Nature and/or Description of the Action Being Processed: The purpose of this J&A is to award a firm-fixed priced contract for three (3) General Elect ic (GE) Vivid E95 Cardiovascular 4D Ultrasound Systems and accessories for the Kansas City VA Medical Center.

Description of Supplies/Services Required to Meet the Agency’s Needs: The Kansas City VA Medical Center Cardiology Department requires additional cardiac ultrasound machines to accommodate the current and increasing demand for echocardiograms. The increased volume and lack of additional equipment is prolonging patient care. The estimated amount is

4. Statutory Authority Permitting Other than Full and Open Competition:

Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements per 41 USC §3304(a)(1) as implemented by FAR 6.302-1.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the

Acquisition Requires the Use of the Authority Cited Above (applicability of authority):

The Kansas City VA Medical Center requires additional cardiac ultrasound systems that are compatible with their existing systems in order to accommodate the increasing demand for echocardiograms. An echocardiogram is a test that utilizes ultrasound to produce images of the heart, which can be used for the diagnosis and treatment of cardiovascular related illnesses. The Kansas City VA Medical Center currently utilizes General Electric (GE) Healthcare’s Vivid E95 ultrasound system and software to perform echocardiograms. The Medical Center’s Biomed Department is trained to troubleshoot and repair GE’s equipment.

Clinical staff are also currently trained to operate GE’s imaging platform. The GE Vivid E95 consists of highly specialized equipment and software, which is proprietary to GE. Only GE equipment and software is compatible with the Kansas City VA Medical Center’s existing GE Vivid E95 Cardiac Ultrasound System. No other equipment or software brand is compatible. Introducing an alternative cardiac ultra sound system would require a duplication of cost and time for training Biomed and clinical staff.

Accordingly, GE Healthcare is the only firm capable of providing the supplies described in Section III above without the Kansas City VA Medical Center experiencing substantial

Effective Date: 04/01/23 duplication of cost that could not be expected to be recovered through competition and unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

The VA Supply Chain Master Catalog (SCMC) and Strategic Acquisition Center (SAC) contract list was queried for GE Vivid E95 mandatory contracts. No results were found.

The National Acquisition Center (NAC) Contract Catalog Search Tool (CCST) was queried for the GE Vivid E95, and no results were found.

The GSA eLibrary and GSA Advantage were queried for the GE Vivid E95, and no results were found.

The NASA Solutions for Enterprise-Wide Procurement (SEWP) was queried for the GE Vivid E95, and no results were found.

The NIH Information Technology Acquisition and Assessment Center (NITAAC) was queried for the GE Vivid E95, and no results were found.

A Sources Sought was sent to GE Healthcare seeking information on any Service-Disabled Veteran-Owned Small Business (SDVOSB) Authorized Distributors. GE Healthcare informed the contracting office of only one (1) SDVOSB (i.e. TrillaMed, LLC) authorized to provide the required supplies.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Price fair and reasonableness will be determined by comparing the vendor’s offer to both the Independent Government Cost Estimate (IGCE) and historical pricing listed in Federal Procurement Data System (FPDS).

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: See Section 6 above for details.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Based on market research, there is only one (1) SDVOSB that is capable of providing the requirement. Therefore, in accordance with FAR 6.302-5 and VAAR 806.302-570, TrillaMed will be awarded a sole source contract if prices are determined to be fair and reasonable and in the best interest of the Government.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: NCO 15 will continue to conduct market research before each award to ascertain if there are any changes in the marketplace that would enable competition for future actions.
