Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C252-19-AP-0090

1. Contracting Activity: U.S. Department of Veterans Affairs, VISN 12, Captain James A Lovell Federal

Health Care Facility, North Chicago, Illinois 60064 2237: 556-19-1-2993-0001

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

The Kreg E-Z Wider therapeutic mattress and bed has been strongly recommended by our Wound Care Department as the best viable solution for the treatment of extremely obese patients at a high risk of developing pressure ulcers. The estimated cost of the upgrade is $214,299.48.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The Kreg E-Z Wider Bariatric Chair Bed has an automatic “Sit to Stand” feature. This unique feature reduces patient fall hazards, and increases the rate of safety for both patients and staff.

4. Description of market research conducted and results or statement why it was not conducted:

On 11/05/2018, A Sources Sought notice was posted to FBO requesting that SDVOSB vendors who possessed the capability of providing bariatric beds respond. Listed in the Salient Characteristics was that the bed possess the “Automatic Sit to Stand” feature. Three (3) SDVOSB Firms responded.

On 12/07/2018 an RFQ solicitation was posted to FBO as a 100% SDVOSB Set-Aside. The solicitation clearly stated, that the product must include an automatic sit-to-stand feature. Two SDVOSB responded and submitted “Equal” products, neither of which featured “Automatic Sit to Stand”. Both submissions were rejected by the facility.

On 01/07/2019, another RFQ solicitation was posted to FBO, the requirements remained the same, but this solicitation open to ALL Small Business vendors. No responses were received.

The Contracting Officer has determined a Sole-Source Award to the Manufacturer is the only viable option. KREG Therapeutics, 1940 Janice Avenue, Melrose Park, Illinois 60160. Award is below the Simplified Acquisition Threshold.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
