B.2 PERFORMANCE WORK STATEMENT

NURSE CALL / CODE BLUE UPGRADE

AT

ROBERT J. DOLE VAMC

1. DESCRIPTION OF SERVICES: The Contractor shall provide all personnel, labor, equipment, materials, supervision, tools, test equipment, transportation, and any other items necessary to install the Nurse Call and Code Blue software upgrade at the Robert J. Dole Veterans Affairs Medical Center (VAMC) as defined within this Performance Work Statement (PWS). The Contractor shall comply with all local, county, state, federal, VA, Joint Commission, OSHA, NEC, NFPA, and Life Safety Code standards as described in the PWS & the contract's terms & conditions. The Contractor is expected to use innovative solutions to effectively accomplish PWS requirements in a timely manner at reduced costs & in a way that fosters pride & ownership in the services provided.

2. TECHNICAL REQUIREMENTS:

All services shall be performed in accordance with standard industry practices and quality control measures.

Contractor shall provide upgrade to existing Nurse call system GE software to Unite software. All equipment and Software and licenses required is to be furnished by contractor to provide a fully functional system capable of Vocera integration.

All Contractor personnel shall report to the COR to sign in before any work is performed on the premises of the Robert J. Dole VAMC, and to sign out after completion of assignment. The Contractor shall furnish a detailed field service report, or equivalent showing the work completed.

2.1. Infection Control Instructions: Implement the requirements of VAMC’s Infection Control Risk Assessment (ICRA) team. ICRA Group may monitor dust in the vicinity of the project work and require the Contractor to take corrective action immediately if the safe levels are exceeded.

A. Establish and maintain a dust control program as part of the contractor’s infection preventive measures in accordance with the guidelines provided by ICRA Group as specified here. Prior to start of work, prepare a plan detailing project-specific dust protection measures, including periodic status reports, and submit to COR for review for compliance with contract requirements.

i. All personnel involved in the project activity shall be educated and trained in infection prevention measures established by the medical center.

B. Medical center Infection Control personnel shall monitor for airborne disease (e.g. aspergillosis) as appropriate during construction. A baseline of conditions may be established by the medical center prior to the start of work and periodically during the construction stage to determine impact of construction activities on indoor air quality. In addition:

i. The RE and VAMC Infection Control personnel shall review pressure differential monitoring documentation to verify that pressure differentials in the construction zone and in the patient-care rooms are appropriate for their settings. The requirement for negative air pressure in the construction zone shall depend on the location and type of activity. Upon notification, the contractor shall implement corrective measures to restore proper pressure differentials as needed.

ii. In case of any problem, the medical center, along with assistance from the contractor, shall conduct an environmental assessment to find and eliminate the source.

C. In general, following preventive measures shall be adopted during project to keep down dust and prevent mold.

i. Dampen debris to keep down dust and provide temporary partitions in existing structures where directed by COR.

ii. Do not perform dust producing tasks within occupied areas without the approval of the COR. For project in any areas that will remain jointly occupied by the medical Center and Contractor’s workers, the Contractor shall:

a. HEPA filtration is required where the exhaust dust may reenter the breathing zone. Contractor shall verify that construction exhaust to exterior is not reintroduced to the medical center through intake vents or building openings. Install HEPA (High Efficiency Particulate Accumulator) filter vacuum system rated at 95% capture of 0.3 microns including pollen, mold spores and dust particles. Insure continuous negative air pressures occurring within the work area. HEPA filters should have ASHRAE 85 or other pre-filter to extend the useful life of the HEPA. Provide both primary and secondary filtrations units. Exhaust hoses shall be heavy duty, flexible steel reinforced and exhausted so that dust is not reintroduced to the medical center.

b. Adhesive Walk-off/Carpet Walk-off Mats, minimum 600mm x 900mm (24” x 36”), shall be used at all interior transitions from the construction area to occupy medical center area. These mats shall be changed as often as required to maintain clean work areas directly outside construction area at all times.

c. Vacuum and wet mop all transition areas from construction to the occupied medical center at the end of each workday. Vacuum shall utilize HEPA filtration. Maintain surrounding area frequently. Remove debris as they are created. Transport these outside the construction area in containers with tightly fitting lids.

d. The contractor shall not haul debris through patient-care areas without prior approval of the COR and the Medical Center. When, approved, debris shall be hauled in enclosed dust proof containers or wrapped in plastic and sealed with duct tape. No sharp objects should be allowed to cut through the plastic. Wipe down the exterior of the containers with a damp rag to remove dust. All equipment, tools, material, etc. transported through occupied areas shall be made free from dust and moisture by vacuuming and wipe down.

e. Using a HEPA vacuum, clean inside the barrier and vacuum ceiling tile prior to replacement. Any ceiling access panels opened for investigation beyond sealed areas shall be sealed immediately when unattended.

f. There shall be no standing water during construction. This includes water in equipment drip pans and open containers within the project areas. All accidental spills must be cleaned up and dried within 12 hours. Remove and dispose of porous materials that remain damp for more than 72 hours.

D. Final Cleanup:

i. Upon completion of project, or as work progresses, remove all construction debris from above ceiling, vertical shafts and utility chases that have been part of the construction.

ii. Perform HEPA vacuum cleaning of all surfaces in the construction area. This includes walls, ceilings, cabinets, furniture (built-in or free standing), partitions, flooring, etc.

2.2. The Contractor will perform a survey of the existing facilities and perform an actual assessment of the existing areas. The walk thru will include obtaining any required information.

2.3. The contractor shall fully comply with all infection control requirements. At a minimum the contractor shall do the following actions:

A. Use mobile containment unit for dust control if possible B. Replace ceiling tile(s) as soon as possible. A maximum of 2 ceiling tile out at any time.

C. Cover or remove patient care equipment from construction area.

D. Give way to essential patient traffic and interrupt dust producing activities to allow patients to pass.

E. Seal holes, pipes conduits and punctures appropriately.

F. Use a HEPA vacuum and/or damp disinfectant mop for cleanup of dust. Contact EMS when complete.

G. Cover general waste before transport

2.4. The contractor shall restore all the affected areas by work to their original state.

2.5. All the utility work shall be performed by certified technician or workers.

A. A sufficient number of signs indicating wet surface and warning hazard signs shall be provided by and utilized by the Contractor employees to alert others of the dangers, prevent injury to other persons and avert damage to their property.

2.6. All tools, materials and equipment such as scaffolds, ladders, scrapers, blades, rags, cleaning chemicals and compounds will be strictly controlled by the contractor for proper disposal and to prevent access to unauthorized personnel. This includes guarding the equipment to prevent patients' access and possible injury while Contractor employees are using the equipment. All equipment must be secure when not in use.

3. GENERAL:

The Contractor shall not perform any services that will result in additional charges without prior approval from a warranted Contracting Officer acting within the means of their warrant.

3.1. Contract Management: The Contractor shall identify in writing to the CO, a primary and alternate Contract Manager who has the authority to act on all contractual matters relating to daily operations.

3.2. Contractor Personnel: All Contractor personnel must be able to read, write, speak and understand English fluently. Contractor personnel shall present a neat appearance, appropriate to the type of work being accomplished and be easily identified as Contractor employees. The Contractor shall not employ persons for work on this contract who have been identified to the Contractor by the CO as a potential threat to the health, safety, security, general wellbeing or operational mission of the facility and its population.

3.3. Hours of Operation: All work shall be completed during regular business hours. The regular business hours for the Robert J. Dole VAMC are Monday through Friday from 0700 to 1630 hrs CST, excluding federal holidays which have been listed below.

3.4. Insurance: Before commencing work under this contract, the Contractor shall furnish to the CO, a certificate of insurance indicating the coverage outlined and containing an endorsement to the effect that cancellation, of or any material change in the policies which adversely affect the interests of the Government in such insurance shall not be effective unless a 30-day advance written notice of cancellation of change is furnished the CO.

3.5. Safeguarding Information: Contractor shall ensure the confidentiality and security of all patient information and shall be held liable in the event of breach of confidentiality.

3.6. Access to VA Information and VA Information Systems: All Contractors and subcontractors working with VA Sensitive Information are subject to the same investigative requirements as those of regular VA appointees or employees who have access to the same types of information. The level of background security investigation will be in accordance with VA Directive 0710, Handbook 0710, which are available at: http://www1.va.gov/vapubs/ and VHA Directive 0710 and implementing Handbook 0710.01 which are available at: http://www1.va.gov/vhapublications/index.cfm. Contractors are responsible for screening their employees.

The Contractor agrees to:

a. Comply with the Privacy Act of 1974 (the Act) and the agency rules and regulations issued under the Act in the design, development, or operation of any system of records on individuals to accomplish an agency function when the contract specifically identifies:

i. The systems of records; and

ii. The design, development, or operation work that the Contractor is to perform;

b. Include the Privacy Act notification contained in this contract in every solicitation and resulting subcontract and in every subcontract awarded without a solicitation, when the work statement in the proposed subcontract requires the redesign, development, or operation of a system of records on individuals that is subject to the Act; and,

c. Include this Privacy Act clause, including this subparagraph (3), in all subcontracts awarded under this contract which requires the design, development, or operation of such a system of records.

In the event of violations of the Act, a civil action may be brought against the agency involved when the violation concerns the design, development, or operation of a system of records on individuals to accomplish an agency function, and criminal penalties may be imposed upon the officers or employees of the agency when the violation concerns the operation of a system of records on individuals to accomplish an agency function. For purposes of the Act, when the contract is for the operation of a system of records on individuals to accomplish an agency function, the Contractor is considered to be an employee of the agency.

a. “Operation of a system of records” means performance of any of the activities associated with maintaining the system of records, including the collection, use, and dissemination of records.

b. “Record” means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, education, financial transactions, medical history, and criminal or employment history and contains the person’s name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a fingerprint or voiceprint, or a photograph.

c. “System of records on individuals” means a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual.

3.7. Quality Assurance: The Contractor shall establish and maintain a written quality assurance and control plan to assure that the requirements of Robert J. Dole VAMC are met. The Government may use various quality assurance methods to determine the Contractor’s compliance with the PWS and the contract requirements in accordance with FAR Clause 52.212-4, Contract Terms and Conditions - Commercial Items (a) Inspection/Acceptance. The Contractor’s performance shall be evaluated through periodic inspections. The Government may inspect each task as completed or increase the number of quality control inspections, if deemed appropriate, because of repeated failures discovered during quality control inspections. Likewise, the Government may decrease the number of quality control inspections if performance dictates.

3.8. Performance Evaluation Meeting: The Contract Manager may be required to meet with the COR and the CO during the performance period of this contract. Meetings shall be as often as necessary thereafter as determined by the CO. The written minutes of all performance evaluation meetings will be prepared by the COR and signed by the Contract Manager, CO, and COR. Should the Contractor non-concur with the minutes, the areas of non-concurrence shall be submitted in writing to the CO within 10 calendar days of receipt of the signed minutes. The minutes shall be included in the contract file.

3.9. Payment: Payment will be made quarterly, in arrears, and upon receipt of a properly prepared invoice which references the period for which payment is due, the contract number and/or assigned purchase order number.

3.10. Phasing: Phasing needs to be coordinated with the COR as various shut-downs may be required to complete the job. Work to be done according to phasing plan. The contractor will coordinate with owner before disconnecting any circuit or conducting any utilities modification or stoppage. Any shutdown shall be coordinated with COR and Engineering Service.

3.11. Other Requirements:

A. Scheduling: Work shall be completed within 1st shift normal business hours. Monday through Friday 7:30am to 4:30pm excluding federal holidays B. Interference with Hospital Functions: Contractor personnel are required to interrupt their work at any time so as not to interfere with hospital functions. This includes but not limited to, utility service, fire protection systems, and the passage of facility patients, personnel, equipment and carts.

C. Contractor Reporting: The Contractor Field Supervisor (CFS) will provide to the COR an official company letter with a list of all personnel that will work on the project. The letter should provide the first name, last name and last 4 numbers of the social security number. The POC will make arrangement with the hospital police security section for the issuance of VA hospital identification cards. All contractors’ employees must wear the identification at all time while performing his/her duties on the installation. The identification must be visible in the torso area. Upon completion of the project all identification must be returned to the POC who will return them to the Police Service section. Each card not returned or lost will generate a payment to the Government on the amount of $25.00. The POC will coordinate parking and off load of supply and equipment arrangements with the police section and the Contractor.

D. Status and Schedule of Work Reports: The contractor will do and submit on weekly basis daily logs to the COR and the CO.

E. Inspections: The daily work will be inspected by Contractor Field Supervisor (CFS) to be provided by contractor. This CFS will ensure that all the work is being performed according to the specifications and regulations involved in this contract. The COR and VA Engineering Service personnel may regularly inspect the work and accept if satisfactory.

F. Identification of Workers: Uniforms or work attire are to be cleaned and maintained in good condition and will be worn as designated by the manufacturer. In the absence of the CFS a temporary acting supervisor will be identified, and he/she will assume full responsibility for the work site until relieved from his/her responsibilities.

G. Documentation of Products to Be Used: The Contractor will be required to submit a material approval submittal of all supplies and material to be used in the project, as required in the submittal section of this scope. Any material safety data sheet, company specification, and brochure will be attached to the form. The form must be returned to the CFS approved prior of using the material or supplies. The CFS must comply with all comments, remarks and instructions attached to the form. A separate sequential logged must be maintained by the Contractor and COR to keep track of all submittals processed.

H. Patient Occupied Areas: Contractor personnel shall utilize painting materials with a low volatility and as odor free as possible in order to keep odor levels from affecting patients and staff in these areas. This is especially important when adjacent to critical areas. The currently designated critical areas are as follows: Pharmacy, Intensive Care Units, Research Facilities, Respiratory Care Areas, Operating Room, SPD, Dietetics Food Service Areas, and Canteen Service.

i. Damages: Any wall surface, glass, floor tile, window or other material broken or damaged by contractor personnel during the performance of this project shall be corrected/repaired to the previous existing condition or better at the contractor’s expense.

ii. Disposal of Waste: The Contractor will not dispose of any excess paint, paint containers, or any other materials container at any location on the Medical facility premises. All waste and rubbish materials are to be disposed of Medical Facility premises by the Contractor, and disposal shall be in accordance with Federal and local regulatory guidance and laws.

iii. Safety: While in the performance of the work, the Contractors personnel shall abide by the safety requirements of the Medical Center. The Contractor shall always exercise extreme care in making the work area safe . The number one priority is to protect patients and hospital staff from any possible injury resulting from the equipment or materials. The Contractor is responsible for security of equipment each day. There is no storage area available on site. The hallways nor corridors shall not be used to store, pile or place construction materials or supplies. In the event of a situation requiring use of the corridor for such purposes, approval of the VA Medical Center Safety Manager/Officer shall be obtained previously. No painting material or supplies shall be placed where patients may recover them. Any safety violation or emergency situation should be reported to a hospital official immediately. The Contractor shall conform to all Federal, State and local regulations governing painting chemicals and equipment, which may be in effect. All equipment used to perform the work will conform to OSHA regulations.

C.2 VAAR 852.203-70 COMMERCIAL ADVERTISING (MAY 2018)

The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

C.3 VAAR 852.215-71 EVALUATION FACTOR COMMITMENTS (OCT 2019)

(a) The offeror agrees, if awarded a contract, to use the service-disabled veteran-owned small businesses (SDVOSBs) or veteran-owned small businesses (VOSBs) proposed as subcontractors in accordance with 852.215–70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, or to substitute one or more SDVOSBs or VOSBs for subcontract work of the same or similar value.

(b) Pursuant to 38 U.S.C. 8127(g), any business concern that is determined by VA to have willfully and intentionally misrepresented a company’s SDVOSB/VOSB status is subject to debarment for a period of not less than five years. This includes the debarment of all principals in the business.

(End of Clause) C.4 VAAR 852.219-75 SUBCONTRACTING COMMITMENTS MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes the clause: 852.215-70 Service-disabled veteran-owned and veteran-owned small business evaluation factors. Accordingly, any contract resulting from this solicitation will include the clause 852.215-71 Evaluation factor commitments.

(b) The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) to assist in assessing Contractor compliance with the subcontracting commitments incorporated into the contract. To that end, the support contractor(s) may require access to the Contractor's business records or other proprietary data to review such business records regarding contract compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor compliance with the subcontracting commitments.

C.5 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
