The Contracting Officer is the only person authorized to approve changes or modify any of the requirements under this contract. The Contractor shall communicate with the Contracting Officer on all matters pertaining to contract administration. Only the Contracting Officer is authorized to make commitment or issue changes that will affect price, quantity or quality of performance of this contract. B.4 PERFORMANCE WORK STATEMENT
Shooting Range Services
1.0. Introduction.
1.1. The Government requires a secure indoor Shooting Range for the training of the Department of Veterans Affairs (VA), Miami VA Healthcare System, Police Officers in support of the Bruce W. Carter, VA Medical Center.
2.0. Description / Scope / Objective.
2.1. The objective for this acquisition is to have a contractor provide an environment that will facilitate law enforcement education and training.
2.2 The Contractor shall provide an environment that encompasses a specialized, clean, modern state of the art firing/shooting range designed for safe firearm practice.
3.0. Applicable Documents.

4.0. Performance Requirements.
1. The Contractor shall provide a Shooting Range that can accommodate long gun/handgun (side arm) weapons, multiple barricades, night shooting operations, and automatic targets. Required disciplined training areas to include:
0. Pistol qualification and proficiency course of fire
0. Low Light pistol course of fire
0. Barricade pistol course of fire (Tactical Training)
0. Long Gun course of fire
0. Active Threat Response training (simulation)
0. A classroom that is equipped with audio/visual, and a minimum room size of 600 square feet
Range:
1. The Contractor shall provide accessible hours of operation times to include the hours of 6:00 AM to 6:00 PM EST.
1. The Contractor shall provide a training facility that accommodates an estimated full day usage to thirty (30) officers.
1. The Contractor shall provide time exclusively for the range space programmed for the Department of Veterans Affairs, during the scheduled dates.
1. The firearm training area shall be designated as areas closed off to the general public.
1. The facility firearms shall be indoors with the capacity for day and night firing.
1. The facility shall have a Central Station (PA system) to provide instructions during the course of fire.
1. The facility shall have sufficient and adequate interior lighting for the scheduled work area(s).
1. The facility backstop trap shall be maintained to provide a safe shooting environment.
1. The Contractor shall provide a range that can accommodate 9mm caliber and 5.56mm/.223mm caliber ammunition.
1. The Facility shall have trash containers designated for used targets, targets backers and empty ammunitions boxes.
1. The Range shall possess a minimum of nine (9) indoor firing lanes with firing points from five (5) yards to twenty-five (25) yards, used for qualifications and tactical training purpose. Each firing lane must allow for movements between firing points with no restrictions. Movement to include standing, kneeling, and prone positions which will allow the shooter to draw and fire from holster and concealment.
Classroom:
1. The Contractor’s facility shall provide classroom settings to include a projector and screen that has compatible computer connections for powerpoint trainings.
1. The Contractor shall provide a classroom that measure at least 600 sq. ft.
1. The facility shall have air-conditioned classrooms which can accommodate at least twenty (30) students and four (4) instructors.
Administrative:
1. The Facility shall have a Range Master.
1. The Contractor shall ensure enforcement of code regulations, so the facility operates smoothly and offers a safe environment as mandated by federal, state and municipal laws. The business compliance shall adhere with the Environmental Protection Agency regulations as well as those concerned with conservation and environmental issues, noise limits and the adverse impact of lead bullets.
1. The Facility shall have separate male and female restroom facilities.
Billing:
1. The Contractor shall allow VA Police to re-schedule the range/s as needed four (4) days prior without penalty. Re-scheduled dates will be subject to the availability of the ranges’ existing schedule.
1. The Contractor shall allow the option to request additional range training dates.
1. The Billing shall consist of the following: one (1) full day (day/night) shall equal six (6) hours. The half day (day/night) is three (3) hours.
1. The Contractor shall not charge a cancellation penalty for inclement weather, where the range is unsafe to operate. (i.e. thunderstorm, hurricanes, tornedos)
1. Supplemental scheduling shall be provided for extra range time, a total of 24 hours for the year.
5.0. Performance Location and Hours.
| 5.1. | The primary performance of the requested service is at the Contractor’s location. |
| 5.2. | The Government will use the facility during special working hours which are from 6:00 AM to 6:00 PM, Monday through Sunday, and nights as necessary. |
6.0. Deliverables.
6.1. Not Applicable.
7.0. Key Personnel Replacement and Substitution.
7.1. Requests for approval of substitutions shall be in writing and shall provide a detailed explanation of the circumstances necessitating the proposed substitutions (one) 1 day prior to range usage. Proposed substitutes shall have qualifications that are equal to or higher than the personnel being augmented.
7.2. The Contractor shall replace any absent individual for any period greater than 30 minutes so as to leave a full complement of trained qualified personnel at all times with no disruption of services.
8.0. Contractor Personnel and Management.
8.1. Contractor Personnel. The Contractor shall be responsible for employing technically qualified personnel to perform the work specified in this PWS. The Contractor shall maintain the personnel, organization and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements.
| 8.2 | Safety/Security Requirements. The Contractor shall comply with all applicable federal, state and local laws. |
| 8.3 | All information generated in performance of this contract becomes property of the Government and |
must be surrendered upon request and/or completion of the contract. The Contractor must protect against the destruction and/or misplacement of all information produced under this contract, unless directed under local policy to destroy. This includes both hard and soft copies of data.
8.4 The Contractor shall not release any information (including photographs, files, public announcements, statements, denials, or confirmations) on any part of the subject matter of this contract or any phase of any program hereunder without the prior written approval of the COR.
9. TRAVEL Not Applicable.
10. NON-PERSONAL SERVICE STATEMENT
10.1. Contractor employees performing services under this order will be controlled, directed, and supervised at all times by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the PWS. Contractor employees will perform their duties independent of, and without the supervision of, any Government official. The tasks, duties, and responsibilities set forth in the contract may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.
11. PERSONNEL QUALIFICATIONS
11.1. The Contractor shall be responsible for employing technically qualified personnel to perform the work specified in this PWS. The Contractor shall maintain the personnel, organization, and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements. The work history of each contractor employee must contain experience directly related to the task and functions he/she is intended to perform under this contract. The Government reserves the right, during the life of the resulting contract, to request work histories on any contractor employee for the purposes of verifying compliance with the above requirements; additionally, the Government reserves the right to review resumes of contractor personnel proposed to be assigned. Personnel assigned to, or utilized by, the Contractor in performance of work shall be fully capable of performing the requirements contained in the PWS in an efficient, reliable, and professional manner.
11.2. Specific Personnel Qualifications Requirements –Personnel assigned to or utilized by the contractor in the performance of this contract shall, as a minimum:
11.2.1. The facility and owners have the necessary license to work in the United States.
12. PERFORMANCE STANDARDS AND QUALITY MEASUREMENT
12.1. The Government designee shall be responsible for monitoring the Contractor's performance. Performance deficiencies or poor performance identified during the term of the contract shall be documented by the Government and reported to the Contractor. Upon notification of deficiencies or poor performance, the Contractor shall be given 5 days’ time to take corrective action. If determined appropriate, the Contracting Officer and/or other VA staff members shall meet with representatives of the Contractor to review performance and resolve issues. All deficiencies or poor performance shall be documented and MUST be corrected within the timeframe specified by the Government. The Contractor shall notify the Contracting Officer when correction(s) have been made. If the appropriate correction is not made within the timeframe specified, the Government shall have the right to terminate the contract in it is entirety. Nothing in this section is intended to modify or waive the government’s rights outlined in 52.212-4.

C.3 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed six (6) months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposed by added the total price for all options to the total price for the basic requirement. This includes options under FAR 52.217-8, Option to Extend Services, which applies to this solicitation. Evaluation of options under FAR 52.217-8 will be accomplished by using the prices offered for the last option period to determine the price for a 6-month option period, which will be added to the base and other option years to arrive at the total price. Evaluation of options will not obligate the Government to exercise the options(s).
“NOTE: The specified rates under this clause will be those rates in effect under the contract each time an option is exercised under this clause.”

C.4 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months.

C.5 52.219-6 NOTICE OF TOTAL SMALL BUSINESS SET-ASIDE (JAN 20019) (DEVIATION 2019-O0003)
(a) Definition. “Small business concern,” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.
(b) Applicability. This clause applies only to—
(1) Contracts that have been totally set aside or reserved for small business concerns; and
(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).
(c) General.
(1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.
(2) Any award resulting from this solicitation will be made to a small business concern.
(d) Agreement.
(1) For a contract at or below the simplified acquisition threshold, a small business concern may provide the end item of any firm. For a contract exceeding the simplified acquisition threshold, a small business concern that provides an end item it did not manufacture, process, or produce, shall—
(i) Provide an end item that a small business has manufactured, processed, or produced in the United States or its outlying areas;
(ii) Be primarily engaged in the retail or wholesale trade and normally sell the type of item being supplied; and
(iii) Take ownership or possession of the item(s) with its personnel, equipment, or facilities in a manner consistent with industry practice; for example, providing storage, transportation, or delivery.
(2) Paragraph (d)(1) of this clause does not apply to construction or service contracts.

C.6 VAAR 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2019) (DEVIATION)
(a) Definition. For the Department of Veterans Affairs, “Service-disabled veteran-owned small business concern or SDVOSB”:
(1) Means a small business concern:
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled Veterans or eligible surviving spouses (see VAAR 802.101, Surviving Spouse definition);
(ii) The management and daily business operations of which are controlled by one or more service-disabled Veterans (or eligible surviving spouses) or, in the case of a service-disabled Veteran with permanent and severe disability, the spouse or permanent caregiver of such Veteran;
(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;

C.8 VAAR 852.219-74 LIMITATIONS ON SUBCONTRACTING—MONITORING AND COMPLIANCE (JUL 2018)(DEVIATION)
(a) This solicitation includes FAR 52.219-6, VAAR 852.219-10 and VAAR 852.219-11.
(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
