2. Nature and/or Description of the Action Being Processed:
The Sheridan VA Medical Center (VAHCS) is requesting a new brand name firm-fixed price contract for 16 MAC VU360 Electrocardiogram (ECG). These units will replace the current GE Healthcare MAC 550 ECG machines as they have surpassed or are at the end of their life expectancy. The GE Healthcare MAC VU360 ECG Machine is compatible with the MUSE database currently in use at the Sheridan VAHCS.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The MAC VU360 ECG is designed to be a workstation allowing access to MUSE, a Cardiology Information System and the patient’s medical history. This enables for faster more informed cardiac care decisions, at the point of care. The MAC VU360 resting ECG workstation helps deliver high ECG quality and speed, even in challenging situations, and automatically detects when a new patient is connected to help minimize patient data mix ups. In addition to the GE MAC VU 360 ECG’s, the following items are also required for purchase: Trolley Cart (x16); WIFI-LAN install and Configuration (x16); Thermal Paper; Electrodes; Training Package(X1); and Online Service Training (X3)

4. Statutory Authority Permitting Other than Full and Open Competition:

FAR13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1(b)(2).
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The new required machines and software upgrades must coincide with the existing system and equipment. No other manufacturer’s systems would be compatible or interface with the current ECG MUSE system. The MAC VU is the only ECG cart that can bidirectionally communicate directly to the MUSE using the same 12SL algorithm used currently. This allows the MUSE to work with both CPRS (text and results outbound, ADT and orders inbound which it sends to the carts) and VistA imaging. Interface between Clinical Information System (CIS) and GE MAC VU is proprietary to GE Healthcare; therefore no other ECG equipment can provide the combined interoperability between CIS and VISTA which permits the transmission of the ECG order, and the ECG results as well as allowing clinicians access to prior ECG reports. The MUSE is the only ECG archival system that has VA approved interface to CPRS and VistA Imaging.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
The solicitation will be posted to the official Government Point of Entry website, Federal Business Opportunities (FBO), as a brand name open market, Unrestricted RFQ. There are two authorized small businesses capable of supplying this requirement. Further, GE Healthcare has provided authorized distributor letters to the Government. The Government will continue to conduct market research to ascertain if there are changes in the market place that would enable future actions to be competed.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
A determination of fair and reasonable pricing will be based on competitive quotations or offers received. If only one (1) quote is received, price reasonableness will be based on the various price analysis techniques stated in FAR Part 13.106-3(a)(2).
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market research was not conducted for other ECG equipment since this requirement is proprietary to GE Healthcare. GE provided a letter dated 27 August 2019 confirming the proprietary information.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
There are no other facts or circumstances supporting the use of other than full and open competition.

In the future, the VA will closely monitor these procurements since modern technology increases there may be opportunities to find new products for market competition for vendors in this field.
