B.4 PERFORMANCE WORK STATEMENT

Performance Work Statement Grounds-Landscaping Services

1.0 INTRODUCTION

1.1 The Government requires grounds- landscaping maintenance services in support of the NF/SG VA Healthcare System, Engineering Service.

2.0 DESCRIPTION/SCOPE/OBJECTIVE

2.1 The Contractor must provide all labor, equipment, tools, material, supervision and other items and services necessary to perform the work as defined in this Performance Work Statement.

3.0 APPLICABLE DOCUMENTS

4.0 PERFORMANCE REQUIREMENTS

4.1 The contractor shall perform lawn maintenance/grounds keeping at the Malcom Randall VA Medical Center for the proper intended performance of beautification of the facilities landscaping features per any and all industry and or governing doctrine. The contractor shall take full responsibility for the features of the facility to maintain an aesthetically pleasing grounds at all times. Described below are the minimum duties required however the contractor shall be responsible for full performance as the intent is to maintain the grounds and landscaping.

4.2 At the time of award the contractor shall take full responsibility for any damages caused to any part of the turf grass and surrounding areas therein (pre-existing conditions). The contractor shall accept all pre-existing conditions of the grounds (includes irrigation system). All lawn maintenance chemicals used shall be coordinated with and IAW all Government policies and procedures at the convenience of the Government.

4.3 Maintenance of Campus: The Contractor is responsible for maintaining the turf grass. This service includes:

· Keeping the grass cut to a height of 3 1/2” to 4”.

· Edge all sidewalk areas of campus and around landscape beds adjacent to turf grass areas.

· Weed eat around all obstacles as they relate to turf grass areas: paying attention to areas that cannot be maintained by riding/walk behind mowers- areas along building foundations, fence posts, sidewalk areas, signage and all other obstacles.

· Power blow all areas of campus when the cutting, edging and weed eating complete.

· Apply fertilizer/insecticide to all shrubbery twice per year.

· Apply fertilizer/insecticides 3 times a year to all turfgrass areas.

· If any issues are noted during the contractor’s visit to the site, contractor shall immediately notify the Government of said problems(s).

· Contractor must follow all safety rules per any and all industry or governing doctrine. All personnel protective equipment shall be worn when working on grounds. At a minimum: safety shoes, hearing protection, safety glasses and safety shirt/vests shall be worn.

· Contractor shall make 42 site visits per year to maintain the turfgrass/plant beds: April-October services shall be performed weekly. November-March services shall be performed bi-weekly.

· Prior to any use of chemicals, the contractor shall keep and maintain a pesticide application log- documenting dates, areas of campus, pest treated, product used, percent of active ingredient used.

· It is the responsibility of the contractor to police all turf grass areas for trash/debris of campus before and after performance.

4.4 Fisher House and Walk of Courage: Mowing: All turf areas shall be mowed as necessary during the growing season to maintain a neat and attractive appearance at the proper height for the following: St Augustine 4” and Bahia 3”. All turf areas shall be thoroughly cleaned of debris prior to mowing and at no time shall any excessive clippings be left on the surface after mowing. String trim all areas where lawn mowers can’t cut. String trimming shall never be lower than the mower height. Turf areas shall be inspected for insects and disease. St Augustine turf will be mowed weekly April through October and bi-weekly November through March or 42 visits.

4.5 Porter/Detail Service: A detail service shall be completed on a bi-weekly schedule from November through March on the opposite week of the full-service visit to ensure weekly visits on the property throughout the year. This service shall include detail work around the building, blowing the sidewalks and tending to the annual’s beds. A total of 10 visits.

4.6 Edging: All plant beds, sidewalks, curbs and driveways shall be edged each visit during the summer and as needed in the winter. Every effort to maintain bed size shall be utilized.

4.7 Pruning: All shrubs and hedges shall be maintained in a manicured fashion. Select pruning will be done where applicable. All trees shall be pruned to maintain 8’ feet clearance of walkways, 12’ feet in the parking lots, and 4’ feet from the buildings. All dead palm fronds under 12’ feet shall be removed as needed. Seasonal pruning on all Crape Myrtles, Azalea, Camellia, Gardenias and grasses (Love and Spartina) shall be done at the proper time of year. All palm trees shall be trimmed in a hurricane fashion one time a year in June or July.

4.8 Bed areas: All bed areas shall have weeds controlled by both mechanical and chemical means. Any weed over 3” inches shall be pulled by hand or mechanically controlled. Liquid herbicides shall be applied by back pack sprayers during times when the wind is below 5 five mph to minimize overspray. All beds, parking lots and sidewalks shall be maintained on a weed free basis. All vines shall be removed from plant material, fence lines and buildings walls.

All grass runners in plant beds to be removed.

4.9 Blowing/Litter control: All parking lots, streets, sidewalks, and patios shall be blown off each visit. All debris shall be blown into a pile and collected. Natural pine straw and leaves may be disposed of throughout select natural areas (available upon request) as long as not altering the natural landscape. All debris shall be disposed of off premises. All storm damage hurricane or otherwise debris is the responsibility of the contractor. All large sticks in plants, plant beds and turf areas shall be removed.

4.10 Fertilization-chemicals: All turf shall be fertilized six 6 times per year with fertilizer and insect treatments. All shrubs shall be fertilized with a granular product and sprayed with a liquid insecticide three 3 times per year. Spot insect treatments shall be applied throughout the year based on visual inspections. One time a year, all turf shall be aerated, generally in the spring time. All turf shall be treated with a fungicide application 4 times a year.

4.11 Irrigation: The contractor shall be responsible for the irrigation system. The irrigation system shall be checked monthly. The irrigation system shall be manually operated, and every zone inspected for optimal operation and coverage. Upon request a complete zone analysis report shall be filled out and submitted to the Government. Any damaged irrigation heads or components shall be repaired by the contractor. Any major repairs required shall be documented and submitted to the Government for possible future repairs.

4.12 Mulching: The beds shall be mulched one 1 time a year using seventy-five 75 yards of pine mulch and fifty 50 bales of pine straw. This shall be a top dressing of the beds.

4.13 Safety Regulations:

· The Contractor shall use all safety equipment as required by OSHA and VA regulations.

· All OSHA and VA safety regulations shall be observed during the performance of the service contract.

· All contractors must have completed the 10- hour OSHA safety course.

· The contractor shall obey all safety rules and regulations.

· The contractor shall provide the necessary barricades/signage where required.

· The contractor shall designate a “competent person” in accordance with 29 CFR 1926.32(f) which states, “One who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous or dangerous to employees and who has authorization to take prompt corrective measures to eliminate them.” The contractor shall instruct each of his employees in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.

· The contractor shall maintain site and building access free and unobstructed to facility emergency services.

· The contractor shall prohibit smoking in not designated areas.

· The contractor shall dispose of waste and debris from site after each service.

· Additionally, the contractor shall comply with the following requirements if the project is inside the building and certain work is being done:

· Develop a plan detailing project specific fire and safety measures.

· Maintain site and building access free and unobstructed to facility emergency services.

5.0 PERFORMANCE LOCATION AND HOURS

5.1 Primary place of performance is the Malcom Randall VAMC 1601 SW Archer RD Gainesville FL.

5.2. Government normal duty hours are from 0800-1630, Monday through Friday, excluding Federal holidays. Contractor access will be provided during this time.

5.2.1 Outside normal duty hours may occur. These times shall be coordinated with and at the convenience of the Government.

6.0 DELIVERABLES

6.1 All service records shall be provided to the Government within a timely manner (one (1) week of services rendered).

7.0. Contractor Personnel and Management.

7.1. Contractor Personnel. The Contractor shall be responsible for employing technically qualified personnel to perform the work specified in this PWS. The Contractor shall maintain the personnel, organization and administrative control necessary to ensure that the work delivered meets the contract specifications and requirements.

7.2. Contractor Badges. Notwithstanding the requirement to wear a Government furnished badge, Contractor personnel shall also wear a laminated contractor identification badge always when performing services under this Contract, including when on Government directed travel the badge will contain a personal picture, name of employee, and Contractor's name. Badges shall be worn on the outer garment attached to the outer shirt or jacket pocket by a button or clip or worn around the neck secured by an appropriate identification card lanyard.

7.3. All Contractor personnel attending meetings, answering Government telephones, and working in other situations where their Contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public or Congress that they are Government officials. They must also ensure that all documents or reports produced by Contractor personnel are suitably marked as Contractor products or that Contractor participation is appropriately disclosed.

7.4. Safety/Security Requirements. The Contractor shall comply with all applicable federal, state and local laws and ensure performance is secure while protecting material, equipment, and supplies from damage and loss. Government security personnel shall have the express right to inspect for security violations at any time during the term of the contract.

7.5. All information generated in performance of this contract becomes property of the Government and must be surrendered upon request and/or completion of the contract. The Contractor must protect against the destruction and/or misplacement of all information produced under this contract, unless directed under local policy to destroy. This includes both hard and soft copies of data.

7.6. The Contractor shall not release any information (including photographs, files, public announcements, statements, denials, or confirmations) on any part of the subject matter of this contract or any phase of any program hereunder without the prior written approval of the COR.

7.7. Standards of conduct

7.7.1. Conduct of Personnel. Contractor personnel shall conduct themselves in a professional manner (i.e. timeliness, communication; spoken and written etc.). The Contracting Officer may require the Contractor to remove from the job site any employee working under this contract for reasons of suspected misconduct, a suspected security breach, or suspected to be under the influence of alcohol, drugs, or any other incapacitating agent. Contractor employees shall be subject to dismissal from the premises upon determination by the Contracting Officer that such action is necessary in the interests of the Government. The hospital director or designated representative has the authority to bar individuals from the Government facility. The removal from the job site or dismissal from the premises shall not relieve the Contractor of the requirement to provide adequate personnel to perform the services as required by this performance work statement. The Government shall not reimburse the Contractor for travel and other expenses associated with the removal of personnel.

7.7.2. Contractor personnel are not authorized to carry or possess personal weapons to include, but not limited to, firearms and knives with a blade length more than three inches, while assigned under this contract.

7.7.3. Working Attire and Appearance. Contractor personnel shall present a professional appearance commensurate with standards delineated for Government civilian personnel acting in similar capacities.

7.7.4. The Government reserves the right to review Contractor personnel qualifications. Upon request, resumes shall be provided to the Contracting Officer prior to clearance approval, for review and acceptance by the COR. The intent is verification purpose and not for the Government to become the hiring authority.

8.0 TRAVEL. NOT APPLICABLE

9.0 NON-PERSONAL SERVICE STATEMENT

9.1. Contractor employees performing services under this order will be controlled, directed, and supervised always by management personnel of the contractor. Contractor management will ensure that employees properly comply with the performance work standards outlined in the PWS. Contractor employees will perform their duties independent of, and without the supervision of, any Government official. The tasks, duties, and responsibilities set forth in the contract may not be interpreted or implemented in any manner that results in any contractor employee creating or modifying Federal policy, obligating the appropriated funds of the United States Government, overseeing the work of Federal employees, providing direct personal services to any Federal employee, or otherwise violating the prohibitions set forth in Parts 7.5 and 37.1 of the Federal Acquisition Regulation (FAR). The Government will control access to the facility and will perform the inspection and acceptance of the completed work.

10.0 PERFORMANCE STANDARDS AND QUALITY MEASUREMENT

10.1. Performance standards define desired services. The Government performs surveillance to determine if the Contractor exceeds, meets, or does not meet these standards. The Government shall use these standards to determine Contractor performance and shall compare Contractor performance to the Acceptable Quality Level (AQL). The Quality Assurance Surveillance Plan (QASP) method of surveillance will be by random inspection.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within thirty (30) days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within thirty (30) days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least thrity (30) days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed sixty-six (66) months.

(End of Clause) C.4 VAAR 852.219-10 VA NOTICE OF TOTAL SERVICE-DISABLED VETERAN-OWNED SMALL BUSINESS SET-ASIDE (JUL 2016)(DEVIATION)

(a) Definition. For the Department of Veterans Affairs, “Service-disabled veteran-owned small business concern or SDVSOB”:

(1) Means a small business concern:

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans or eligible surviving spouses (see VAAR 802.201 Surviving Spouse definition);

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans (or eligible surviving spouses) or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran;

(iii) The business meets Federal small business size standards for the applicable North American Industry Classification System (NAICS) code identified in the solicitation document;

(iv) The business has been verified for ownership and control pursuant to 38 CFR 74 and is so listed in the Vendor Information Pages database, (https://www.vip.vetbiz.gov); and

(v) The business will comply with subcontracting limitations in 13 CFR 125.6, as applicable

(2) “Service-disabled veteran” means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

(b) General.

(1) Offers are solicited only from verified service-disabled veteran-owned small business concerns. Offers received from concerns that are not verified service-disabled veteran-owned small business concerns shall not be considered.

(2) Any award resulting from this solicitation shall be made to a verified service-disabled veteran-owned small business concern.

(c) Agreement. A service-disabled veteran-owned small business concern agrees that in the performance of the contract, the concern will comply with the limitation on subcontracting requirements in 13 CFR §125.6.

(d) A joint venture may be considered a service-disabled veteran owned small business concern if the joint venture complies with the requirements in 13 CFR 125.15, provided that any reference therein to SDVO SBC is to be construed to apply to a VA verified SDVOSB as appropriate.

(a) This solicitation includes VAAR 852.219-10 VA Notice of Total Service- Disabled Veteran-Owned Small Business Set-Aside.

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6, or the limitations on subcontracting requirements in the FAR clause, as applicable. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor's offices where the Contractor's business records or other proprietary data are retained and to review such business records regarding the Contractor's compliance with this requirement.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). The Contractor is required to cooperate fully and make available any records as may be required to enable the Contracting Officer to assess the Contractor's compliance with the limitations on subcontracting or percentage of work performance requirement.

C.6 VAAR 852.232-72 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS (NOV 2018)

(a) Definitions. As used in this clause—

(1) Contract financing payment has the meaning given in FAR 32.001;

(2) Designated agency office means the office designated by the purchase order, agreement, or contract to first receive and review invoices. This office can be contractually designated as the receiving entity. This office may be different from the office issuing the payment;

(3) Electronic form means an automated system transmitting information electronically according to the accepted electronic data transmission methods and formats identified in paragraph (c) of this clause. Facsimile, email, and scanned documents are not acceptable electronic forms for submission of payment requests;

(4) Invoice payment has the meaning given in FAR 32.001; and

(5) Payment request means any request for contract financing payment or invoice payment submitted by the contractor under this contract.

(b) Electronic payment requests. Except as provided in paragraph (e) of this clause, the contractor shall submit payment requests in electronic form. Purchases paid with a Government-wide commercial purchase card are considered to be an electronic transaction for purposes of this rule, and therefore no additional electronic invoice submission is required.

(c) Data transmission. A contractor must ensure that the data transmission method and format are through one of the following:

(1) VA’s Electronic Invoice Presentment and Payment System at the current website address provided in the contract.

(2) Any system that conforms to the X12 electronic data interchange (EDI) formats established by the Accredited Standards Center (ASC) and chartered by the American National Standards Institute (ANSI).

(d) Invoice requirements. Invoices shall comply with FAR 32.905.

(e) Exceptions. If, based on one of the circumstances in this paragraph (e), the Contracting Officer directs that payment requests be made by mail, the Contractor shall submit payment requests by mail through the United States Postal Service to the designated agency office. Submission of payment requests by mail may be required for—

(1) Awards made to foreign vendors for work performed outside the United States;

(2) Classified contracts or purchases when electronic submission and processing of payment requests could compromise the safeguarding of classified or privacy information;

(3) Contracts awarded by contracting officers in the conduct of emergency operations, such as responses to national emergencies;

(4) Solicitations or contracts in which the designated agency office is a VA entity other than the VA Financial Services Center in Austin, Texas; or

(5) Solicitations or contracts in which the VA designated agency office does not have electronic invoicing capability as described above.

C.7 VAAR 852.237-70 CONTRACTOR RESPONSIBILITIES (APR 1984)

The contractor shall obtain all necessary licenses and/or permits required to perform this work. He/she shall take all reasonable precautions necessary to protect persons and property from injury or damage during the performance of this contract. He/she shall be responsible for any injury to himself/herself, his/her employees, as well as for any damage to personal or public property that occurs during the performance of this contract that is caused by his/her employees fault or negligence, and shall maintain personal liability and property damage insurance having coverage for a limit as required by the laws of the State of Florida. Further, it is agreed that any negligence of the Government, its officers, agents, servants and employees, shall not be the responsibility of the contractor hereunder with the regard to any claims, loss, damage, injury, and liability resulting there from.
