Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: _ 36C250-19-AP-2629_
1. Contracting Activity: Department of Veterans Affairs, NCO 10 Contracting, VISN 10, Ann Arbor
Healthcare System, is seeking a brand name only purchase of 13 Valley lab FT10 Energy Platform Units, 3 Gem Bipolar Footswitch Standard, 3 Footswitch Standard, and 5 Valley lab FT10 Carts. The purchase request/2237 is: 506-19-2-118-0102.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
An energy platform that holds power throughout various tissue types provides consistency to the clinician. The Valley lab FT10 energy platform demonstrated consistent power in varying types of tissue and across power settings to effectively eliminate variability in the operating room.
The tissue sensing technology improves the speed and consistency of hand-held devices by reading tissue composition in real time. This technology examines device performance 434,000 times per second, monitoring tissue impedance and allowing effective and efficient energy delivery.
12 of the Valley lab FT10 Energy Platform Units will go to the operating rooms and 1 will go to the ENT clinic.
The estimated amount $203,109.93 minus $20,500 trade in credit for outdated equipment, total estimated amount is $182,609.93
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
This purchase is to fully upgrade our OR to the FT10. From a patient safety standpoint, the OR would like to continue with the type of generator that our staff is familiar with and comfortable using.
Medtronic will be the Sole Source as their product offers better results for the Veteran and provides technical qualities that no other of its competitors offer. Medtronic is currently our contracted vendor for ESU generators and the FT10 is the latest version of the same platform we have previously been using (ex. ForceFX, ForceTriad, etc.)
4. Description of market research conducted and results or statement why it was not conducted:
A search of VIP using NAICS 334510 resulted in 163 matches. A NAC search found the required equipment on contract with the OEM, V797P-4465B, Covidien Sales, LLC which has since been bought out by Medtronic. GSA Advantage resulted in a similar product, but it did not meet the requirement. GSA e-Library search using A-41, Electrosurgical Apparatus and resulted in 30 contractors including Medtronic. MSPV, National Strategic Source Listing and the NX Equipment listing resulted in zero additional schedule contracts.

A FPDS search for previous purchases resulted in a sole source purchase from the OEM, large business and SB set-aside. CO posted sources sought on FBO and eBuy. CO determined SDVOSB pricing to be fair and reasonable. CO believes a SDVOSB set-aside IAW VA “Rule of Two” 38 U.S.C.
8127(d) requirements and VAAR 819.7005 is in the best interest of the Government.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
