Justification for Limiting Sources (LSJ) For
Limiting Sources (<SAT)
Acquisition Plan Action ID:36C262‐19‐AP‐4150
1. Contracting Activity: Department of Veterans Affairs, NCO 22G, 605‐19‐3‐6022‐1116.
2. Description of Action: This is a request for the installation of cabling and pathways where there are not presently existing cameras at Loma Linda VA Medical Center. This Firm fixed Price contract will be awarded to Security Solutions as a sole source procurement from May 31, 2019 through July 31, 2019. Security Solutions shall provide all labor and services according to the statement of work for the sole purpose of installing security to care for our veterans and staff at LLVAMC.
The intent of this procurement is to provide for labor and discovery as part of the installation of cameras at the Medical Center. Security Solutions is the only contractor who can provide this labor in order to support their work under supply contract 36C26218P8880. This requirement is extremely urgent as camera installation is current and ongoing throughout the medical facility and delays in the processing would result in a delay in the installation of the cameras in key areas. Further, delays of the camera installation in key areas would require another maintenance contract to be cut in order to keep the outgoing vendors on site at additional cost to the government.
3. Description of Supplies or Services:
The estimated value of the proposed action is $107,301.35
The Department of Veterans Affairs, Network Contracting Office 22 proposes to award a sole source contract to Security Solutions for installation of cabling and pathways where there are not currently existing cameras at Loma Linda VA Medical Center.
Security Solutions already has the necessary staff, equipment, and procedures to perform these services on site. It would not be feasible to compete a short‐term contract in time due to the magnitude of labor required, and any incoming contractor would have to re‐do the discovery by Security Solutions that led to the need for this contract initially. Delays in awarding this labor contract will cause the installation of cameras to stop, as the local facility has determined that containment is required for this installation. Any lapse in installation would be detrimental for both patients and staff as Security Solutions is in the middle of replacing an outdated CCTV system, and their leaving would prevent critical areas from being visible to the VA Police. Security Solution’s installation contract ends on 31 July 2019, and no other company can perform both the discovery and these services by the needed date.
This labor is absolutely a requirement in order to install cameras all over the hospital and cover areas that are currently dark to the VA Police. Should an event happen here and a FOIA request be submitted, the VA Police cannot currently comply and provide footage for many areas.
4. Authority:
FAR 13 ‐‐ Simplified Acquisition Procedures: The statutory authority permitting other than full and open competition is FAR Part 13.106‐1(b)(i); Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available. This action’s value is under the threshold set forth by the National defense Authorization act (NDAA) 2018.:
An urgent and compelling need exists, and following the procedures would result in unacceptable delays;
Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
In the interest of economy and efficiency, the new work is a logical follow‐on to an original Federal Supply Schedule order and the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order was not previously issued under sole‐source or limited‐sources procedures; or
Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer). A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.
5. Rational/explanation to support cited authority:
It has been determined that a short duration sole source contract is in the Governments’ interest due to the fact that the additional labor requirement was found during the performance of the above referenced supply contract. Failure to award this contract would prevent the required installation of cameras in key areas, leaving the new security system incomplete, and keeping a failing system in place. The maintenance of that failing system is a burden on the VA in terms of both cost and time. Further, patient and staff safety would be adversely affected, placing individuals in jeopardy and preventing evidentiary recordings from being available in the event of an emergency. This would be a significant impact to all personnel that frequent Loma Linda VA Medical Center.
Additionally, failure to award this sole‐source contract to Security Solutions would adversely affect their ability to complete the work that they are already contracted to do. The additional labor burdens placed upon the company are not the fault of the vendor but were requirements placed upon them by the local facility due to unforeseen and unavoidable circumstances.
The time it would take to solicit, award and transition to a new contract would cause unacceptable delays in fulfilling the agency’s mission needs. Security Solutions is already present on site working on camera swaps under contract, and failure to award would adversely affect the contract that they are presently executing. Because of the time needed for discovery, bidding, mobilization, site walks, and other matters related to the procurement process, they are the only vendor capable of providing these services prior to 31 July 2019, which is the end of their supply contract and the targeted completion date of our CCTV installation. They currently have the necessary staff, resources, procedures, documentation and equipment needed to perform these services.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
It is not practical to source identical labor to supplement a company currently on site and capable of performing that labor. Transitioning to a new contractor at this time would not be feasible. In accordance with FAR 5.301 a solicitation allowing competition for this service will be synopsized on the Federal Business Opportunities (FBO) page and will be publicly available. Creating a Firm Fixed Priced contract and completion will meet the competitive process for a long‐term contract.
7. Requirements Certification:
I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
