B.2 STATEMENT OF WORK

GROUNDS MAINTENANCE SERVICES

SOUTH TEXAS VETERANS HEALTH CARE SYSTEM

1. GENERAL

1.1 General: This is a non-personal services contract to provide grounds maintenance services. The Government shall not exercise any supervision or control over the service providers providing the services described herein.

1.2 Description of Services/Introduction: The Contractor shall provide all personnel, transportation, equipment, supplies, facilities, supervision, and other items and non- personal services necessary to perform the services as defined in this Statement of Work. The Contractor assumes all liability risks for work performed under this contract. The Contractor must assume total liability for all contract employees. The Contractor shall perform to the standards of the contract.

1.3 Physical Security: The Contractor shall be responsible for safeguarding all government equipment, information and property provided to

Contractor personnel while performing the services described herein.

1.4 Type of Contract: The government will award a firm fixed-priced contract.

1.5 Service Contract Act: The Service Contract Act applies to this contract.

Current Service Contract Act Wage Determinations for the service areas will be attached to the contract. Employees performing under this contract must be paid at least the pay and fringe benefits described therein.

1.6 Contracting Officer Representative (COR): The COR will be identified by a separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. A letter of designation issued to the COR, a copy of which will be provided to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates.

The COR is not authorized to change any of the terms and conditions of the resulting order.

1.7 Contract Administration: The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting

Officer on all matters pertaining to contract administration. Only the

Contracting Officer is authorized to make commitments or issue changes that will affect price, quantity or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof. All changes to the contract will be issued via an amendment and/or modification in writing from the Contracting Officer to the

Contractor.

1.8 Invoices: Invoices are to be submitted electronically; monthly, in arrears of the start of the services performed each month. Invoices must include the IFCAP (Integrated Funds Control Point) obligation number (Finance purchase order number) assigned during each period of performance to ensure timely payment. Electronic invoices can be submitted at no additional cost at the VA Vendor Information System (VIS) website https://www.vis.fsc.va.gov/login.aspx?ReturnUrl=%2fDefault.aspx , or at http://www.tungsten-network.com/us/en/veterans-affairs/. The COR is responsible for the acceptance of services invoices and/or the processing of receiving reports for the services provided to the government.

1.9 Progress Meetings: The Contractor agrees to attend periodic progress meetings. The Contracting Officer, COR, and/or other government personnel, as deemed appropriate, may meet periodically with the

Contractor to review the Contractor’s performance. At these meetings the

Contracting Officer will appraise the Contractor of how the government views the Contractor’s performance and the Contractor will apprise the government of problems, if any, being experienced. Appropriate action will be taken to resolve outstanding issues. The Contractor’s attendance at these meetings will be at no additional cost to the government.

1.10 Work Stoppage/Delays: The Contracting Officer shall be notified at the earliest time available, but no later than the next business day, via phone of Contractor's knowledge of any conditions which may adversely affect the Contractor's ability to perform under the terms and conditions as stated in the specifications of this requirement. For example, union strikes, vehicle problems, licenses, or anything that might jeopardize the terms and conditions of this contract should be reported to the Contracting

Officer.

2. BACKGROUND

The South Texas Veterans Health Care System (STVHCS) Organizational

Experience Service, Grounds Section, has an ongoing requirement for grounds maintenance/landscaping services for the Audie L. Murphy Memorial Veterans

Hospital (ALMD).

3. OBJECTIVE

The objective of the services are to provide grounds maintenance/landscaping to the ALMD Medical Center grounds, 7400 Merton Minter Street; to include, a detached parking lot (P- 9) located across the street from the main hospital on

Wurzbach Road, Villa Serena Domiciliary located at 4455 Horizon Hill Boulevard, https://www.vis.fsc.va.gov/login.aspx?ReturnUrl=%2fDefault.aspx http://www.tungsten-network.com/us/en/veterans-affairs/

STVHCS Fisher House located at 7485 Wurzbach Road and the Polytrauma

Transitional Rehabilitation Program (PTRP) located at 4949 Gus Eckert Road.

4. APPROACH AND METHODOLOGY

It shall be the Contractor’s responsibility to design a method and system of how best to deliver the services to meet the Governments quality and performance requirements. The requirements contained herein are all performance-based with a focus on desired result and outcome. This represents a challenge to the

Contractor to develop and apply innovative and efficient approaches to the contract requirements. Performance-based contracting is a result of the overall shift in government management toward commercial business practices.

The Contractor shall respond to comments and complaints from patrons and address them to the Contracting Officer or the COR immediately. In the event of malfunctioning equipment, the Contractor shall make every effort to immediately correct the problem to ensure patron satisfaction. If the problem is systemic, the

Contractor will submit a plan of correction to the Contracting Officer or the COR.

It is the Contractor’s responsibility to obtain required Personal Protective

Equipment (PPE) for each of their employees and ensures that they are wearing, using, maintaining and storing equipment properly.

5. DESCRIPTION AND SCOPE OF WORK

5.1 ALMD HOSPITAL GROUNDS MAINTENANCE

A. LAWN MAINTENANCE:

Contractor is required to mow, trim, de-weed, edge and blow or vacuum, the VA

Medical Center grounds, parking areas and detached (P-9) parking lot, STVHCS

Fisher House, Villa Serena Domiciliary and Polytrauma Transitional

Rehabilitation Program (PTRP). Grounds will be mowed to a height of 4 to 5 inches (whichever is more applicable). All clumps, piles and windrows will be scattered, blown or otherwise removed. The grounds will be trimmed using string trimmers, edger or other apparatus. All concrete abutments, sidewalks and curbs will be edged. Trees, signs, poles and other free-standing objects will be trimmed so as not to damage the object. The grounds will be blown with blowers or vacuums so as to remove all clippings from sidewalks, streets and pedestrian ways. Grass areas will be free from clumps and windrows. The Contractor will remove all debris generated as a result of this effort from VA Medical Center grounds.

Contractor is required to mow, remove weeds from plant beds, maintain and string edge all lawn, curbing, sidewalks, trees and plant beds around

Polytrauma, PTRP and Fisher House. Contractor is required to string trim all new fences in and around Statue Island, front entrance of hospital and all new fence area with rock barrier under it. Contractor will provide herbicide treatment to rock area under fence.

All refuse generated by the services shall be removed at the end of the working day.

A.1 Hours of work:

All work shall be conducted preferably on Thursday and/or Friday beginning at

7:00 A.M. during normal duty hours (7:00 A.M. to 4:30 P.M.). Any work that must be completed outside of normal hours or on weekends will be coordinated between the Contractor and the COR, with no less than a five (5) working day notice. Services will be required once a week, during normal duty hours.

B. TREE/SHRUB MAINTENANCE:

Contractor shall trim shrubs at the Audie L. Murphy VA Hospital grounds, Villa

Serena, Fisher House parking lot areas and all detached parking lot areas in accordance with standard practices of the trade. In general, overgrown shrubs along the main entrance and surrounding the exterior of the main parking lot, to include the shrubs adjacent to all buildings will be trimmed to a height of approximately 4 feet. (This will be evaluated on a section- by- section basis, keeping the natural shape of the shrub intact.). All other shrubs will be trimmed to applicable heights so as not to block windows or obstruct pedestrian traffic flow.

Clippings from shrub trimming will be promptly bagged or otherwise loaded and removed from VA Medical Center grounds. Contractor will remove and replace selected shrubs from the VA Medical Center grounds. Specifically, the shrub rows immediately adjacent to and on both sides of the main entrance will be removed and the resulting soils will be tilled and/or amended in preparation for new shrub replacement. Gaps in the shrub rows along the exterior of the parking lot will be filled with like species. Old and newly cut leaves from underneath the shrubs, along with debris and other foreign matter will be raked and removed from the VA Medical Center grounds. Services to be provided include, but are not limited to:

i. Weekly Interval

1. Mowing

2. Trimming shrubs

3. Tree trimming and grooming up to 12 feet.

4. Edging and blowing walkways and paths

5. De-weeding of plant beds

6. Mulch main entrance and around polytrauma 2 x per year.

7. Pick up, bag and remove leaves during heavy leave falls

8. Fertilizer adjacent to all buildings at Audie Murphy, Fisher House, Villa

Serena, and PTRP 2 x per year. To include pre-emergent and post emergent.

ii. As needed / as requested - Quarterly, Small Scale

1. Installing sod

2. Planting trees and shrubs

3. Aerating soil

4. Planting bedding areas

5. Removal of plants

6. Fertilizing and adding soil

7. Spraying islands with roundup for weeds

8. Repairing irrigation lines and replacing sprinkler heads

B.2 Hours of work:

All work will be conducted preferably on Thursday and/or Friday beginning at

7:00 A.M. during normal duty hours (7:00 A.M. to 4:30 P.M.). Any work that must be completed outside of normal hours or on weekends will be coordinated between the Contractor and the COR, with no less than a five (5) working day notice. Services will be required once a week, during normal duty hours.

C. SWEEP/VACUUM PARKING LOTS

Contractor shall provide all necessary barriers, cones and equipment to block parking lot scheduled for cleaning. Work will not be accomplished during periods of rain and /or wet weather.

Contractor is responsible for sweeping all paved parking lots, roadways and warehouse loading dock areas, to include the parking lot P-9 (across the street from main hospital on Wurzbach Road).

Contractor shall blow out or vacuum all corners, curbs, sidewalks, car stops and parking lot islands of leaves and trash. All trash and debris picked up by the

Contractor will be disposed of in an open top container (dumpster), provided by the VA Hospital.

Contractor shall pay special attention to parked cars. The Contractor is responsible for damage to vehicles as a result of the negligible or unintentional actions by the Contractor in the service performance of the contract. Any debris blown on parked cars will be removed by Contractor.

Contractor shall make sure any rocks, on all paved surfaces, are picked up and disposed of, either by returning rocks to rock area or in a designated dumpster.

C.1 Hours of work:

Work will be accomplished twice a month on Friday evenings (after 5:00

PM) Saturday or Sunday.

5.2 VILLA SERENA DOMICILIARY GROUNDS MAINTENANCE

A. LAWN MAINTENANCE:

Contractor shall mow, trim, edge and blow all turf areas of the Villa Serena

Domiciliary grounds. The grounds will be mowed to a height of 3 to 4 inches

(whichever is more applicable). All clumps, piles and windows will be scattered, blown or otherwise removed. The grounds will be trimmed using string trimmers, edger or other apparatus.

Lawn and grounds must present a smooth even appearance after mowing, trimming and or edging. All concrete abutments, sidewalks and curbs will be edged. Trees, signs, poles and other free-standing objects will be trimmed so as not to damage the object. The grounds will be blown with blowers or vacuums so as to remove all clippings from sidewalks, streets and pedestrian ways. Grass areas will be free from clumps and windrows. The Contractor will remove all debris generated as a result of this effort from the Villa Serena Domiciliary grounds, and will not use the facilities dumpsters, trash receptacles, etc. for disposal. B. SHRUB MAINTENANCE:

5.3 STVHCS FISHER HOUSE GROUNDS MAINTENANCE

(whichever is more applicable). All clumps, piles and windows will be scattered, blown or otherwise removed. The grounds shall be trimmed using string trimmers, edger or other apparatus. Lawn and grounds must present a smooth even appearance after mowing, trimming and or edging. All concrete abutments, sidewalks and curbs will be edged. Trees, signs, poles and other free- standing objects will be trimmed so as not to damage the object. The grounds will be blown with blowers or vacuums so as to remove all clippings from sidewalks, streets and pedestrian ways. Grass areas will be free from clumps and windrows.

Contractor shall trim shrubs at the grounds in accordance with standard practices of the trade. In general, overgrown shrubs will be trimmed to a height of approximately 4 feet. (This will be evaluated on a section- by- section basis, keeping the natural shape of the shrub intact.). All other shrubs will be trimmed to applicable heights so as not to block windows or obstruct pedestrian traffic flow. Clippings from shrub trimming will be promptly bagged or otherwise loaded and removed from the grounds. Old and newly cut leaves from underneath the shrubs, along with debris and other foreign matter will be raked and removed from the grounds.

Contractor shall trim Palm trees at Fisher house 2 x per year

C. ROMAN FOUNTAIN MAINTENANCE

• Check any skimmer baskets for debris

• Test water for chemical balance with a DPD test kit

• Check the water level in the reservoir

• Inspect and clean all the suction strainers and backwash the sand filter

5.4 PTRP GROUNDS MAINTENANCE

A. LAWN MAINTENANCE

Contractor shall mow, trim, edge and blow all turf areas of the PTRP grounds. The grounds will be mowed to a height of 3 to 4 inches (whichever is more applicable).

All clumps, piles and windows will be scattered, blown or otherwise removed. The grounds will be trimmed using string trimmers, edger or other apparatus. Lawn and grounds must present a smooth even appearance after mowing, trimming and or edging. All concrete abutments, sidewalks and curbs will be edged. Trees, signs, poles and other free-standing objects will be trimmed so as not to damage the object. The grounds shall be blown with blowers or vacuums so as to remove all clippings from sidewalks, streets and pedestrian ways. Grass areas will be free from clumps and windrows. The Contractor will remove all debris generated as a result of this effort from the PTRP grounds, and will not use the facilities dumpsters, trash receptacles, etc. for disposal. The week or weeks that mowing is not required, due to dry weather or extremely wet weather, hedges may be pruned instead of mowing, at the discretion of the COR.

All refuse generated by the services shall be removed at the end of the working day.

A.1. Hours of work:

Work will be accomplished twice a month, preferably on Thursday and/or Friday beginning at 7:00 A.M. during normal duty hours (7:00 A.M. to 4:30 P.M.). Any work that must be completed outside of normal hours will be coordinated between contractor and building representatives with no less than a five (5) working day notice.

6 GOVERNMENT FURNISHED PROPERTY AND SERVICES

The Contractor may use the available utilities (water, electricity), if necessary, while in the performance of the contract services. Available utilities are not to be used for other Contractor projects or contracts.

C.1 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 calendar days of contract expiration.

C.2 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR

2000)

(a) The Government may extend the term of this contract by writ ten notice to the Contractor within 30 calendar days of contract expiration; provided that the Government gives the

Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

C.3 SUPPLEMENTAL INSURANCE REQUIREMENTS

In accordance with FAR 28.307-2 and FAR 52.228-5, the following minimum coverage shall apply to this contract:

(a) Workers' compensation and employers’ liability: Contractors are required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 is required, except in States with exclusive or monopolistic funds that do not permit workers' compensation to be written by private carriers.

(b) General Liability: $500,000.00 per occurrences.

(c) Automobile liability: $200,000.00 per person; $500,000.00 per occurrence and $20,000.00 property damage.

(d) The successful bidder must present to the Contracting Officer, prior to award, evidence of general liability insurance without any exclusionary clauses for asbestos that would void the general liability coverage.

BUSINESS SET-ASIDE (JUL 2019) (DEVIATION)

(a) Definition. For the Department of Veterans Affairs, “Veteran-owned small business or

VOSB”:

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more Veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more Veterans;

(ii) The management and daily business operations of which are controlled by one or more

Veterans;

(iii) The business meets Federal small business size standards for the applicable North

(d) Agreement. When awarded a contract (see FAR 2.101, Definitions), including orders under multiple-award contracts, or a subcontract, a VOSB agrees that in the performance of the contract, the VOSB shall comply with requirements in VAAR subpart 819.70 and SBA regulations on small business size and government contracting programs at 13 CFR part 121 and 125, including the nonmanufacturer and limitations on subcontracting requirements in 13

CFR 121.406 and 125.6, provided that for purposes of limitations on subcontracting, only VIP-listed VOSBs are considered eligible and/or “similarly situated” (i.e., a firm that has the same small business program status as the prime contractor). (3) General construction. In the case of a contract for general construction, it will not pay more than 85% of the amount paid by the government to it to firms that are not VIP-listed

VOSBs.

(4) Special trade contractors. In the case of a contract for special trade contractors, it will not pay more than 75% of the amount paid by the government to it to firms that are not VIP-listed

VOSBs.

(5) Subcontracting. Any work that a VIP-listed VOSB subcontractor further subcontracts will count towards the percent of subcontract amount that cannot be exceeded. For supply or construction contracts, cost of materials is excluded and not considered to be subcontracted.

(e) Joint ventures. A joint venture may be considered a VOSB if the joint venture is listed in

VIP and complies with the requirements in 13 CFR 125.18, provided, that any reference therein to service-disabled veteran-owned small business concern (SDVO SBC), shall also apply equally to a veteran-owned small business (VOSB) and is to be construed for the VA as only a

VIP-listed VOSB.

(f) Precedence. For any inconsistencies between the requirements of the SBA program for service-disabled veteran-owned small business concerns and the VA Veterans First Contracting

Program, as defined in VAAR subpart 819.70 and this clause, the VA Veterans First Contracting

Program requirements have precedence.

C.6 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—

MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service- Disabled Veteran-

Owned Small Business Set-Aside.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.
