2. Nature and/or Description of the Action Being Processed:

This procurement is for Microbiology Media Testing for the Puget Sound VA Medical Center as a new Base +4 Option Year order and the order will be firm fixed price. These products are mandatory for the identification of pathogenic organism. Remel (Fisher) products exhibit special characteristics not available in other vendor product lines. These supplies enable microbiologists to identify disease in veteran patients. These products have to be compatible with the Media Testing Instrument that is currently in use at the Seattle VAMC.

The estimated value of this procurement is $342,543.24.

4. Statutory Authority Permitting Other than Full and Open Competition:

This transaction is conducted IAW FAR 13.501(a)(1)(ii), Simplified Procedures for Certain Commercial Items, under the authority of 41 U.S.C. 1901. An acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer. No other items are compatible with the current system already in use at the VAMC.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

These products are mandatory for the identification of pathogenic organism. Remel (Fisher) products exhibit special characteristics not available in other vendor product lines. Using products that are not compatible, with the supplies describes in section 3 above, with the current instrument could result in unacceptable delays in treatment and additional costs. These products have to be compatible with the Media Testing Instrument that is currently in use at the Seattle VAMC. If a new instrument is procured, then the current insutrment and all the supplies will need to returned which would be huge additional costs to the Health Care facility. These supplies enable microbiologists to identify disease in veteran patients. Patient safety is of the utmost importance when testing for diseases and the treatment of these diseases.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

A sources sought was posted to FBO on 2/26/2018. Remel (Fisher) responded that they could provide the request products. We also received 3 responses from authorized distributors of the Remel (Fisher) products; GSS, a VOSB, Franklin Young, a SDVOSB and Stripes Global, a SDVOSB.

This J&A will be posted with the solicitation va the GPE.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

The anticipated cost and final contract price will be considered fair and reasonable through competitive quotes.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

Puget Sound VAMC Microbiology laboratory requested the Microbiology Media Testing products and be compatible with the current testing instrument. These products have to be compatible with the Media Testing Instrument that is currently in use at the Seattle VAMC. A VIP search under NAICS 325413 showed 22 potential SD/VOSB sources listed. A sources sought notice was posted to FBO, 4 potential sources replied they could offer the products requested: 2 SDVOSB’s, 1 VOSB and 1 Large Business.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: NONE

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

The sources that expressed interest in this acquisition are as follows:

Franklin Young, Stripes Global, GSS and Remel (Fisher) all responded to the FBO sources sought posting.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required:

No actions are planned as this will be awarded to one of the SDVOSB authorized distributors of Remel (Fisher).

12.
