2. Nature and/or Description of the Action Being Approved: This action is a new requirement and will be a firm-fixed price sole source award to a VIP verified SDVOSB using the statutory authority listed in 4 below.

The VISN20 MIRECC will conduct high throughput screening for disease nodes and modifiers related to cellular processes involved in traumatic brain injury. The MIRECC requires a multimode plate reader with the capacity to perform certified alphascreen, luminescence, absorbance, DELFIA, LANCE and TRF excitation / detection capabilities with the ability to read up to 3456 well plate using fluorescence intensity mode.

4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.

Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below:

5. and/or Nature of the Acquisition

Requires the Use of the Authority Cited Above (applicability of authority):

Based on 38 U.S.C. 8127 (c), the authority allows sole source awards to SDVOSB and the SDVOSB concern has been determined to be a responsible source and meets eligibility requirements in VAAR 813.7003.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart

5.2 and, if not, which exception under 5.202 applies:

Market research was conducted to satisfy the requirements of the FAR 10.002(a) and is in the briefcase. A search of mandatory sources of supply and encouraged sources of supply was conducted. In addition, on 8/30/2019 a unrestricted sources sought salient characteristics was published to FBO. The Sources Sought closed on 9/4/2019. The only response was from the manufacture PerkinElmer Health Sciences Inc. A further search of capability statements using the manufactures named revealed one SDVOSB distributor for Perkinelmer.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:

The quote provided by Franklin Young International, Inc. has been determined fair and reasonable IAW FAR 13.106-3(2)(Vii)

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

Market research was conducted to satisfy the requirements of the FAR 10.002(a) and is in the briefcase. A search of mandatory sources of supply and encouraged sources of supply was conducted. In addition, on 8/30/2019 a unrestricted sources sought salient characteristics was published to FBO. The Sources Sought closed on 9/4/2019. The only response was from the manufacture PerkinElmer Health Sciences Inc. The results of the sources sought indicate that the
