INVOICES:

Payments shall be made in arrears upon receipt of a properly prepared invoice.

In order to comply with the Improper Payment Elimination and Recovery Act of 2010 (IPERA), the VA has mandated electronic invoice submission to the Veterans Affairs Financial Services Center (VAFSC). VAFSC has partnered with Tungsten Network e-Invoicing network, for submissions of all electronic invoices to VA. Tungsten Network electronic invoicing is free to all VA vendors. In order to submit electronic invoices, all VA vendors must register with Tungsten Network by submitting an email to VA.Registration@ob10.com or calling 1-877-752-0900 option 2 for Enrollment.

Contractor shall submit an electronic invoice by the tenth (10th) of the following month services were performed to the Veterans Affairs Financial Services Center (VAFSC) e-Invoice through the website at https://portal.ob10.com/Login.aspx. For questions regarding the submission of VA electronic invoices, Tungsten Network customer service may be contacted at 1-877-489-6135.

All invoices shall reference the vendor name and address, customer name, contract number, appropriate obligation/funding order number, description of services provided, quantity, unit price, and total invoice amount (any additional info). Invoices shall also include any payment discount terms.

SPECIAL NOTES

In order to maintain integrity of this solicitation and subsequent award date, all offerors are advised that any question and answer requests must be submitted in a written form via e-mail to the Contracting Officer susan.pasholk@va.gov no later than MONDAY NOVEMBER 25, 2019 AT NOON CENTRAL. Contracting will issue a consolidated response via solicitation amendment to www.fbo.gov within 2 business days to all parties.

The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof.

SECURITY & PRIVACY CONTROL:

The Certification & Accreditation (C&A) requirements of VHA Handbook 6500.6 do not apply to this requirement, therefore, a Security Accreditation Package is not required. No C&A or MOU/ISA is required. Sensitive information exposure as part of this contract involves applicable security controls within the facility as part of the VA Information Security If there are any questions related to privacy, please have a member of your staff contact the VA Privacy Service at (202) 461-6309. AUTHORITY

This Request for Quote (RFQ) solicitation is issued under the authority of FAR Part 13.5 for Certain Commercial Items in which simplified acquisition procedures in FAR Part 13 will be used. FAR Part 14 and 15 will not be used.

The Lowest Price Technically Acceptable source selection process will be used for this FAR 13.5 procurement. This means award will be made on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for non-cost factors. See 52.212-2 Evaluation – Commercial Items (Section E) for a description of the factors in addition to price that the Government will use to evaluate offers. Prospective contractors must furnish the information listed herein with their quotations to ensure they receive full consideration.

SITE VISIT

It is strongly suggested and expected that the offeror inspect the campus to be serviced to fully understand the nature of the work and the conditions under which the work is to be performed. In no case shall failure to inspect the campus constitute grounds for a claim after contract award. TO SCHEDULE A SITE VISIT, CONTACT COR ADAM KREGER AT 414-384-2000 X44773. ELEVATOR CAR DOOR CLUTCH AND RESTRICTOR ASSEMBLIES REPLACE AND INSTALLATION ON 13 ELEVATOR DOORS IN BLDG 111

STATEMENT OF WORK

The Contractor shall provide all labor, material, travel, parking fees, management, tools and equipment necessary for the installation new door clutch assemblies in Otis 411 Elevators located in Building 111 (Elevator Banks A, B and C) at the Milwaukee VAMC as outlined herein the Statement of Work.

1. DESCRIPTION OF SERVICES

Contractor shall:

1. Remove and demo current clutch assembly from each elevator car door on all thirteen (13) elevators in Bldg. 111

1. Install and test new door clutch assemblies

1. Inspect all associated equipment and door function

2. SPECIAL REQUIREMENTS

1. All work shall be performed off hours either after 6:00 pm weekdays, or on weekends and shall be scheduled in advance with COR upon award of this contract

1. Contractor shall only have two cars in any elevator bank out of service at any given time while performing this service

1. Elevator shall be put back into full service prior to starting work on additional cars

1. Replacement parts shall be approved by COR before installation

3. WARRANTY

Parts replaced as part of this service shall be under warranty for one year from acceptance and completion of clutch and restrictor assembly installation work completed under this contract.

4. SECURITY REQUIREMENTS

A. All contractors working at Milwaukee VAMC shall be fingerprinted prior to being allowed to work on campus. Contractor ID badges can be obtained from PIV office typically 3-5 days after approved SAC form is received and finger prints clear. ID badges are required for contractor employees working at VAMC Milwaukee. Contractors who been finger printed at other VAs and have contractor badges from other VAs can have their information transferred, thus reducing the time to get a Milwaukee VA badge. Individual’s names and the name of the VA where the finger printing occurred at should be forwarded to the VA COR after award to expedite the badging process.

B. Contractor

1. Furnish SAC form to each employee and subcontractor employee, regardless of how long they will be on site, and have them fill out the form. Blank SAC form is included as appendix to this specification.

2. When form is legibly completed by hand, scan each form with file name as above then dash then employee name (e.g., 08 SAC FORM – John Doe).

3. Email form to VA COR (a.k.a., COR)

C. VA and Requestor

1. VA COR signs form, then emails Fingerprinting Office (fingerprinting) and PIV Office (badging) of pending visit from person named, forwarding form as email attachment.

2. Contractor/Requestor visits Fingerprinting/PIV Office, building 70, E-wing south, ground floor.

3. VA Fingerprinting Office will check to ensure proper form was received.

D. VA Processing

1. Fingerprinting begins background check process. Fingerprinting must be done within 4 weeks after contract award. Contractor may be escorted by a VA employee while this process is being completed.

2. Assuming background check allows, then within 3 to 10 business days, VA should send to Contractor/Requestor notice that they may now obtain their Physical Access Control (PAC) badge.

3. VA PIV Office staff take photo and issue PAC badge.

E. Badge Usage

1. Wear badge, readily visible, above waist level, not on head or hard hat, when on grounds doing work.

2. Lanyards and clips are not included, but may be purchased at Canteen Store.

3. Superintendent shall inspect personnel badge (should be visible).

4. Badges allow keyless entry into restricted areas. Names, dates, and times of access are recorded by VA Police.

5. Badges will be valid for 90 days. The PM will notify PIV office to extend badge access for another 90 days if appropriate.

6. Badge wearer, not anyone else, must get badge issues taken care of. For example, it is not allowed to hand over badge to superintendent to walk them down to FM or PIV for entering code on back of badge, into SAM box system. Violations may result in suspension or revocation of construction access.

5. IDENTIFICATION PARKING SMOKING AND VA REGULATIONS

A. No contractor or sub-contractor employee shall be permitted to perform work or access non-public areas unescorted without an ID card obtained from the VA Police. Contractor's and any Subcontractor's employees will be required to provide 2 forms of ID and be accompanied by the COR to obtain ID.

B. It is the responsibility of the Contractor to park in the appropriate designated parking areas. Information on parking is available from the VA Police Section. The VAMC will not invalidate or make reimbursement for parking violations of the Contractor under any conditions.

C. Effective January 1, 2019, smoking is prohibited both inside and outside (entire campus) at the VAMC.

D. Possession of weapons is prohibited. Enclosed containers, including tool kits, shall be subject to search. Violations of VA regulations may result in citation answerable in the United States (Federal) District Court, not a local district, state, or municipal court.

6. COMPLIANCE WITH THE GENERAL SAFETY REGULATIONS

All Contractors and Subcontractors performing services for the Government are shall comply with all Occupational Safety and Health Administration (OSHA), State, County and Municipal Safety and Occupational Health Standards and any other applicable rules and regulations. Also, all Contractors and Subcontractors shall be held responsible for the safety of their employees and any unsafe acts or conditions that may cause injury or damage to any persons or property within and around the work site area under this contract.

All ladders, scaffolding, tools, equipment, personal protective equipment, etc. shall be OSHA approved for the work to be performed. Contractor shall use caution signs as required by OSHA Regulations. Caution signs shall be on-site on commencement of Contract.

The Contractor shall purchase and issue all chemicals in their original containers. Materials that require precautionary warnings shall have affixed to all containers such labels or markings as are prescribed by law, regulatory agencies or this Contract. Any violation of OSHA may be subject to default action.

Contractor shall furnish to the COR two (2) copies of Material Safety Data Sheets (MSDS), for all products proposed for use, a minimum of seven (7) days prior to beginning service, for approval. Contractor must update copies of the MSDS on an annual basis. In addition, each time a new chemical product is proposed to be introduced into the facility, a copy of that product's MSDS must be provided to the COR for approval, prior to the product being used at the facility.

7. PROTECTION OF GOVERNMENT PROPERTY

During work execution, the Contractor shall take special care to protect Government property including furniture, walls, baseboards, and other surfaces. Accidental splashes shall be removed immediately. Damage resulting from the Contractor operations shall be repaired by the Contractor, including painting, refinishing, or replacement, if necessary, at no additional cost to the Government. The Contractor shall be responsible to meet OSHA/Safety requirements in the performance of the work. This shall include, but not limited to, taking all the necessary precautions to protect the patients, visitors, and/or staff at each location. The Contractor shall be held responsible for any injuries and /or damage, which may be caused as a result of the Contractors failure to adhere to these requirements.

Extreme caution shall be exercised to prevent damage to the building and its contents. Any damage must be reported to the COR immediately for appropriate action. Any damage caused by the contractor will be repaired and/or replaced to the satisfaction of the VA at the Contractor’s expense.

8. FACILTY CHECK-IN/OUT REQUIREMENTS

The Contractor shall be required to report to Graphics Center, Bldg. 113 to log in. This check in is mandatory. When the service is complete, the FSE shall document services rendered on a legible ESR. The FSE shall be required to log out at Graphics Center and submit the ESR to the COR. ALL ESR’s shall be submitted for an “acceptance signature”.

9. DOCUMENTATION/REPORTS

Contractor shall provide documentation of work performed under this contract. The documentation shall include detailed descriptions of service performed. In addition, each service report shall, at a minimum, document the following:

A. Name of contractor and contract number, name of FSE who performed services.

B. Contractor service report number/log number.

C. Date, time (starting and ending), equipment downtime and hours on-site for service call.

D. VA purchase order number.

E. Description of problem reported by COR/user (if applicable).

F. Description of equipment to be serviced: inventory id number, manufacturer’s name, device name, model number, serial number, and any other manufacturer’s identification numbers.

Final REPORTS to be submitted in electronic format to the COR within 10 business days of the completion of service.

The Contractor shall immediately, but no later than 24 (twenty-four) consecutive hours after discovery, notify the CO and COR (in writing) of the existence or the development of any defects in, or repairs required, to the scheduled equipment which the Contractor considers he/she is not responsible for under the terms of the contract. The Contractor shall furnish the CO and COR with a written estimate of the cost to make necessary repairs.

10. COMPETENCY OF PERSONNEL SERVICING EQUIPMENT

A. Each respondent must have an established business, with an office and full-time staff. The staff includes a “fully qualified” FSE and “fully qualified” FSE who will serve as the back-up and be regular employees of the contractor.

B. “Fully Qualified” is defined for the purposes of this contract as having at least three (3) years of experience, within the last five (5) years performing this same service.

C. If subcontractor(s) are used, they must be approved by the CO; the Contractor shall submit any proposed change in subcontractor(s) to the CO for approval/disapproval.

11. DEFINITIONS/ACRONYMS

A. Acceptance Signature – VA employee who is authorized to sign-off on the ESR, which indicates that the service has been concluded or is still pending completion, or that the Emergency Repair has been accomplished or is still in a pending status.

B. CO – Contracting Officer C. COR – Contracting Officer’s Representative D. ESR – Employee/Vendor Service Report – A documentation of the services rendered for each incidence of work performance under the terms and conditions of the contract.

E. FSE – Field Service Employee - A person who is authorized by the Contractor to perform services on the VAMC premises.

C.3 52.219-6 NOTICE OF TOTAL SMALL BUSINESS SET-ASIDE (DEVIATION 2019-01)(NOV2011)

(a) Definition. “Small business concern,” as used in this clause, means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.

(b) Applicability. This clause applies only to-

(1) Contracts that have been totally set aside or reserved for small business concerns; and

(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).

(c) General.

(End of clause) C.4 52.237-2 PROTECTION OF GOVERNMENT BUILDINGS, EQUIPMENT, AND VEGETATION (APR 1984) The Contractor shall use reasonable care to avoid damaging existing buildings, equipment, and vegetation on the Government installation. If the Contractor’s failure to use reasonable care causes damage to any of this property, the Contractor shall replace or repair the damage at no expense to the Government as the Contracting Officer directs. If the Contractor fails or refuses to make such repair or replacement, the Contractor shall be liable for the cost, which may be deducted from the contract price.

The bidder or offeror agrees that if a contract is awarded to him/her, as a result of this solicitation, he/she will not advertise the award of the contract in his/her commercial advertising in such a manner as to state or imply that the Department of Veterans Affairs endorses a product, project or commercial line of endeavor.

C.6 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause-

(1) Contract financing payment has the meaning given in FAR 32.001.

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, e-mail, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the Contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the Contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A Contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI)

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances below, the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.7 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of WISCONSIN. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.

C.8 VAAR 852.246-71 REJECTED GOODS (OCT 2018)

(a) Supplies and equipment. Rejected goods will be held subject to Contractor’s order for not more than 15 days, after which the rejected merchandise will be returned to the Contractor’s address at the Contractor’s risk and expense. Expenses incident to the examination and testing of materials or supplies that have been rejected will be charged to the Contractor.

(b) Perishable supplies. The Contractor shall remove rejected perishable supplies within 48 hours after notice of rejection. Supplies determined to be unfit for human consumption will not be removed without permission of the local health authorities. Supplies not removed within the allowed time may be destroyed. The Department of Veterans Affairs will not be responsible for, nor pay for, products rejected. The Contractor will be liable for costs incident to examination of rejected products.

(d) Comptroller General Examination of Record. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

*VA has a maximum allowable incoming email size limitation including attachments of seven megabytes. Offerors submitting responses via email which exceed seven megabytes shall split their response into multiple email messages so as to not exceed the maximum allowable email size limitation. The VA is not responsible for late responses due to undelivered e-mails that exceed seven megabytes.

As part of their quote, offerors shall submit the following information:

(1) Price:

a. Complete SCHEDULE OF SUPPLIES/SERVICES AND PRICES/COSTS

b. Fill in SF 1449 blocks 17a, 30a, 30b, and 30c on Page 1.

c. Fill in 1(a) on Page 2.

d. Fill in Price/Cost Schedule.

(2) Technical Capability: (Will be used for evaluation under the Technical Capability factor in 52.212-2) A. Offeror shall provide a list of facilities where Offeror has performed these same services as outlined in the Statement of Work within the last 3 years.
