36C24820Q0247: LEP Phone Interpreter Service Vendor Questions

1. Are these services currently being performed? If so, please provide the incumbent name and contract number.

VA248-15-J-0735 TrueLanguage, LLC 1355 Terrell Mill Rd.

Bldg 1476 Ste 250 Atlanta GA 30067

2. What has been the biggest challenge for fulfilling service under this contract?

The biggest challenge is getting the education out to the facility how to use this service. With the Vendor’s assistance and guidance, our facility can work to provide an operating procedure.

3. Is this contract subject to the Limitations on Subcontracting?

Yes. Per VAAR Clause 852.219-10 VA Notice of Total Service-Disabled Veteran-Owned Small Business Set-Aside (Jul 2019) (Deviation), paragraph (a)(5), the Limitations on Subcontracting apply to all SDVOSB set-asides, regardless of the dollar amount. This means that in the case of a contract for services (except construction), it will not pay more than 50% of the amount paid by the government to it to firms that are not VIP-listed SDVOSBs. This is in accordance with the SBA’s explanation in the Federal Register, Vol. 81, No. 104; page 34249.

NOTE: see https://www.govinfo.gov/app/details/FR-2016-05-31

4. Does the VA require a vendor to have a GSA contract to be eligible for this award?

No, both GSA and Open Market quotes will be accepted.

5. Will the interpreter be located on site, or is this a call-in service that can be provided off site?

This should be a call-in service and provided off-site. There is no in-person, on-site requirement.

6. On Page 6, B.4, paragraph 2c: What is the minimum security clearance (background security investigation) required in order to perform the duties of this contract?

Contractors are required to complete the Required Classes on page 14, B.5, and to meet all Privacy Act and HIPAA standards regarding patient information.

7. If service is provided off site, is the “VHA-provided records management training” on page 16, B.6, paragraph 11 required?

Records Management language and training is not required if the contractor is NOT producing records on behalf of our facility. For example, if they are not recording or transcribing the call, then the RM requirements can be removed.

8. Will there be time for the chosen vendor to complete training (VA10176 & VA10203) and/or recertify employees prior to the contract start?

The requirement is training needs to be accomplished prior to the contractor providing the translations service. Since the service is intermittent, this can be done after the establishment of the contract but prior to providing the service. Training is accomplished in TMS:

• the contracting officer’s knowledge and previous experience with the supply or service being acquired

• Customer surveys (See D.2) and past performance questionnaire replies

• Contractor Performance Assessment Reporting System (CPARS) at http://www.cpars.gov/

• or any other reasonable basis.”

In addition, an offeror who has no relevant past performance history will be given a neutral rating and will not be evaluated either favorably or unfavorably, in accordance with FAR 15.305 (a)(2)(iv).
