Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C256-19-AP-3108

1. Contracting Activity: Department of Veterans Affairs, Network Contracting Officer 16, Houston, Texas Medical Center.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The MEDVAMC is requesting one (1) Navigation System stealth station for the neurosurgery operation room. The neurosurgery operations room personnel provides a wide variety of rhinology services of varying complexity, including anterior skull base surgery for benign and malignant tumors.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used: The Veterans Affairs Medical Center in Houston TX is currently using Medtronic probes, Medtronic suctions, and Medtronic head tracker kits in the neurosurgery operations room. A Medtronic Navigation Stealth system is required for compatibility with existing Medtronic instruments. Brand name Medtronic is the only Navigation Stealth System that can work with existing instrumentation. Other brands cannot be modified to work with existing instrumentation. Therefore, only the brand name Medtronic Navigation System is acceptable to ensure compatibility with existing neurosurgery instrumentation, mitigate equipment operation risk, and ensure patient safety during surgical operations.

4. Description of market research conducted and results or statement why it was not conducted:

On June 20, 2019, a Sources Sought notice was issued on FBO with responses requested by June 28, 2019 and the posting remained available through August 20, 2019 prior to archiving. The intent of the notice was to 1) Determine the availability of sources who could provide the exact brand name for Medtronic and 2) Determine the availability of sources who could provide items determined to be equivalent to Medtronic. The posting was an intent to establish sources and it was stated in the notice that responses would be used to determine the future formal procurement strategy.

Only HCSS and Medtronic as the original manufacturer can satisfied the requirement. Therefore this requirement will be solicited sole source to VHSS pursuant to FAR 13.106-1 (b): Soliciting from a single source and IAW 813.106 (a) pursuant to 38 U.S.C. 8127 (b): use of Noncompetitive Procedures for certain Small Business contract in the total amount of $188,360.00.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b) (1). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
