Request for Sole Source Justification

DEPARTMENT OF VETERANS AFFAIRS

Justification and Approval (J&A) For Other Than Full and Open Competition

1. Contracting Activity: Department of Veterans Affairs, VISN 10, Richard L. Roudebush VA Medical Center (RLRVAMC), 1481 W. Tenth Street, Indianapolis, IN working with Network Contracting Office (NCO) 10.

2. Nature and/or Description of the Action Being Processed: The proposed project will install data cabling and provide data/networking related services for the facilty as a bridge contract until a long-term IDIQ is awarded.

3. Description of Supplies/Services Required to Meet the Agency’s Needs: The RLRVAMC has an emergent need for a data installation company to provide data cabling related services to support day to day operations and provide cabling related support for various critical equipment upgrades that must be implemented in FY23. The possible impacts of this contract not being implemented soon will include delaying the following projects: the VISN enforced Police body camera system implementation, correct OIT cabinet deficiencies and the SPS equipment replacement. Not having this contract in-place soon could also impact day to day patient care services that use data, if one of the data lines becomes damaged or needs repaired. 30% percent of the data lines in the facility are used for medical equipment that requires data to function properly. Data installation services and support is critical to ensure this facility has the capability to ensure that veterans get the quality care they deserve without delay.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): Vancom is a reputable company that has installed thousands of feet of fiber and copper cabling within the facility over the last few years with no issues. Their supervisors are BICSI technician certified and can install fiber and copper cabling to the latest industrial standards. Vancom is a local SDVOSB that knows the facility and the facilitates standards and procudures. Vancom is a trusted company that has completed all the training necessary to access the OIT VA closets in the facility and they have the most up to date data as-builts of the facility.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Based on the urgent need to procure a contract to maintain, install and repair critical data cabling that supports that facility, the project was not soliciated since we have an experienced SDVOB that can fullful the the VA requirments for data cabling and repair. If we solicit this contract we may delay patient care since this may take weeks to award. We also fear that if we were to award a contract to another contractor that is not familiar with the facilty or doesn’t have the security training than we may be required to wait weeks before repairs or cable installations could be made in the facilty, which could delay patient care if critical hospital equipment is effected. Vancom is a SDVOSB that is fully capable of accomplishing this work with no errors and without delay.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The Contracting Officer will ensure through the use of price analysis techniques, such as comparison against the independent Government estimate and other price analysis techniques identified in FAR 15.404-1(b), that the price will be fair and reasonable.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Conducted market research in SBA’s VetCert utilizing NAICS 238210. Did locate 2,096 businesses, but none of them have the capability to start immediately.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Over the past 2 years, RLRVAMC has had at least 3 instances where contractors have either installed the cabling wrong or the contractor was found installing the cabling in an unsafe manner. The government doesn’t always find out the data is installed or labeled incorrectly until several months down the road when the warranty period has expired, and facility must pay to have the data installed the correct way. The government has also had contractors try to install the data themselves vs having a professional do the work. This usually results in a poor finished product that needs to be repaired or completely reinstalled.

The RLRVAMC currently does not have a contract in place to install and repair data cabling. If a contract is not awarded in the next couple of days patient care may be impacted if data cabling to critical heathcare equipment becomes damaged.

A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: A procurement package was submitted for a long-term contract that will be in place, NLT October 1, 2023. In the meantime, this bridge contract will take care of the facility’s urgent needs that need to be completed before September 30, 2023.The long term contract will be competed.
