Justification for Single Source Awards IAW FAR 13.106-1

For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

3) Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

Imaging system, digital radiographic detector, max wi-d cpl, used for Veterans requiring radiography services.

Estimated Amount: $98,051.00.

4) Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

SIEMENS MEDICAL SOLUTIONS USA, INC. owns the proprietary rights to the Ysio Max Imaging System. Therefore, they are the sole source to provide the replacement detector and do the installation and calibration.

Current detector on the SIEMENS Ysio Max Imaging system has failed and cannot be repaired, resulting in the imaging system to be down. This has impacted patient care by not having the means to perform radiography resulting in delayed care and financial hardship when Veterans are fee based out into the community. Furthermore, the Tomah VAMC only has two radiology rooms and the other is scheduled to go under repair in the next 30-days. When this happens, that room will be down for 5-days and the Tomah VAMC will have no radiography capability.

5) Description of market research conducted and results or statement why it was not conducted:

The NMR does not apply to this procurement, as the IGCE is less than $150,000.00, therefore a set aside will be pursued.

Market Research Findings:

Ability One website search was conducted; Ability One does not provide the required product.

FSS Search resulted in no vendors capable of providing the requirement.

Other pertinent information: Procurement is of an urgent and compelling nature. SIEMENS MEDICAL SOLUTIONS USA, INC. owns the proprietary rights to the Ysio Max Imaging System. Therefore, they are the sole source to provide the replacement detector and do the installation and calibration.

Based on the information provided above, it is determined this procurement will be fulfilled by issuing a sole source purchase order to SIEMENS MEDICAL SOLUTIONS USA, INC., i/a/w: FAR 13.106- 1(b)(1)(i).

Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
