5. INVOICES:

a. Payments shall be made annually, in arrears upon receipt of a properly prepared invoice.

b. In order to comply with the Improper Payment Elimination and Recovery Act of 2010 (IPERA), the VA has mandated electronic invoice submission to the Veterans Affairs Financial Services Center (VAFSC). VAFSC has partnered with Tungsten Network e-Invoicing network, for submissions of all electronic invoices to VA. Tungsten Network electronic invoicing is free to all VA vendors. In order to submit electronic invoices, all VA vendors must register with Tungsten Network by submitting an email to VA.Registration@Tungsten-Network.com or calling 1-877-752-0900 option 2 for Enrollment.

c. Contractor shall submit an electronic invoice by the tenth (10th) of the following month services were performed to the Veterans Affairs Financial Services Center (VAFSC) e-Invoice through the website at https://portal.Tungsten-Network.com/Login.aspx. For questions regarding the submission of VA electronic invoices, Tungsten Network customer service may be contacted at 1-877-489-6135.

d. All invoices shall reference the vendor name and address, customer name, contract number, appropriate obligation/funding order number, description of services provided, quantity, unit price, and total invoice amount (any additional info). Invoices shall also include any payment discount terms.

Technical Capability: Offeror must submit the following (will be used for evaluation under the Technical Capability factor in 52.212-2):

a. Provide proof that contractor has been providing the same service for a minimum of three (3) years, within the last two (2) years at a facility in comparable size to the Clement J. Zablocki VA Medical Center. Proof must be in the form of a list that includes name of facility/company, facility/company size, year work completed and point of contact.

b. Provide proof that technician supervising this service is at least a Journeyman Level.

c. Provide copies of NETA certifications or equivalent work experience (two years full time) in the testing and maintenance of electrical distribution systems for all technicians who will be providing service under this contract.

A signed, dated and scanned 1449 must be included along with all other information requested herein by the due date and time. Offers may also be submitted through the regular mail and must be received by the date and time specified in Block 8. CAUTION - LATE Submissions, Modifications, and Withdrawals: See provision 52.212-1. All offers are subject to all terms and conditions of this solicitation.

TYPE OF CONTRACT: Firm Fixed Price

ACQUISITION OF COMMERCIAL ITEMS:

This Request for Quote (RFQ) solicitation is issued under the authority of FAR Part 12 Acquisition of Commercial Items and FAR Part 13 Simplified Acquisition Procedures. FAR Part 15 will not be used. The procedures in Part 12 used in conjunction with Part 13 allow the Government to procure services resembling those in the commercial marketplace and streamline the procurement process.

The Lowest Price Technically Acceptable source selection process will be used for this FAR 13.5 procurement. This means award will be made on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for non-cost factors. See 52.212-2 Evaluation – Commercial Items (Section E) for a description of the factors in addition to price that the Government will use to evaluate offers. Prospective contractors must furnish the information listed herein with their quotations to ensure they receive full consideration.

SECURITY & PRIVACY CONTROL:

The Authorization & Accreditation (A&A) requirements of VHA Handbook 6500.6 do not apply to this requirement, therefore, a Security Accreditation Package is not required. No A&A or MOU/ISA is required. Sensitive information exposure as part of this contract involves applicable security controls within the facility as part of the VA Information Security If there are any questions related to privacy, please have a member of your staff contact the VA Privacy Service at (202) 461-6309. SPECIAL NOTES

In order to maintain integrity of this solicitation and subsequent award date, all offerors are advised that any question and answer requests must be submitted in a written form via e-mail to the Contracting Officer susan.pasholk@va.gov no later than NOON CENTRAL WEDNESDAY JUNE 6, 2018. Contracting will issue a consolidated response via solicitation amendment posted to www.fedbizops.gov within 2 business days to all parties.

The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change shall be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in cost incurred thereof.

SITE VISIT

It is strongly suggested, and expected that the offeror inspect the campus to be serviced to fully understand the nature of the work and the conditions under which the work is to be performed. In no case shall failure to inspect the campus constitute grounds for a claim after contract award. SITE VISIT IS SCHEDULED FOR TUESDAY JUNE 5, 2018 AT 10:00 AM CENTRAL. INTERESTED PARTIES TO MEET POC PERRY SCOTT (414-384-2000 X 43931) AT FACILITY MANAGEMENT BUILDING 70, E-WING.

LIMITATIONS ON SUBCONTRACTING – MONITORING AND COMPLIANCE (JUN 2011)

This solicitation includes 852.219-10. The contractor is advised in performing contract administration functions, the CO may use the services of a support contractor(s) retained by VA to assist in assessing the contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to contractor's offices where the contractor's business records or other proprietary data are retained and to review such business records regarding the contractor's compliance with this requirement. All support contractors conducting this review on behalf of VA will be required to sign an “Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the contractor's business records or other proprietary data reviewed or obtained in the course of assisting the CO in assessing the contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs. Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The contractor is required to cooperate fully and make available any records as may be required to enable the CO to assess the contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

SCOPE OF WORK/SPECIFICATIONS

1.0 DESCRIPTION OF SERVICES

The Contractor shall provide all travel, labor, labor hours, management, materials, tools, and equipment necessary to provide circuit breaking testing located at the Clement J. Zablocki Medical Center, Milwaukee, WI as defined in the Statement of Work.

2.0 SERVICES

The work to be performed under this contract consists of testing all molded case circuit breakers (frame size 225 amps or less) in the following locations:

2.1 Testing shall include the following:

1. Perform infrared scan to determine if there are any “hot spots” on the breaker connections and wire connections to the breaker.

2. Tighten all hardware visible to the eye and that are found during the infrared scan at the time of testing

3. Perform Contact resistance

4. Operate breaker

5. Identify discrepancies

1) Repair on site

2) Detailed information on any not repaired on site. The contractor will provide a quote to the COR before completing any additional work.

Work areas shall be left broom clean at the close of each day’s work.

The Contractor shall secure all permits, licenses, and/or certificates, or any such approvals or plans or specifications as may be required by federal, state and local laws, ordinances, rules, or regulations, for the proper execution and completion of the work under this contract.

Majority of service under this contract will be performed outside of normal business hours; most work will be performed between the hours of 5:00 PM and 2:00 AM Central. Work typically takes place in April of each contract year, and shall be scheduled with the COR at least 90 days prior to performance.

3.0 TECHNICAL REQUIREMENTS

3.1 It is of the utmost importance that the contractor utilizes adequately skilled and productive labor in order to furnish the required level of service specified in the contract. Technicians performing service under this contract must be Journeyman Level or technicians working directly under the supervision of a Journeyman. Failure on the part of the contractor to perform satisfactorily shall necessitate government action to adjust the contractor invoices.

3.2 Service technicians performing testing work must be NETA (National Electrical Testing Association, Inc.) certified or have equivalent work experience (two years full time equivalent experience in the testing and maintenance of electric power distribution systems).

3.3 The contractor shall have been in the business of testing electric power distribution systems for at least three years with a record of satisfactorily completing jobs of this scope.

3.4 The successful bidder shall submit employee qualifications and a list of job references prior to award.

4.0 REPORTS

A written ESR report with complete and documented all preventive maintenance and repair work must be submitted at the completion of each visit. Report must be in format mutually acceptable to VA and Contractor. The report shall include a detailed description of the process used including a complete list of acceptable cleaning agents. The report shall also include, but not limited to, manufacturer of products used, UL classification, and a copy of any Safety Data Sheets previously submitted as required by the specifications and OSHA. In addition, each ESR must, at a minimum, document the information listed below legibly and in complete detail. Failure to provide written reports could result in delay of payments. Reports must be submitted in original copy. No carbon copies will be accepted.

· Name of Contractor

· Name of FSE who performed services

· Contractor service ESR number/log number

· Date, time (starting and ending), equipment downtime, and hours on-site for service call

· VA purchase order number (Using the incorrect number could delay processing of invoices)

· Identification of equipment to be serviced: ID number, manufacturers name, model, and serial numbers, room location, and any other manufacturer’s identification numbers

· Itemized description of services performed including location of access panels and documenting of discrepancies, system impairments, and recommendations

· Signatures of the FSE performing the services and the VA employee who witnessed the services described

The contractor is to submit two (2) hard copies and one (1) electronic of the final inspection and repair report in a format similar to Attachment A.

All the test results will be documented and submitted to the Contracting Officer’s Technical Representative (COR) in a report (two certified copies), which will include the discrepancies found during testing and recommendations. Any minor repair or adjustments will be carried out as required during testing and inspection.

5.0 GENERAL INFORMATION

5.1 Hours of Operation

Normal hours of operation are Monday through Friday from 7:00 am to 3:30PM Central, excluding holidays. Majority of service under this contract will be performed outside of normal business hours; most work will be performed between the hours of 5:00 PM and 2:00 AM Central. Work typically takes place in April of each contract year and shall be scheduled with the COR at least 90 days prior to performance. Due to the nature of the project, the Contractor understands that a portion of the work will be performed in occupied areas. Therefore, work shall be performed in strict accordance with the Conformance Standards and OSHA regulations. Contractor shall perform work in a professional manner and shall minimize the disruption of normal operations of the facility including the occupied patient and staff areas.

6.0 COMPLIANCE WITH THE GENERAL SAFETY REGULATIONS

6.1 All Contractors and Subcontractors performing services for the Government are shall comply with all Occupational Safety and Health Administration (OSHA), State, County and Municipal Safety and Occupational Health Standards and any other applicable rules and regulations. Also all Contractors and Subcontractors shall be held responsible for the safety of their employees and any unsafe acts or conditions that may cause injury or damage to any persons or property within and around the work site area under this contract.

6.2 All ladders, scaffolding, tools, equipment, personal protective equipment, etc. shall be OSHA approved for the work to be performed. Contractor shall use caution signs as required by OSHA Regulations. Caution signs shall be on-site on commencement of Contract.

6.3 The Contractor shall purchase and issue all chemicals in their original containers. Materials that require precautionary warnings shall have affixed to all containers such labels or markings as are prescribed by law, regulatory agencies or this Contract. Any violation of OSHA may be subject to default action.

6.4 Contractor shall furnish to the COR two (2) copies of Material Safety Data Sheets (MSDS), for all products proposed for use, a minimum of seven (7) days prior to beginning service, for approval. Contractor must update copies of the MSDS on an annual basis. In addition, each time a new chemical product is proposed to be introduced into the facility, a copy of that product's MSDS must be provided to the COR for approval, prior to the product being used at the facility.

7.0 SECURITY REQUIREMENTS

All contractors working at Milwaukee VAMC shall be fingerprinted prior to being allowed to work on campus. Contractor ID badges can be obtained from PIV office typically 3-5 days after approval.

8.0 PROTECTION OF GOVERNMENT PROPERTY

During work execution, the Contractor shall take special care to protect Government property including furniture, walls, baseboards, ceiling tiles, and other surfaces. Accidental splashes shall be removed immediately. Damage resulting from the Contractor operations shall be repaired by the Contractor, including painting, refinishing, ceiling tile replacement or replacement, if necessary, at no additional cost to the Government and to match the existing finish, paint or ceiling tile. C.8 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2012)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001.

(2) Designated agency office has the meaning given in 5 CFR 1315.2(m).

(3) Electronic form means an automated system transmitting information electronically according to the Accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests.

(4) Invoice payment has the meaning given in FAR 32.001.

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System. (See Web site at http://www.fsc.va.gov/einvoice.asp.)

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI). The X12 EDI Web site (http://www.x12.org) includes additional information on EDI 810 and 811 formats.

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances below, the contracting officer directs that payment requests be made by mail, the contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for:

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(d) Comptroller General Examination of Record.
