B.2 STATEMENT OF REQUIREMENTS

VISN 15 USP Compliance Documentation System VISN 15 Pharmacy Services

*ALL ITEMS HEREIN THAT MENTION BRAND NAME PRODUCTS MAY BE SUBSTITUTED FOR A LIKE OR SIMILAR ITEM*

A. PURPOSE

a. The purpose is to provide access to a web-based software program for all facilities who do sterile compounding within VISN 15 Pharmacy Services. Users encompass those who perform duties and tasks related to compounding, and USP Chapter 797 and 800 quality assurance monitoring within VISN 15 facilities.

B. SCOPE OF WORK

a. The contractor shall provide access to a customizable web-based software program that will offer VISN 15 Pharmacy Services all they need to perform and document CSP primary and secondary engineering controls certifications, personnel competency training, risk management, and quality assurance (QA) practices necessary for a USP 797/800 compliant, safe, and efficient sterile compounding environment. All products must meet all salient characteristics, training, and system requirements, as defined in this section.

b. SALIENT CHARACTERISTICS/REQUIRED FEATURES

i. Access by All VISN 15 facilities/users, including pharmacists, pharmacy technicians, designated housekeeping and other staff involved in maintaining CSP program.

ii. Ability for VISN staff to access each facility’s documentation and run facility level and VISN level monitoring and trend reports

iii. Ability for facility staff to access their documentation and run facility level monitoring and trend reports

iv. Pre-built USP 797 and 800 required tasks, including, but not limited to, environmental documentation, sampling, and cleaning

v. Alert notifications for overdue tasks or out-of-range results/readings and ability to document corrective actions for these findings. Ability to transmit alerts via email to individual users and/or specified groups.

vi. Pre-built observational competency assessments (i.e. donning, doffing, aseptic technique, etc.) and USP 797 and 800 Pharmacy competency exams, with the ability to custom build and add additional assessments and exams.

vii. Pre-built CSP Standard Operating Procedures and Policy templates customizable by the client

viii. System provides online, comprehensive, multimedia compounding training resources and assessment resources and offers continuing education credits for staff who complete the training.

ix. Includes pre-built hazardous drug risk assessments, customizable by the customer

x. Includes pre-built compounding logs, customizable by the client

xi. Ability to create form to document ward inspection, including CSP medication storage areas within the pharmacy as required by

xii. Management of personnel certification status and re-certifications and alerts to compounding employees and supervisors when certifications are coming due or are overdue

xiii. Facility dashboard providing an overview of all activities in a given time frame

xiv. Canned and customizable reporting capabilities for all aspects of the compounding program

xv. All data and reports are exportable in a variety of formats, including XLS/XLSX, PDF, and DOC/DOCX.

xvi. Ability to attach files to documentation forms in the system, allowing for review by other system users, and a document repository to upload and organize training materials, SOPs, primary and secondary engineering controls certification reports, environmental and surface sampling results, gloved fingertip testing and media fill testing results, and various other materials for user access

xvii. Ability to save the IV room configuration/setup pictures for each facility

xviii. Ability to store smoke study or other video documentation done as part of the certification process

xix. System is regularly maintained and up-to-date with all USP standards; provides continual support in all pre-built tasks, risk assessments, training, etc. even when revisions to USP standards are published

xx. Vendor must demonstrate successful system implementation with a similar size health system and provide three references of existing customers.

c. TRAINING

i. The contractor shall provide full service setup and ongoing support, including guidance on how to properly setup the accounts for VISN 15 Pharmacy Services. This guidance will include either group or one-on-one web sessions so the end-user knows how to properly access, document, build, and customize features within the software program. An online tutorial will also be embedded in the software for ease of access by the user.

ii. The contractor will be responsible for coordinating training with pharmacy and other designated staff involved in maintaining CSP program and management in order to ensure a successful implementation by including extensive product training and ongoing support. Multiple online trainings to allow all end users at the VISN 15 facilities to receive training will be provided by the contractor. Sufficient evening and weekend trainings will be offered to allow all staff to obtain the necessary training.

iii. The contractor will provide training and support for Pharmacy staff on risk management and quality assurance practices necessary to establish and maintain a safe and efficient IV compounding environment.

d. SYSTEM REQUIREMENTS

i. The program shall allow pharmacy staff to keep real-time QA data on environmental testing programs revolving around USP Chapter 797/800 rules and regulations related to clean room maintenance.

ii. The program shall provide reporting capability to identify and mitigate ongoing risks that may occur within our customized QA programs and respond quickly to day-to-day deviations from our programs with real-time alerts on facility and system-level compliance risks.

iii. The program shall provide easy access to reports on compliance trends and issues for hassle-free inspections by auditing agencies, in addition to a unit inspection product for managing JCAHO required ward inspections as required for all pharmacy medication storage areas per VHA Directive 1108.06 ‘Inpatient Pharmacy Services’. Reports on environmental testing compliance shall be readily retrievable for management oversight purposes. VISN-wide ad-hoc report generation shall be available. All reporting will need to include timely data that includes trending and analysis reporting by person, site, location, activity, and compounding area.

iv. The program must be an online application that does not require any hardware investment or IT resources to maintain software functionality. Implementation of the software application must be straightforward and user friendly.

v. The program shall require passwords to be at least eight characters long and include alphabetic letters, numeric characters, and at least one punctuation mark or symbol.

vi. Any installation services will be scheduled with a contact person as assigned by the Contracting Officer’s Representative (COR), Point of Contact (POC), or designee for performance on site.

vii. Contractor will assign an account representative to receive trouble reports and coordinate timely resolution, same day if possible.

C. SPECIFIC MANDATORY TASKS AND ASSOCIATED DELIVERABLES

E. GENERAL REQUIREMENTS

a. The contractor shall furnish all necessary materials, supplies, equipment, personnel, and supervision to provide site license services via web-based software applications.

b. Contract Type: firm-fixed-price

F. SECURITY REQUIREMENTS

a. GENERAL

i. Contractors, contractor personnel, subcontractors, and subcontractor personnel shall be subject the same federal laws, regulations, standards, and VA directives and handbooks as VA and VA personnel, regarding information and information system security

ii. The COTR and the Contractor will assure that:

1. No other information except what is in this contract will be shared with the contractor in any follow-up communication

2. None of the information in this contract includes entry or documentation of Protected Health Information (PHI) or Individually Identifiable Information (III) into the USP 797/800 documentation system.

3. Contract performance does not require access to VA systems.

C.2 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years.

C.3 VAAR 852.203-70 COMMERCIAL ADVERTISING (MAY 2018)

The Contractor shall not make reference in its commercial advertising to Department of Veterans Affairs contracts in a manner that states or implies the Department of Veterans Affairs approves or endorses the Contractor’s products or services or considers the Contractor’s products or services superior to other products or services.

C.4 VAAR 852.215-71 EVALUATION FACTOR COMMITMENTS (DEC 2009)

The offeror agrees, if awarded a contract, to use the service-disabled veteran-owned small businesses or veteran-owned small businesses proposed as subcontractors in accordance with 852.215-70, Service-Disabled Veteran-Owned and Veteran-Owned Small Business Evaluation Factors, or to substitute one or more service-disabled veteran-owned small businesses or veteran-owned small businesses for subcontract work of the same or similar value.

(End of Clause) C.5 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—MONITORING AND COMPLIANCE (JUL 2018)

(a) This solicitation includes FAR 52.219-14 Limitations on Subcontracting.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor's business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

(a) This solicitation includes the clause: 852.215-70 Service-disabled veteran-owned and veteran-owned small business evaluation factors. Accordingly, any contract resulting from this solicitation will include the clause 852.215-71 Evaluation factor commitments.

C.7 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

SECTION E - SOLICITATION PROVISIONS

E.1 GRAY MARKET LANGUAGE (MAY 2016)

The Vendor shall be an Original Equipment Manufacturer (OEM) authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system such that the OEM warranty and service are provided and maintained by the OEM. All warranty and service associated with the equipment/system shall be in accordance with the OEM terms and conditions. The vendor shall provide new items ONLY; no remanufactured or "gray market" items. All items must be covered by the manufacturer's warranty.
