B.3 STATEMENT OF WORK
STATEMENT OF WORK
1. Requirements.
a. The contractor shall provide all necessary labor, materials, equipment, tools, and trucks to support sanitary sewer and storm drain jetting service, inspection service and on-call jetting service in accordance with the specifications of the Statement of Work.
1. The CCTV operator shall be trained and certif ied to the NASSCO PACP standard.
Documentation shall be submitted prior to start of CCTV inspection operations and within fourteen (14) days of award.
b. Sanitary sewers shall be maintained per the schedule below. Contractor shall provide two (2) emergency calls per calendar year at each location with a 24-hour response time from time of call.
c. Base Year: The work to be completed on each section of sewer will be performed in phases as defined in the following:
1. Phase 1 Pre-cleaning Inspection.
a. The preferred method for Pre-Cleaning Inspection is color CCTV conforming to NASSCO Pipeline Assessment Certif ication Program (PACP), and for the data to be exported electronically in a PACP certif ied format. Since this inspection is performed prior to cleaning, it is understood that the video may not provide an “unobstructed view of the entire pipe”.
b. The Contractor may propose other methods to the Government prior to bid for inspection such as, zoom camera inspection, digital sidewall scanning inspections, acoustical technology, etc.
c. If the Contractor is performing the Pre-Cleaning Inspection, the method must be pre-approved by the Government prior to inspection of the sewer interior.
2. Phase 2 Sewer Pipe Cleaning. Based on the Government’s review, he or she will determine if additional work will be required. At the sole discretion of the Government is to either declare the work on the particular sewer segment complete or notify the Contractor of additional work.
3. Phase 3 Additional Sewer Pipe Cleaning (Optional). The Contractor shall perform the assigned additional work.
4. Phase 4 Post Cleaning Inspection. Final televising of the sewer segment to evaluate the condition of the sewer segment after all cleaning has been performed in Phase
3. Phase 4 will be required to be performed and will be reimbursed at the bid unit price.
a. The recorded video must show the entire circumference of the sewer. Any flow control to remove standing water and debris shall be incidental to the contract. It is not the intent of this specification to require bypass pumping 6 to control heavy flow; however, the Contractor must, at a minimum, make reasonable effort to control the flow by using flushing equipment to temporarily retain flow or to remove standing water. The Contractor must also consider weather conditions to obtain the best video image of the sewer. This may require the Contractor to delay any video work after major rain events until the system can return to lower dry weather flow. The Contractor shall submit PACP data to include the electronic video reports, logs, etc. for the Government’s review.
b. The segments of sewer to be cleaned and televised through this contract will be located primarily within the paved areas of the station’s roadways and parking areas. Closures will need to be coordinated with the station’s COR.

d. Option years:
1. Annually perform Phase 4 for all segments.
2. Perform Phase 2 in the periodicity noted in the tables in 2.
e. All debris must be properly removed and disposed of off VA premises by the Contractor.
Services must be performed by licensed and experienced Contractors for the type of services as further defined in the Statement of Work. Quantities shown are estimated and may be increased or decreased in accordance with need.
2. Place of Performance. The work to be performed under this contract shall be performed at the following VA Medical Centers.

3.1. Period of Performance and Schedule.
a. Period of Performance. The period of performance shall be for one 12-month base period and four (4), 12-month options if exercised by the Government. Each Option Period shall be evaluated individually and shall only be exercised based on the availability of funds and government needs.
b. Schedule. This service shall be performed as listed in Section 2. All work shall be performed. Monday through Friday, excluding Government Holidays, in accordance with the following schedule:
1. Dallas Facility: Between 3:00 AM and 09:00 AM or weekends. This is due to where the manholes are located. Services during business hours shall gridlock traffic of Veterans Affairs North Texas Health Care System (VANTHCS) facilities.
2. Bonham and Garland Facilities: Between 8:00 AM and 3:30 PM.
3. The Government hereby provides notice and Contractor hereby acknowledges receipt that Government personnel observe the listed days as holidays:

4. In addition to the days designated as holidays, the Government observes the following days:
o Any other day designated by Federal Statute o Any other day designated by Executive Order o Any other day designated by the President’s Proclamation
It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation shall be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.
3.2. Scope of Work.
a. The contractor shall be responsible for the verification of all requirements for this service.
All measurements and conditions must be verif ied by the contractor. Any discrepancies between field conditions, project documents, and this SOW shall be immediately brought to the Contracting Officer’s attention. Verification can be completed during the scheduled site visit prior to contract award.
b. Sewer Cleaning
1. Unless stated otherwise, all inspections and resulting records, reports, and videos must follow all procedures, processes, and recommendations outlined within NASSCO PACP standards. Defect codes must align with NASSCO PACP defect codes.
a. Block debris at downstream manhole to prevent contamination of the downstream mains. Sludge, dirt, sand and other debris resulting from the cleaning operations shall be removed from the downstream manhole of the section being cleaned.
Passing material from the section being cleaned to the downstream sewer section shall not be permitted.
b. The liquid portion of material removed at the manholes shall be decanted back into the sewer. The solid and semi-solid material removed at the manholes shall be disposed of at a designated site as approved by the City of Regina.
c. The maximum allowable water level within a pipe, during inspection, is 20%. The Contractor is required to bring down the water level where any part of any pipe exceeds 20%.
c. Disposal and transportation Sludge, dirt, sand and other debris resulting from the cleaning operations, the contractor shall use a waste transporter permitted by the city where the sewer system is being serviced.
1) Waste must be transported by a waste hauler licensed by the Texas Commission on
Environmental Quality and to a properly permitted disposal site.
2) A manifest of hauled waste receipt shall be provided to the site Government Point of Contact immediately upon completion. The Manifest must be signed by the Government Point of Contact and the Transporter at the time of waste removal.
3) Transporter means a person who is registered with and authorized by the TCEQ to transport sewage sludge, water treatment sludge, domestic septage, chemical toilet waste, grit trap waste, or grease trap waste in accordance with 30 TEXAS
ADMINISTRATIVE CODE §312.142.
3.3. General Requirements.
a. Contractor shall notify engineering general foreman or engineering plumbing shop personnel by email at David.Murphy@va.gov at least two weeks in advance of each pumping date. The Point of Contact (POC) can also be reached at 214-857-1005.
During this notif ication, arrangements shall be made for the facility PO to accompany the contractor at the site of work. Upon completion of each service the contractor shall obtain the signature of the Engineering designee, as specified, to show mailto:David.Murphy@va.gov acceptance/rejection of the service. A copy of this transaction shall be given to the Engineering designee.
b. Rescheduling Services: In an unforeseen event such as weather that may prevent the service from being conducted, the contractor shall be notif ied by the POC and at the government’s discretion work schedule. The contractor shall provide this service at no additional cost to the government.
c. The contract certif ies that all applicable services offered under this contract shall conform to all common industry standards. The contractor for these services shall meet any regulatory requirements.
d. The Contractor shall possess and maintain all necessary required insurance, license and permits required for contract performance and in accordance with local, state, federal regulatory authorities, and the Federal Acquisition Regulation. Contractor is responsible for any injury to themselves, or their employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by employees’ fault or negligence.
e. Reporting “on-the-job” Injuries: The Contractor is required to report all “on-the-job” injuries incurred by the Contractor, its agents or employees, resulting from performance of this contract. Contractor shall notify the contracting officer representative (either orally or via telephone) within twenty-four (24) hours of the injury and provide details and exact location of the incident. This shall be followed up by a written notice to the COR.
3.4. Reporting Requirements. As a part of the cleaning, inspect and make a written report on any abnormal conditions found. This report shall be provided to the COR at the completion of each service visit.

3.5. Regulatory Requirements
a. Disposal of materials removed under this contract at an approved disposal site in accordance with all local, state, and federal laws, regulations, and guidelines are the Contractor’s sole responsibility. The contractor shall adhere to all Texas Commission on Environmental Quality (TCEQ) requirements concerning removal, transporting, and disposal of the material.
b. All f ire and safety rules and regulations are applicable; NFPA and SBCCI dated 1999.
The Contractor shall comply with EM385-1-1 dated 1987 for minimum safety requirements. Construction Safety Guidebook (VHA Center for Engineering & Occupational Safety & Health).
c. The Contractor shall be responsible for obtaining any licenses and permits and complying with any laws, codes, and regulations applicable to the execution of this work as required Federally and by the State of Texas.
d. The Contracting Officer and Contracting Officer Representative reserves the right to conduct any inspections or perform any tests deemed necessary at any time during the execution of the contract to determine conformance with the requirements of theses specifications.
3.6. Condition of Equipment. The contractor accepts responsibility for the equipment described in “as is” condition. Failure to inspect the equipment prior to contract award shall not relieve the Contractor from performance of the requirements of this contract.
3.7. Contractor Capability Requirements. The contractor shall be licensed in all service areas to clean and haul waste to a properly permitted disposal site. Permits shall be submitted as part of the proposal technical submission.
3.8. Contractor Personnel Security Requirements. At all Facilities Contractors are required to check in with engineering general foreman or engineering plumbing shop personnel.
Visitor’s badges shall always be obtained and always worn while on VA property unless escorted by VA personnel.
3.9. Safety Plan Requirements.
1. All contractors performing services for the Government must comply with all
Occupational Safety and Health Administration (OSHA), State, County and Municipal Safety and Occupational Health Standards and any other applicable rules and regulations. Also, all Contractors and Subcontractors shall be held responsible for the safety of their employees and any unsafe acts or conditions that may cause injury or damage to any persons or property within and around the work site area under this contract.
2. Prior to performing any work, the contractor shall be required to submit a safety plan in accordance with OSHA and VA Regulations. The safety plan shall include but not limited to:
1) Company Safety and Health Policy
2) Company Safety and Health Objectives
3) Job Site Inspections process / requirements
4) Identif ication of Contractor Safety Administrator
5) Personal Protective Equipment Requirements
6) Safety Rules; Job Hazard Analysis for commercial Grease Trap tasks
7) Job Safety Training Requirements (OSHA Training, State or Local Training requirements) and completion status.
8) Safety Discipline (i.e. correction of violations, etc)
9) Hot Work Permit (i.e. responsibilities, procedures, etc)
10) Confined Space Training / Competent Person Training
11) Emergency Procedures (i.e. responsibilities, procedures, etc)
12) Written Hazard Communication Program (i.e. responsibilities, procedures, list of hazards, MSDS, etc)
3. All ladders, scaffolding, tools, equipment, personal protective equipment, etc. must be OSHA approved for the work to be performed. Contractor must use caution signs as required by OSHA Regulations. Caution signs must be on-site on commencement of Contract.
4. The Contractor must purchase and issue all chemicals in their original containers.
Materials that require precautionary warnings must have affixed to all containers such labels or markings as are prescribed by law, regulatory agencies or this Contract. Any violation of OSHA may be subject to default action.
5. Contractor must furnish to the COR two (2) copies of Material Safety Data Sheets (MSDS), for all products proposed for use, a minimum of seven (7) days prior to beginning service, for approval. Contractor must update copies of the MSDS on an annual basis. In addition, each time a new chemical product is proposed to be introduced into the facility, a copy of that product’s MSDS must be provided to the COR for approval, prior to the product being used at the facility.
3.10. Codes and Standards.
a. The project shall be in accordance with the latest Uniform Building Code (UBC), National Fire Protection Associate (NFPA) standard, Uniform Federal Accessibility Standard (UFAS), VA Specifications and Standards, and local facility requirements. In the event there is a conflict between any of the standards/codes, the more stringent standard/code shall apply.
b. The contractor shall provide all applicable safety signage and barricades applicable to OSHA, VHA and DOD regulations. Contractor shall comply with VHA DIRECTIVE 2004-012 and all VA Center Policy Memorandums, including but not limited to the following:
1) Protection of patients, visitors, and employees from traumatic injury, as well as occupational and facility–associated infections.
2) Compliance with OSHA and State construction safety regulations. Construction contracts require that the general contractor’s on-site “competent person” have completed the OSHA 30-hour construction worker course and that all other general and sub-contractor’s workers have completed the OSHA 10-hour construction worker course or other relevant competency training. The determination for training is based on the project hazards and complexity, State and Federal regulations and VA requirements. Verif ication of completion of training shall be required prior to performing work.
3) Compliance with EPA and State environmental regulations.
3.11. Invoice and Payment
a. Payment to be made monthly, in arrears, following satisfactory performance by Contractor’s personnel and upon receipt of a properly prepared invoice.
b. Contractor shall be required to invoice through the Tungsten System at http://www.tungsten-network.com/us/en/veterans-affairs/. Additional information regarding Tungsten shall be provided upon award.
c. The contractor shall have current registration in the System for Award Management
(SAM) for this solicitation; URL: www.sam.gov.
d. The invoice SHALL be itemized to include the following information. Any information listed below, and not provided on an invoice, shall render that invoice incomplete and the invoice shall be returned for immediate correction. Invoice to be approved by COR before submission to Tungsten.

3.12. Records Management
1. Contractor shall comply with all applicable records management laws and regulations, as well as National Archives and Records Administration (NARA) records policies, including but not limited to the Federal Records Act (44 U.S.C. chs. 21, 29, 31, 33), NARA regulations at 36 CFR Chapter XII Subchapter B, and those policies associated with the safeguarding of records covered by the Privacy Act of 1974 (5 U.S.C. 552a). These policies include the preservation of all records, regardless of form or characteristics, mode of transmission, or state of completion.
2. In accordance with 36 CFR 1222.32, all data created for Government use and delivered to, or falling under the legal control of, the Government are Federal records subject to the provisions of 44 U.S.C. chapters 21, 29, 31, and 33, the Freedom of Information Act (FOIA) (5 U.S.C. 552), as amended, and the Privacy Act of 1974 (5 U.S.C. 552a), as amended and must be managed and scheduled for disposition only as permitted by statute or regulation.
3. In accordance with 36 CFR 1222.32, Contractor shall maintain all records created for Government use or created in the course of performing the contract and/or delivered to, or under the legal control of the Government and must be managed in accordance with Federal law. Electronic records and associated metadata must be accompanied by sufficient technical documentation to permit understanding and use of the records and data.
4. VA North Texas Health Care System and its contractors are responsible for preventing the alienation or unauthorized destruction of records, including all forms of mutilation. Records may not be removed from the legal custody of VA North Texas Health Care System or destroyed except for in accordance with the provisions of the agency records schedules and with the written concurrence of the Head of the Contracting Activity. Willful and unlawful destruction, damage or alienation of Federal records is subject to the fines and penalties imposed by 18 U.S.C. 2701.
In the event of any unlawful or accidental removal, defacing, alteration, or destruction of records, Contractor must report to VA North Texas Health Care System. The agency must report promptly to NARA in accordance with 36 CFR 1230.
5. The Contractor shall immediately notify the appropriate Contracting Officer upon discovery of any inadvertent or unauthorized disclosures of information, data, documentary materials, records or equipment. Disclosure of non-public information is limited to authorized personnel with a need-to-know as described in the [contract vehicle]. The Contractor shall ensure that the appropriate personnel, administrative, technical, and physical safeguards are established to ensure the security and confidentiality of this information, data, documentary material, records and/or equipment is properly protected. The Contractor shall not remove material from Government facilities or systems, or facilities or systems operated or maintained on the Government’s behalf, without the express written permission of the Head of the Contracting Activity. When information, data, documentary material, records and/or equipment is no longer required, it shall be returned to VA North Texas Health Care System control or the Contractor must hold it until otherwise directed. Items returned to the Government shall be hand carried, mailed, emailed, or securely electronically transmitted to the Contracting Officer or address prescribed in the [contract vehicle]. Destruction of records is EXPRESSLY PROHIBITED unless in accordance with Paragraph (4).
6. The Contractor is required to obtain the Contracting Officer's approval prior to engaging in any contractual relationship (sub-contractor) in support of this contract requiring the disclosure of information, documentary material and/or records generated under, or relating to, contracts.
The Contractor (and any sub-contractor) is required to abide by Government and VA North Texas Health Care System guidance for protecting sensitive, proprietary information, classified, and controlled unclassified information.
7. The Contractor shall only use Government IT equipment for purposes specifically tied to or authorized by the contract and in accordance with VA North Texas Health Care System policy.
8. The Contractor shall not create or maintain any records containing any non-public VA North Texas Health Care System information that are not specifically tied to or authorized by the contract.
9. The Contractor shall not retain, use, sell, or disseminate copies of any deliverable that contains information covered by the Privacy Act of 1974 or that which is generally protected from public disclosure by an exemption to the Freedom of Information Act.
10. The VA North Texas Health Care System owns the rights to all data and records produced as part of this contract. All deliverables under the contract are the property of the U.S.
Government for which VA North Texas Health Care System shall have unlimited rights to use, dispose of, or disclose such data contained therein as it determines to be in the public interest.
Any Contractor rights in the data or deliverables must be identif ied as required by FAR 52.227- 11 through FAR 52.227-20.
11. Training. All Contractor employees assigned to this contract who create, work with, or otherwise handle records are required to take VHA-provided records management training, Talent Management System (TMS) Item #10176, Privacy and Information Security, Rules of Behavior. The Contractor is responsible for confirming training has been completed according to agency policies, including initial training and any annual or refresher training.

C.2 SUPPLEMENTAL INSURANCE REQUIREMENTS
In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:
(a) Workers' compensation and employers liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.
(b) General Liability: $500,000.00 per occurrences.
(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.
(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.
