Justification and Approval (J&A) For

Other Than Full and Open Competition (>SAT)

Acquisition Plan Action ID: 36C257-24-AP-3147

1. Contracting Activity: Department of Veterans Affairs, VISN 17, VA South Texas Health

Care System, 7400 Merton Minter, Surgical Service, San Antonio, TX., 78229, NCO 17, Direct Clinical Support. Transaction 671-24-3-039-0371.

2. Nature and/or Description of the Action Being Processed: Eyesi Surgical Simulator is being purchased to allow resident providers to learn and practice surgical skills in a safe environment. This action will be awarded as a new contract. The purchase will include: all Cataract Courseware, Vitreoretinal Training Modules and Courseware. The equipment is stand alone and does not connect to VA systems.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: Eyesi Surgical offers an immersive environment for training of surgical steps. Through the simulator´s OR microscope trainees see the virtual surgical field in stereo and high resolution while operating with lifelike surgical instruments. Just as in real surgery, discreet instrument movements are required to avoid undue wound stress, loss of viscoelastic, or diminished red reflex. The highly realistic simulation of interaction with tissue in real-time increases trainees’ surgical experience – without risk for real patients. Residents are required to perform a number of procedures on the device prior to performing any surgical procedures on Veterans.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

Haag-Streit is currently the only manufacturer that produces an Ophthalmic Surgical Simulator.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Extensive research was performed to find as many sources as possible. Guidance from University of Texas Ophthalmology residency program, Research in Ophthalmology medical journals and conducting interviews with SME. Only one manufacturer provides an Ophthalmic Surgical Simulator.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: It is anticipated that costs will be be fair and reasonable and will be compared to the Government estimate, prices found reasonable on similar purchases for similar items,

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: VetCert searched NAICS 339112 resulted in 659 SDVOSB/VOSB. SBA searched NAICS 339112 resulted in 86 HUBZone Certified, 639 Service-Disabled Veteran-Owned Small Business or Joint Venture, 54 Veteran-Owned Small Business or Joint Venture, 138 Women-Owned Small Business, 69 Economically Disadvantaged Women-Owned Small Business, and 95 8(a) Certified or 8(a) Joint Venture. ECAT searched keyword Eyesi resulted in 0 results. GSA eLibrary searched keyword Eyesi resulted in 0 results. GSA Advantage searched keyword Eyesi resulted in 0 results. FPDS searched keyword Eyesi resulted in 78 VA Awarded contracts with the most recent award to SDVOSB CORPS Medical Supply LLC.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Other sources are not available due to the lack of market competion. Because Haag-Streit is the ONLY manufracturer of an Ophthalmic Surgical Simulator.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: LB Haag-

Streit and SDVOSB CORPS Medical Supply, LLC.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any

Barriers to Competition before Making subsequent acquisitions for the supplies or services required: There are no know barriers to remove or overcome. CORPS Medical Supply is a SDVOSB. There is currently only one product on the market for Ophthalmology Surgical Simulation training.
