.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: The Contracting Officer has determined that the anticipated price will be determined to be fair and reasonable. A FAR Part 13 Open Market Award Decision Documentation Form will detail how the Government has determined that the anticipated cost will be fair and reasonable.
The basis of price reasonableness will be determined based on comparison with similar items in a related industry.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

On 3/11/19 a sources sought (RFQ 1354088) was posted to GSA eBuy and closed on 3/15/19. It was issued to ten SDVOSB vendors and only one responded to the notice.
On 4/2/19 a NAC search was conducted and had no contracted vendors for this equipment.
A VIP search was also conducted on 4/8/19 resulting in 119 SDVOSBs. A sources sought was sent out to all vendors on 3/11/19 and closed on 3/15/19, with one SDVOSB vendor that responded.
The notice included the salient characteristics for the requirement. Any firm that believed it could provide the equipment listed were encouraged to submit written notification to the Contracting Specialist with requested information for consideration before the close of the Sources Sought Notice.
After sources sought notice closed, Contracting Specialist found that Scanco is the only authorized supplier and provider of maintenance services for the equipment needed. Scanco provided a letter which was uploaded to the file.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: VA will continue to monitor the commercial marketplace to determine if other sources are capable of providing a Pre-Clinical Viva Micro CT scanner that can meet VAPAHCS’ requirements.
