Effective Date: 02/01/2022 Page 3 of 4 evaluate which could meet the requirement while preventing future contamination. It was determined through market research and first-hand knowledge of trays used previously that Aesculap trays are the manufactured trays that could fulfill the requirement due to their new generation baskets with pans. Aesculap was contacted to determine authorized distributors in order to solicit as much competition as possible in the emergent situation, it was confirmed that the only authorized distributor for government sales is TrillaMed LLC.
Other brands reviewed revealed tray issues; filter plate retention plates would jam and could not be removed, tray design did not allow for an audible or visual confirmation that filter is properly secured, no stop on handles resulted in employees pinching fingers, metal-on-metal contact between pan and basket, handle designs lead to jamming in the instrument washer causing damage to the pan, washer baskets and washer arms.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable: The final contract price was determined fair and reasonable based on market research (FAR 13.106-3(a)(2)(i)), based on comparison of proposed prices (FAR 13.106-3(a)(2)(ii)) and based on current price lists (FAR 13.106-3(a)(2)(iii)).
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons
Market Research Was Not Conducted: Market research was conducted searching all mandatory and non-mandatory sources to include a NAICS check on VetCert. Market research was conducted by subject matter experts by reviewing commercial items in the current marketplace and examining past acquisitions of similar items and utilizing professional experience with similar items in the marketplace. See section six above for detailed examination of different manufactured items.
9. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: Due to the emergent nature of this procurement, market research was conducted to the extent practicable, there was not an opportunity for sources to express interest in the acquisition.
10. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to
Competition before Making subsequent acquisitions for the supplies or services required: Future acquisitions for any surgical trays required in the future will be procured utilizing competition to maximum extent. End of life planning for trays will allow for competition.
11. Requirements Certification: I certify that the requirement outlined in this justification is a Bona
Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
