INTRODUCTION
The Department of Veterans Affairs, Veterans Health Administration (VHA), hereafter referred to as the “VA”, “VAMC”, or the “Government”, has a requirement to the paint booth at the VA Medical Center (VAMC) in Oklahoma City, Oklahoma. The team responsible for the replacement will hereafter be referred to as the “Contractor”. The contractor shall provide all tools, equipment, labor, supervision, transportation, project management, and materials to conduct the replacement. This includes the demolition and removal of the current structure.
SCOPE OF WORK
Paint Booth The OKC VA hospital’s paint booth needs to be replaced due to end of life. Clean air flows into the booth through the filtered doors, passing through the work area, and exits through the exhaust plenum located in the rear of the booth. Filtered exhaust air is drawn thru the exhaust plenum and discharged upward into the atmosphere through the exhaust stack(s). This booth is provided complete with all necessary hardware to meet the applicable national requirements established by OSHA, and the NFPA for paint booth construction. The general requirements are as follows.
GENERAL REQUIREMENTS
· Interior working dimensions of 10'-0" wide X 8'-0" tall X 17'-6" long. Approximate overall dimensions of: 10'-4" wide X 8'-2" tall X 20'-4" long.
· Panels: Panels fabricated from 18-gauge quality galvanized steel, flanged and precision punched on 6" centers for maximum rigidity. Panels are to be fastened together with 5/16" bolts and are to be sealed with the provided caulk following assembly.
· A total of (6) 4,000 Lm light fixtures will be provided for illumination:
· Fixtures are Maintenance-Free rated for Class I Division II Groups A, B, C, D; Class II Division II Groups F & G. Fixtures are ETL listed and approved for their intended use and placement. Lighting is provided by innovative LED technologies consisting of multiple high efficiency flux boards paired with high efficiency drivers. Fixtures are designed to accept either 120VAC or 277VAC power. Drivers and boards carry a 5-year limited warranty.
· Exhaust Filters: RTT's RP Arrestor W-Series 5100 Ultra-Efficiency filtration roll media and FilterLoc filter management system. The RP Arrestor W-Series filtration has six layers of expanded paper to create an alternating labyrinth upstream of a heavy polyester backing. This combination yields higher efficiency while still providing ample holding capacity in a wide variety of applications. Filters are lab tested with over a 99.8% particulate removal efficiency. FilterLoc track is mounted to the exhaust chamber providing a tighter seal to help eliminate overspray bypass. The roll media is secured in the FilterLoc track using the provided FilterLoc Tool. The new technology provides savings by allowing the utilization of roll media reducing overall cost and decreases overall filter change out time.
· A Dwyer Mark II manometer will be provided with the unit to monitor the filter resistance and thereby offer a visual indicator of the filter's life and efficiency.
· Intake air filters: Rated by UL as Class 2 and are EPA registered as environmentally safe. Filters are self-supporting in an internal frame sized 20" x 20" x 1". One set of filters will be supplied with this unit.
· Air Solenoid Valve: 1/2" 120V solenoid valve will be provided with this booth.
· (1) - 24” 3.0 HP Exhaust fan rated for 8,000 CFM @ 0.5” Static Pressure Total CFM exhausted: 8,000 CFM
· (1) – Personnel access doors: 10'-0" W x 8'-0" H
· UL/ ETL Listed Control Equipment:
· Refillable Carbon tray for removal of odors, gases and VOC.
· Doors are to be field hung on slotted hinges to facilitate adjustment on two axis’ to compensate for field conditions. Standard 36" wide personnel door is constructed with a square tube frame and covered with 18-gauge galvanized steel and includes an observation wind
· Desiccant dryer system: 17-1/2" wide, 20" high, 5" deep. 12.5 lb; 2-stage filter The above paragraphs constitute a basic outline of the work to be accomplished and in no way comprises all the details for this project.
The contractor shall be solely responsible for the management, including all associated labor, equipment, materials, mailing costs, and inspection, to meet the requirements of this project.
The areas adjacent to the proposed addition shall be continuously occupied by the OKC VAMC. The Contractor shall implement phasing to ensure that the construction will not impact or impede the VAMC’s mission to care to the Veterans.
The contractor shall provide quality control of all work conducted and the individual appointed shall be competent and educated/experienced in the field of work this scope encompasses.
Codes and Standards: The Contractor shall follow all applicable codes and standards to this type of work including but not limited to Health Care System Memorandums (HCSM), OSHA Guidelines, NFPA 101, NFPA 70, Lock-out-Tag-out, and Rules of Station.
Task Management. Engineering shall identify a Contracting Officer’s Representative (COR). The COR will provide technical assistance and clarification required for the performance of this contract, participate in project meetings, review invoices, and receive deliverables. After contract award, the Contracting Officer will appoint a COR and issue a COR appointment letter stating the authority for the COR. The contractor will receive a copy of the written appointment Period of Performance.
Anticipated length of Construction is 30 Calendar days from NTP.

VA has adopted the latest edition of the following codes and standards as a minimum for all projects performed in the modernization, alteration, addition, or improvement of its real property and the construction of new structures. VA design Manuals and Master Specifications specify other codes and standards that VA follows on its projects:

PART I - INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS
PART I/SECTION A – REQUEST FOR QUOTE
This is a Request for Quote in accordance with FAR Part 13. Potential offerors must follow all instructions in order to be compliant with the solicitation.
It is the responsibility of the offeror to verify that their offer is complete. The offeror is responsible for submitting all required forms and documents with the offer.
The Government will award a single contract resulting from this solicitation to a responsible SDVOSB offeror whose offer conforming to the solicitation will be most advantageous to the Government based on Past Performance, Safety and Price.
I.1A JOINT VENTURES
If submitting an offer as a joint venture as defined by P.L. 109-461 AND Department of Veterans Affairs I.L. 049-06-4, http://www.vetbiz.gov/library/jtventure.pdf , an offeror must provide a copy of the joint venture agreement specific to the project that is consistent with the percentage of required work and net proceed. Additionally, the offeror must provide a breakdown or labor of which is to be performed by the SDVOSB firm and that which is performed by the small business joint venture firm and that which is sub-contracted. All Joint Ventures will be required to be registered and verified as an entity in VETBIZ.
I.3A SITE VISIT
See SF 1442, Block 10 and FAR Provision 52.236-27, Site Visit (Construction) of this solicitation. Please ensure that you do a COVID pre-screen at the main entrance before meeting for the site visit.
I.4A SELECTION CRITERIA/QUOTE PREPARATION INSTRUCTIONS
Quotes will be evaluated in accordance with FAR 13.106 Simplified Acquisition Procedures Award will be made based on the following factors:
Factor 1 – Past Performance Factor 2 - Price Offerors are encouraged to provide their best offers with the past performance information requested for evaluation. The Government, based on the offered material presented, will award to the offeror that best demonstrates to be most advantageous for the Government.
Factor 1 - Past Performance: Offerors shall provide past performance information on two (2) federal, state, local government or private contract of similar type, scope, size and complexity. For purposes of this evaluation, a relevant project is further defined as experience with paint booth replacement, particularly in a hospital environment. Project shall have a minimum amount of $25,000.00 or more and completed within the past five years from the date of issuance of this RFQ. If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the quote. The Government may also evaluate recent and relevant past performance, based upon sources available to the contracting officer that may include Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS) and Electronic Subcontract Reporting System (eSRS). IF THE OFFEROR CANNOT PROVIDE A CPARS FOR PROJECTS LISTED IN FACTOR 1, then the offeror shall submit Past Performance Questionnaires (PPQ).
Completed PPQs should be submitted directly from your client via email to Daniel Payne at daniel.payne@va.gov. If you have any questions, please contact Daniel Payne at daniel.payne@va.gov. If the offeror is unable to contact a client for a project(s) before closing date, the offeror should complete and submit with the quote the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires.
Basis of Evaluation: Past Performance will be evaluated in accordance with FAR 13.106-2 and award will be made to the offeror presenting the best value to the Government.
Factor 2 - Price: Offerors shall provide pricing as requested in the Schedule of Service identified within the SF1442 Basis of Evaluation: The Government will evaluate price based on the total price. Total price consists of the basic requirements. Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

| • | Comparison of quoted prices with the IGCE. |
| • | Comparison of quoted prices with available historical information. |
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The Offeror shall submit the following information: (For a partnership or joint venture, the following submittal requirements are required for each Contractor who is part of the partnership or joint venture and for the entity itself. EMR shall not be submitted for subcontractors.)
(1) OSHA or EPA Violation(s):
Offerors shall provide Summary of Work-Related Injuries and Illnesses, affirming that the Offeror has no more than three serious, or one repeat, or one willful OSHA or EPA violation(s) in the past 3 years
(2) Experience Modification Rate (EMR):
Offerors shall provide documentation to show that the offeror has an Experience Modification Rate (EMR) of equal to or less than 1.0.
Offerors who fail to meet any special standard of responsibility will not be eligible to receive contract award.
PART I/SECTION B - INSTRUCTIONS, CONDITIONS AND NOTICES TO OFFERORS
I.1B COST RANGE: Between $25,000 and $100,000 I.2B GENDER: Wherever the masculine gender is used in this solicitation and contract documents, it shall be considered to include both masculine and feminine.
I.3B METRIC PRODUCTS:
Products manufactured to metric dimensions will be considered on an equal basis with those manufactured using inch-pound units, providing they fall within the tolerance specified using conversion tables contained in the latest revision of Federal Standard No. 376, and all other requirements of this document are met.
If a product is manufactured to metric dimensions and those dimensions exceed the tolerance specified in the inch-pound units, a request should be made to the Contracting Officer to determine if the product is acceptable. The Contracting Officer, in concert with the Contracting Officer’s Representative (COR), will accept or reject the product.
I.4B REQUESTS FOR INFORMATION:
All requests for information must be submitted in writing to the Contracting Officer for action no later than the date shown in Block 10 of the Standard Form 1442, Solicitation, Offer and Award.
I.5B QUOTE REQUIREMENTS
General – Both past performance information and price proposal shall be submitted in response to this solicitation. Proposals shall be submitted via email to daniel.payne@va.gov Emails are limited to 15 MB. The proposal, in its entirety, shall be one email (one attachment for price proposal, and one attachment for past performance information) not to exceed 15MB. Proposal cam be submitted in one email if 15MB or less. Failure to submit in the format required and clearly address those factors may result in rejection of the offer. An original Bid Bond, in the amount of twenty (20%) percent (but not to exceed $3,000,000) of the bid price shall be mailed to the address listed in block 8 of the SF1442 and be received at the address no later than the closing date and time. Failure to furnish the required bid guarantee in the proper form and amount, by the time set for opening, will require rejection of the bid in all cases except those listed in FAR 28.101-4, and may be cause for rejection even then. SEE FAR Provision 52.228-1, Bid Guarantee, of this Solicitation. Electronic copies of the proposals will be time/date stamped by Microsoft Outlook upon receipt of email. Further details on electronic submission are outlined below.

Submit quotes to: daniel.payne@va.gov Important Notice: Apparent successful offerors must apply for and receive verification from the Department of Veterans Affairs Center for Verification and Evaluation (CVE) in accordance with 38 CFR Part 74 and VAAR 819.70 by submission of documentation of Veteran status, ownership and control enough to establish appropriate status. Offerors must be both VISIBLE and VERIFIED by the Department of Veteran Affairs CVE at the time of offer submission. Failure to be both VERIFIED by CVE and VISIBLE on VetBiz at the time of offer submission and contract award will result in the offeror’s proposal being deemed non-compliant. All offerors are urged to contact the CVE and submit the required documents to obtain CVE verification of their SDVOSB status if they have not already done so.
I.6B REQUIREMENTS FOR ELECTRONIC SUBMISSION OF OFFER
Unless paper offers are specifically authorized in an individual solicitation, all responses to solicitations must be submitted electronically as described below. Responses submitted in a paper form are unacceptable. Failure to comply with this requirement may jeopardize the possibility of receiving an award for the contract due to noncompliance with the terms of the solicitation. You must submit your electronic offer, and any supplemental information (such as spreadsheets, backup data, technical information), using any of the electronic formats and media described below.
In addition, contractors are notified of the award via an electronic Notice of Award e-mail. The award document will be attached to the Notice of Award e-mail.

Security Issues, Late Bids, Unreadable Offers
1. Late submission of offers is outlined at FAR 52.215-1(c)(3). Particular attention is warranted to the portion of the provision that relates to the timing of submission.
1. Please see FAR 15.207(c) for a description of the steps the Government shall take with regard to unreadable offers.
1. To avoid rejection of an offer, vendors must make every effort to ensure their electronic submission is virus-free. Submissions or portions thereof submitted and which the automatic system detects the presence of a virus or which are otherwise unreadable will be treated as “unreadable” pursuant to FAR 15.207(c).
1. The virus scanning software used by our e-mail systems cannot always distinguish a macro from a virus. Therefore, sending a macro embedded in an e-mail message or an e-mail attachment may cause the e-mail offer to be quarantined. You may send both the spreadsheet and the spreadsheet saved in PDF format to ensure that your quote is readable.
1. Password protecting your offer is not permitted. The Contracting Officer will file the offer electronically which will allow access only by designated individuals.
2.1 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.2 52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. If the Contractor performs construction work in a geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed. Goals are published periodically in the Federal Register in notice form, and these notices may be obtained from any Office of Federal Contract Compliance Programs office.
(c) The Contractor's compliance with Executive Order 11246, as amended, and the regulations in 41 CFR 60-4 shall be based on (1) its implementation of the Equal Opportunity clause, (2) specific affirmative action obligations required by the clause entitled "Affirmative Action Compliance Requirements for Construction," and (3) its efforts to meet the goals. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade. The Contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor, or from project to project, for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, Executive Order 11246, as amended, and the regulations in 41 CFR 60-4. Compliance with the goals will be measured against the total work hours performed.
(d) The Contractor shall provide written notification to the Deputy Assistant Secretary for Federal Contract Compliance, U.S. Department of Labor, within 10 working days following award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the—
(1) Name, address, and telephone number of the subcontractor;
(2) Employer's identification number of the subcontractor;
(3) Estimated dollar amount of the subcontract;
(4) Estimated starting and completion dates of the subcontract; and
(5) Geographical area in which the subcontract is to be performed.

2.3 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)
(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.
