B.2 STATEMENT OF WORK

1. General Objectives and Requirements:

0. Contractor is to provide all material, labor, and equipment necessary to sample, monitor, package and transport with chain of custody, record, and send the completed wastewater (effluent) analysis report to the Phoenix VA Health Care System (PVAHSC), Engineering Department (139), 650 E. Indian School Road, Phoenix, AZ 85012-1892. All work shall be performed in accordance with the City of Phoenix Wastewater Discharge Permit #1201-2590 (attached) for the Phoenix VA Health Care System (PVAHCS) using the designated City Self-Monitoring Report forms (sample attached).

0. Authority for the Contract: In compliance with the provisions of the Clean Water Act, (33 U.S.C. 1251, et seq.), the General Pretreatment Regulations (40 CFR Part 403) and Chapter 28 of the Phoenix City Code, and any amendments or supplements thereto, the City of Phoenix, Water Services Department, Environmental Services Division authorizes the Carl T. Hayden VAMC to discharge industrial wastewater into the City of Phoenix sanitary sewer system in accordance with the effluent limitations, sampling requirements, and other conditions set forth in this Permit, the Permit Standard Conditions dated July 30, 2015, and Chapter 28 of the Phoenix City Code.

1. Scope:

A. All Contractors must utilize laboratories certified by Arizona State laws for accreditation of Environmental Testing Laboratories to ensure the quality of analysis data used for regulatory purposes. During the term of the contract, the Contractor shall be required to provide a valid certificate number and provide an updated certificate and list of approved fields of testing for the laboratory subcontracted for sample analysis. Contractor shall submit with the technical offer a valid certificate number, a copy of their accreditation certificate. Certification for any subcontractor shall also be submitted if applicable.

B. All Arizona state and Environmental Protection Agency (EPA) sampling and analysis methods and standards applicable shall form a part of this statement of work. If a subcontractor is being used to perform the sampling analysis, the above information also applies to that subcontractor. The VA reserves the right to inspect the laboratory used upon request.

C. Standards: Whenever two or more standards apply in a given situation, the most stringent standard shall govern.

D. Field Testing: Field-testing instruments may be used where indicated provided that: (1) the operator is trained in proper use, calibration, and maintenance of the instrument, (2) the testing instruments shall be calibrated and serviced in accordance with manufacturer’s recommendations, and (3) field calibration reports are provided (using Phoenix ESD forms) along with appropriate test results. Contractor shall submit with the technical offer a list of approved fields of testing for the laboratory to be used for sample analysis. Certificates for any subcontractor shall also be submitted if applicable. The contractor shall submit with the technical offer a minimum of two sample reports used to test and analyze, that can indicate they are familiar with this process as described in the SOW.

E. Analysis and Testing:

I. The Contractor shall perform necessary sampling during the weekday within the first fifteen (15) calendar days of the month. The Contractor shall notify the designated Contracting Officer Representative (COR) of intended sampling date 24 hours in advance.

II. Analysis shall be in conformance with the City of Phoenix Wastewater Discharge Permit #1201-2590 (copy attached) for the Phoenix VA Health Care System (PVAHCS). Permit #1201-2590 with the concurrent tests expires on January 31, 2022. During the Option Year in which this permit is renewed for PVAHCS, should no changes occur in the sampling requirements, no changes in the contract pricing will be approved; however, should changes in sampling requirements occur as a result of the permit requirements, an equitable adjustment will be negotiated.

III. At the time of this contract base period, Total Petroleum Hydrocarbon (TPH) sampling is temporarily suspended and shall not be included in the Contractor monthly pricing. Should TPH sampling be reinstated as a requirement under the terms of this contract agreement, the Contractor shall have the right to request an equitable adjustment in the monthly contracting pricing for this additional test.

IV. Three Parshall Flumes; 2590.04 – 6 Inch, 2590.05- 3 Inch; 2590.06 – 3 Inch North and the Palmer Bolus 2590.07 – 6-inch Dental Clinic flume shall be tested. The four flumes. shall be inspected for cleanliness and conditions that may affect proper orientation. Flumes will be cleaned on a monthly basis. Structural deficiencies detected will be reported to the designated Contracting Officers Representative (COR) for recommended repairs. No repair work is expressly authorized under the terms of this contract agreement and shall be negotiated as separate items.

V. Report Submittals: Reports shall be submitted to the Phoenix VA Health Care System (PVAHCS), Engineering (139), by the 20th of the month following in which the sampling was performed in the Significant Industrial User Monitoring Report as provided.

VI. Temporary Increased Sampling Methods (TISM): This is a firm fixed price contract with monthly fee non-inclusive of all monthly, quarterly, and TISM tests that may be required to conform to the City of Phoenix Wastewater Discharge Permit for the Phoenix VA Health Care System (PVAHCS) when permit parameters are exceeded. No TISM sampling is expressly authorized in the terms of this agreement and shall be negotiated as separate items as required.

VII. Maintenance, repair and replacement costs for four 2110 Teledyne Isco Ultrasonic Flow Modules with sensors to include all parts and software upgrades as necessary.

VIII. Maintain a backup 2110 Teledyne Isco Ultrasonic Flow Modules or equivalent in the event of a flow meter failure.

IX. The following supplies and materials are to be supplied by contractor, Batteries Energizer 6-volt part # 4LR25X or equal 2 each, required per each flow meter.

X. Desiccant-ISCO brand-Part number 602004233 to be changed annually for all four flow meters.

1. Security Requirements:

Security Requirements for Unclassified Information: The contractor, their personnel, and their subcontractors shall be subject to the Federal laws, regulations, standards, and VA Directives and Handbooks regarding information and information system security as delineated in this contract.

4. Risk Control:

The Contractor shall be escorted by the Agency. The Contractor may need passes from the on-station Police Department.

5. Performance Monitoring:

The Agency shall oversee work done by the vendor and accept the quality of work as appropriate.

6. Government-Furnished Equipment (GFE)/Government-Furnished Information (GFI):

The Agency shall provide physical access to the compliance sampling points.

7. Other Pertinent Information or Special Considerations:

A. Possible Follow-on Work: The Contract shall provide for the addition and removal of equipment.

B. Non-Disclosure Requirements: The vendor shall have physical access to the equipment. This may allow the vendor to view patient information.

C. Packaging, Packing and Shipping Instructions: All parcels and packages shall come through the Agency’s warehouse to be distributed either through Biomedical Engineering or the field service engineer her/himself if s/he is on station to receive the package. All parcels and packages shall ship overnight.

D. Inspection and Acceptance Criteria: The Agency shall sign off on the work completed if service is determined to be satisfactory.

8. Place of Performance:

Phoenix VA Health Care System 650 E. Indian School Rd Phoenix, Arizona 85012.

9. Estimated Quantity of Samples:

A. Continuous flow monitoring is conducted in all four flumes to measure the total gallons of waste water each 24-hour period every day of the month.

B. Continuous composite sampling is conducted in all four flumes, the water tested for Copper, Silver and Zinc and reported each month.

C. A pH test is also done each week from each flume. Four separate grab samples are collected from each flume every six months and analyzed for cyanide, which has to be taken separately from the composite sampling since it is a grab sample.

D. On the month that cyanide grab sample is taken there will be 4 grab samples for cyanide from each flume, the 4 composite samples for Copper, Silver and Zinc from each flume , plus the weekly pH test and the daily flow monitoring from each flume.

E. Every six months the composite samples from the four flumes are analyzed for Arsenic, Cadmium, Mercury, Molybdenum, Selenium, in addition to the monthly Copper, Silver, and Zinc. Once a quarter composite samples are taken from all four flumes and analyzed for Lead, in addition to the monthly Copper, Silver, and Zinc

F. Depending on the quarter, the full panel of all the contaminants might be conducted in addition to the lead. Below is a schedule of the daily flow monitoring with flowmeters and pH tests that should be considered.

G. Additional tests may be required in the event of an exceedance in any of the parameters a Temporary Increase in Self -Monitoring (TISM) is required until the water tests are compliant with the EPA effluent limitations and standards.

H. The contractor should be familiar with this testing schedule as stated in the EPA standards. The test results will be reported separately for each flume and also combined as a flow weighted average of all four flumes.

I. The contractor will follow the previous testing cycles from the last contract to ensure that the samples are taken on time. The reports are due each month.

J. Below is a schedule of the daily flow monitoring with flowmeters and pH tests that should be considered.

SECTION C - CONTRACT CLAUSES

C.1 ADDENDUM to FAR 52.212-1 INSTRUCTIONS TO OFFERORS—COMMERCIAL ITEMS

INSTRUCTIONS TO OFFERORS:

Prospective Offerors are notified that verification of VA Form 10091 and the W-9 sent directly to the VA paying office in Austin, TX, must be submitted with the quote unless the offeror has previously submitted these forms to VA Austin and provides certification of previous work. The FMS Vendor File Update form needs to be submitted in all cases to the Contracting Officer as part of the offers quote. Prior information sent to the VA Payment Center in Austin does not preclude submittal of the FMS Vendor File Update form. Failure to include this information could preclude the offeror from consideration for award or considerably delay award.

The Contractor is advised that all submissions and related materials become the property of the U.S. Government and will not be returned. A Contractor’s quote, if accepted by the Government, will form binding parts of the contract that results from this solicitation. Therefore, care must be taken to properly address the requirements set forth in this RFQ.

Due Date:

The Offeror shall submit the RFQ with the signed SF1449 electronically to Arcelia.medina@va.gov by the time and date specified on Block 8 of the SF1449.

Contractors are responsible for ensuring that the Contract Specialist has received the quote before the response deadline. The Government will not be responsible for delays or failures of either the Contractor’s or the Government’s e-mail system. Amendments to this Solicitation: Contractors are encouraged to monitor the Federal Business Opportunities website at www.fbo.gov with respect to this solicitation because any amendments to this Solicitation will be posted on that website.

Format of Quote: In order to be considered for selection, the Offeror must submit a complete response to this solicitation using the sequence and format instructions provided. Quotes shall NOT contain classified data. NO ZIPPED FILES are permitted.

Offerors should review this entire solicitation before submitting a quote to ensure that their quote meets all requirements.

Vendor Point of Contract: Submit the name of the individual who can answer questions about the offeror to include First and Last names, Telephone number, and email address.

Site Visit: There will be only 1 site visit scheduled to walk through the Phoenix VA to view each of the vaults. The site visit will be held on July 30, 2019 at 7:00 am local time and can take up to 2 hours to complete. To participate in this site visit you will need to email Arcelia.medina@va.gov no later than July 29, 2019 by 2:00 pm AZ Time and provide the name(s) and contact # of the person(s) who will be attending. A detail of the location for the site visit will be sent after the email of participation is received.

Each offer submitted shall include the following documentation in-order to be considered for award deviating from this requirement may exclude your offer from award:

The offeror shall submit their pricing within the schedule, Section B, of the SF 1449. The offeror shall properly complete the solicitation document (SF 1449) along with any amendments (SF 30), if any are issued. Complete Blocks 12, 17a (please include DUNS number), 30a, 30b, and 30c of the Standard Form 1449.

File #2: Technical Requirements:

The offeror shall submit technical information as a separate file containing the information below:

1. Verification of submitted VA Form 10091 and W-9 faxed to Austin, TX (fax number is located on the VA10091 Form).

2. FMS Vendor File Update Form send to Contract Specialist

3. Qualifications: Offeror must establish their qualifications and demonstrate their ability to perform all services by providing a minimum of a two-page capability statement pertaining to this solicitation

4. Certifications: Offeror shall submit certification of a valid certificate number and list of approved fields of testing for the laboratory to be used for sample analysis. Certificates for any subcontractor shall also be submitted if applicable

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed one (1) year.

C.5 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

(End of Clause) C.6 VAAR 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2016)(DEVIATION)

(a) Definition. For the Department of Veterans Affairs, “Service-disabled veteran-owned small business concern or SDVSOB”:

(1) Means a small business concern:

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans or eligible surviving spouses (see VAAR 802.201 Surviving Spouse definition);

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans (or eligible surviving spouses) or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran;

(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;

(iv) The business has been verified for ownership and control pursuant to 38 CFR 74 and is so listed in the Vendor Information Pages database, (https://www.vip.vetbiz.gov); and

(v) The business will comply with subcontracting limitations in 13 CFR 125.6, as applicable

(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(b) General.

(1) Offers are solicited only from verified service-disabled veteran-owned small business concerns. Offers received from concerns that are not verified service-disabled veteran-owned small business concerns shall not be considered.

(2) Any award resulting from this solicitation shall be made to a verified service-disabled veteran-owned small business concern.

(c) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, the concern will comply with the limitation on subcontracting requirements in 13 CFR §125.6.

(d) A joint venture may be considered a service-disabled veteran owned small business concern if the joint venture complies with the requirements in 13 CFR 125.15, provided that any reference therein to SDVO SBC is to be construed to apply to a VA verified SDVOSB as appropriate.

(e) Any service-disabled veteran-owned small business concern (non-manufacturer) must meet the requirements in FAR 19.102(f) of the Federal Acquisition Regulation to receive a benefit under this program.

(End of Clause) C.7 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service- Disabled Veteran-Owned Small Business Set-Aside.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

C.8 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.9 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Arizona. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

(i) 52.203-13, Contractor Code of Business Ethics and Conduct (OCT 2015) (41 U.S.C. 3509).

(ii) 52.203-19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements (JAN 2017) (section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub.
