Justification and Approval (J&A)

For

Other Than Full and Open Competition

Acquisition Plan Action ID: 36C252-19-AP-2397

1. Contracting Activity: Department of Veterans Affairs, VISN 12, Great Lakes Acquisition Center, Southern Tier Construction Team, 3001 Green Bay Road, Building 1, Room 329, North Chicago, Illinois 60064. This acquisition is for Project 537-18-136E DDC Systems Corrections OR AHU 5 on behalf of Jesse Brown VA Medical Center, 820 S. Damen Ave, Chicago, IL 60612, Purchase Request

537-19-3-6985-0192.

2. Nature and/or Description of the Action Being Processed: Jesse Brown VA Medical Center has a need to install a standard ASHRAE Standard 135, Native BACnet Server/IP Control System to complete DDC System Corrections to OR AHU 5.

The Government proposes to establish a contract with Blue Yonder, Inc.; DUNS 828816541, CVE-

VIP verified, Service Disabled Veteran Owned Small Business (SDVOSB) under NAICS 238210

Electrical Contractors and Other Wiring Installation Contractors as a sole-source procurement under the Statutory Authority granted to VA in 38 USC § 8127 (Public Law 109-461 or the Veterans

Benefits, Health Care and Information Technology Act of 2006).

The IGE is $162,744.00, below the SAT.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: AHU 5 has present numerous issues, such as failing to maintain adequate temperature to conduct surgeries and shutting off. Several projects have occurred to correct the issues, and one project, Project 537-18-136A AHU

5, is currently scheduled in order to complete the work to solve AHU 5’s issues. Project 537-18-136E

DDC Systems Corrections is to be completed prior to Project 537-18-136A AHU 5 to ensure that rework of the DDC system does not need to occur. If 537-18-136A occurs before 537-18-136E, there will be rework of the DDC system, which will impact the cost and schedule.

4. Statutory Authority Permitting Other than Full and Open Competition: In accordance with 38

USC § 8127: Authorized or Required by Statute FAR 6.302-5.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition

Requires the Use of the Authority Cited Above (applicability of authority): Statutory authority is prescribed under 38 U.S.C. § 8127 and 41 U.S.C. § 3304(a)(5). Governing regulations are FAR

6.302-5 and VAAR 819-7007 (per Class Deviation 07/25/2016).

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: No other vendors have been considered, as it is in the best interest of the

Government to award this project as a sole source award, and is authorized by statute.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable: The IGE is based off the recently completed project, Project 537-18-136D DDC

Systems Corrections. It was completed from January 2019 to March 2019.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: A search utilizing NAICS 238210 was conducted to

OFOC SOP Revision 08 Page 2 of 2 Original Date: 03/22/11 Revision 08 Date: 04/18/2018 determine if other qualified CVE SDVOSB contractors woud be able to meet the needs of this project. The VET Biz Registry website was queried using the parameters of NAICS 238210, SDVSOB set-aside, and strict geographic location of Illinois, Indiana, and Wisconsin. 50 SDVOSBs were returned. While there is a reasonable expectation that 2 or more SDVOSBs would submit, the necessity to complete both projects sequentially and prior to the temperature rising, it would be prudent and beneficial to solicit the requirement to Blue Yonder, Inc.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Blue Yonder was recently awarded Project 537-18-136A AHU 5 Follow On. Having Blue Yonder complete 537-

18-136E DDC Corrections will allow for better coordination between both projects as they need to be completed sequentially to ensure that the issues with AHU 5 are addressed. Having Blue Yonder already mobilized onsite allows for cost savings.

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

None.

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona

Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
