The Contractor shall provide all labor, transportation, materials, equipment and supervision required for the removal and replacement of the electrical feed line to the HVAC roof top unit #8 located on the roof. Contractor is to also remove and replace damaged exterior electrical boxes and replace four (4) each 20amp GFCI receptacles. On conclusion of installation, Contractor is to verify and load new circuits to test equipment and wiring. Contractor will also clean-up and haul away any job-related debris.

A.4 SCOPE OF WORK

Building 225 VA Boiler Plant Rental Boiler Tie-In Waco VA Project

Requirements

The contractor shall provide all personnel, services, vehicles, transportation, tools, equipment, materials, supplies, facility supervision, administration supervision and any other item(s) necessary to perform and accomplish the services required for the Waco VA Boiler Rental Boiler Tie-in at Building 225, the Boiler Plant. Work shall be performed at the Doris Miller VA Medical Center (VAMC) in Waco, at 4800 Memorial Drive, Waco, Texas 76504 in Building 225. After all work is completed, the contractor will have a walkthrough with the VA COR and Operators to ensure all work is completed and ready to receive payment.

The contractor shall be familiar with all the terms, conditions, and requirements herein contained with warranty items and conditions in the contract. All work must comply with federal, state and local regulations. All welding work must comply with American Welding Society (AWS) as well American Society of Mechanical Engineers (ASME) codes for welding with Boiler and Pressure Vessel Certification (BPVC). All welds must be inspected and hydrostatic test by an independent contractor with a welding inspection certification prior to completion, (with no add cost to the VA).

The contractor shall provide the VA COR with a completed summary report, and list of any new deficiencies. If any other deficiencies arise that are not covered under this scope of work, the vendor will provide a quote for any needed corrective actions to the VA COR as soon as possible. The work will not be considered completed by the Government until the VA COR accepts the work.

All work shall be done according to the Infection Control Risk Assessment (ICRA) specified for the respective areas where work is performed.

Note: The Waco VA Boiler Rental Boiler Tie-in’s do not involve connectivity of any device/systems to the VA computer network and does not involve sensitive VA data. “The C&A requirements do not apply, and that a Security Accreditation Package is not required for this contract.”

Project Requirements

Base Bid – New Work Boiler Plant-Building 225

Contractor Responsibilities:

1. The Contractor shall visit the site to determine the full extent of the work. Failure to inspect the site will not constitute grounds for a claim after contract award. A site visit will be scheduled through the VA COR.

2. All permits for repair such as hot work permits, confined space entry permits, or etc. must be obtained from the VA Safety Department at least 24 hours in advance before work is to be done and coordinated with VA COR as well.

3. To ensure the uninterrupted operation of the medical facility, a shutdown will be conducted to install spool pieces with a valve to the existing piping. All valves are to be flanged for accessibility while the plant preforms normal operation.

4. Prior to attempting to tie in any connection, the contractor will verify the proper lock out/ tag out of all energy source.

5. Upon the completion of prefabrication, and coordination with the COR and plant operator on duty. The vendor will then conduct the installation of the rental boiler hook-ups connections. This will include tie ends to the existing steam header, natural gas line, fuel oil lines, and make-up water lines. This includes installation and insulation of pipe hangers, new valves, gaskets and blind flanges on each line ran.

6. (Note: VA Waco will be responsible for the required electrical power for the rental boiler. The vendor will provide the correct voltage and amperage prior to time of rental).

7. The service receipt will be provided to the customer upon completion of work.

8. At the end of the project clean up and haul off any debris, extra materials or waste that has accumulated during the project in accordance with EPA Guidelines and Regulations. Also, disposal of materials removed under this contract will comply with all local, state, and federal laws, regulations, and guidelines followed by contractor’s sole responsibility. The contractor shall adhere to all OSHA requirements concerning removal, transporting, and disposal of materials and hazardous materials.

Note: At the end of each workday, please clean-up all worked in areas.

It is understood and agreed between the Government and the Contractor that observance of such days by Government personnel shall not otherwise be a reason for an additional period of performance, or entitlement of compensation. In the event the Contractor's personnel work during the holiday, they may be reimbursed by the Contractor, however, no form of holiday or other premium compensation will be reimbursed either as a direct or indirect cost, other than their normal compensation for the time worked.

A. Invoices and Payment

1. Payment to be made monthly, in arrears, following satisfactory performance by Contractor’s personnel and upon receipt of a properly prepared invoice.

1. Invoices submitted without correct purchase order/obligation document number and contract/purchase order number will not be processed.

1. Contractor shall be required to invoice through the Tungsten System at http://www.tungsten-network.com/us/en/veterans-affairs/. Additional information regarding Tungsten shall be provided upon award.

1. The contract shall have current registration in the System for Award Management (SAM) for this solicitation; URL: www.sam.gov.

1. The invoice MUST be itemized to include the following information. Any information listed below, and not provided on an invoice, will render that invoice incomplete and the invoice will be returned for immediate correction.

i. Time period being invoiced for.

ii. Description of services performed.

iii. Unit Cost billed.

iv. Extended amount due.

v. Invoice number, date, and;

vi. Contract and obligation numbers.

GENERAL INFORMATION

1. The Contractor shall notify the Contracting Officer’s Representative (COR) Moses Briscoe 254- 297-3762 prior to start of work. The Contractor shall schedule work through the COR, to ensure that all necessary parts, materials, tools are accounted for prior to the start of work. The Contractor shall coordinate work with COR NLT 7 days before starting work.

2. The scope work shall be completed within 60 days from the time the contract was awarded to the contractor.

3. Contractor shall provide all services including supervision, labor, travel, mileage, overtime and required parts/materials.

4. Contractors must have at a minimum R stamp to conduct tie-ins, and fabrication work present at location where work is performed.

5. The contractor shall be responsible for the verification of all requirements for this project. All measurements and conditions must be verified by the contractor. Any discrepancies between field conditions, project documents, and this SOW shall be immediately brought to the Contracting Officer’s attention.

6. The contractor will be required to submit a safety plan for VA review and approval prior to the performing work.

7. The contractor must comply with the requirements for Type C/Class II (Lowest Risk) Infection Control Risk Assessment (ICRA).

8. It is the contractor’s responsibility to provide adequate documentation verifying that any equipment and/or materials proposed will meet or exceed all federal government requirements. Majority of the work shall be performed during VA Normal Hours of Operations unless other wised noted by the COR. Normal working hours are 8:00 am – 4:30 pm, Monday – Friday.

a. Note: After Hours: Times vary and must be scheduled with Contracting Officer Representative (COR); generally, after 6:00 p.m. and before 6:00 a.m.

9. The contractor will be required to submit a phasing plan prior to performing work. The phasing plan shall be developed and coordinated with VA COR. The contractor’s supervisor shall always be available to address any needs the VA COR may have during the period of performance.

10. The contractor may be required to coordinate work activities and shutdowns with VA COR and M&O Supervisors.

11. The contractor shall thoroughly clean inside and outside of project site daily with contractor’s own equipment, including vacuums, mops, buckets, wash rags, dust mops, etc.

12. The contractor shall be responsible for the removal of project demo materials/debris /equipment from this facility when complete.

Codes and Standards The project shall be in accordance with the latest Uniform Building Code (UBC), National Fire Protection Associate (NFPA) standard, Uniform Federal Accessibility Standard (UFAS), American Welding Society (AWS), American Standards of Mechanical Engineers (ASME), VA Specifications and Standards, and local facility requirements. In the event there is a conflict between any of the standards/codes, the more stringent standard/code shall apply.

The contractor shall provide all applicable safety signage and barricades applicable to OSHA, VHA and DOD regulations. Contractor shall comply with VHA DIRECTIVE 2004-012 and all VA Center Policy Memorandums, including but not limited to the following:

(a) Protection of patients, visitors, and employees from traumatic injury, as well as occupational and facility–associated infections.

(b) Compliance with OSHA and State construction safety regulations. Construction contracts require that the general contractor’s on-site “competent person” have completed the OSHA 30-hour construction worker course and that all other general and sub-contractor’s workers have completed the OSHA 10-hour construction worker course or other relevant competency training. The determination for training is based on the project hazards and complexity, State and Federal regulations and VA requirements. Verification of completion of training will be required prior to performing work.

(c) Compliance with EPA and State environmental regulations.

SAFETY PLAN REQUIREMENTS

Prior to performing any work, the contractor will be required to submit a safety plan in accordance with OSHA and VA Regulations.

The safety plan shall include, but not limited to the following:

A. Safety and Health Policy (i.e. company policy) B. Safety and Health Objectives (i.e. company goals, procedures, etc.)

C. Job Site Inspections (i.e. safety inspection/potential hazards/prevention, etc.)

D. Contractor Safety Administrator (i.e. competent person/safety officer) E. Personal Protective Equipment (i.e. head, hearing, and eye protection, footwear, clothing, gloves, etc.)

F. Safety Rules (i.e. rules applicable to the work/task being performed, equipment, ladders, confined spaces, open flame, etc.)

G. Job Safety Training (i.e. OSHA, safety meetings, etc.)

· 30 Hour OSHA Construction Safety Course – competent person

· 10 Hour OSHA Construction Safety Course – all others H. Safety Discipline (i.e. correction of violations, etc.)

I. Hot Work Permit (i.e. responsibilities, procedures, etc.)

J. Emergency Procedures (i.e. responsibilities, procedures, etc.)

K. Written Hazard Communication Program (i.e. responsibilities, procedures, list of hazards, MSDS, etc.)

SAFETY INSPECTIONS

On a weekly basis, the VA will conduct a safety inspection of the work area. This inspection includes, but is not limited to the following:

A. Means of Egress

· Fire/Smoke Doors unlocked, free of obstructions

· Means of Egress (includes Exits) free of obstructions and clearly marked

B. Fire Alarm, Fire Detection, and Fire Suppression Systems.

· Fire Alarm Pull Stations are unobstructed

· Smoke Detector smoke caps in use, or removed at end of the day

· Hot Work Permits are current, in use

· Sprinkler Heads are unobstructed

C. Housekeeping and Traffic Control

· Trash and debris are removed promptly and transported outside the construction area

· Floor mats and dust tack mats are located at the entrance to construction area

· Tools and equipment are properly stored

· Signs installed to restrict patient access (doors locked as needed)

· Dust control measures are in place

· Barriers are in place and properly sealed

D. Hazardous Chemicals/Conditions

· Appropriate storage of hazardous chemicals

· MSDS sheets are readily available on-site

· Lock out/tag out procedures are in place

· Hot work permit is current and posted

E. Clothing

· PPE is available and properly worn

· Clothing is relatively dust free with the construction area and patient areas

2.3 52.222-5 CONSTRUCTION WAGE RATE REQUIREMENTS—SECONDARY SITE OF THE WORK (MAY 2014) (a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.

(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.

(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.

(2) The due date for receipt of offers will not be extended as a result of an offeror's request for a wage determination for a secondary site of the work.

2.4 52.225-10 NOTICE OF BUY AMERICAN REQUIREMENT—CONSTRUCTION MATERIALS (MAY 2014)

(a) Definitions. "Commercially available off-the-shelf (COTS) item," "construction material," "domestic construction material," and "foreign construction material," as used in this provision, are defined in the clause of this solicitation entitled "Buy American—Construction Materials" (Federal Acquisition Regulation (FAR) clause 52.225-9).

(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.

(c) Evaluation of offers.

(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.

(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.

(d) Alternate offers.

(1) When an offer includes foreign solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.

(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.

(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—

(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or

(ii) May be accepted if revised during negotiations.

3.2 52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019) The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services—Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items.

(a) Definitions. As used in this provision— Covered telecommunications equipment or services, critical technology, and substantial or essential component have the meanings provided in clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115–232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. 4.2 52.222-36 EQUAL OPPORTUNITY FOR WORKERS WITH DISABILITIES (JUL 2014)

(a) Equal opportunity clause. The Contractor shall abide by the requirements of the equal opportunity clause at 41 CFR 60-741.5(a), as of March 24, 2014. This clause prohibits discrimination against qualified individuals on the basis of disability, and requires affirmative action by the Contractor to employ and advance in employment qualified individuals with disabilities.

(b) Subcontracts. The Contractor shall include the terms of this clause in every subcontract or purchase order in excess of $15,000 unless exempted by rules, regulations, or orders of the Secretary, so that such provisions will be binding upon each subcontractor or vendor. 4.3 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) ALTERNATE I (APR 1984) The Contractor shall be required to (a) commence work under this contract within 7 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 60 days after receipt of award. The time stated for completion shall include final cleanup of the premises.

The completion date is based on the assumption that the successful offeror will receive the notice to proceed by . The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

(c) The submission of the payment protection is required within days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.
