Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID: 36C248-19-AP-1665
1. Contracting Activity: Department of Veterans Affairs, VISN 08, James A. Haley Veterans Hospital (JAHVH) located at 13000 Bruce B. Downs Blvd. Tampa, FL 33612 673-19-1-084-0025.
2. Nature and/or Description of the Action Being Approved: Upgrade existing Steris Caviwave Ultrasonic machines in the Sterile Processing Services (SPS) Decontamination area. The estimated value of the proposed action is $521,183.16.
3. Description of Supplies/Services Required to Meet the Agency’s Needs: This request is for new InnoWave Sonic Irrigators with thermal disinfection technology. SPS is requesting the InnoWave PCF and InnoWave PRO Steris that will clean and disinfect 20-40 lumened instruments in a single uninterrupted cycle. The instrument reprocessing workstation can be used as a standalone unit, twin or multiple wash station. The InnoWave PCF and InnoWave PRO Systems parametrically controls the flow through the lumened devices optimizing both mechanical and chemical cleaning action inside the cannula while simultaneously controlling the propagation of unwanted wash foam build up. The inline Thermal Disinfection System is used to raise the temperature of the water in the rinse phase following both internationally recognized time temperature relationships and the A0 calculation. Also, the Innowave PCF will be SPS primary way of properly cleaning and disinfecting the Da Vinci Xi robotics instrumentation.
4. Statutory Authority Permitting Other than Full and Open Competition: 41 USC §3304(a)(5), 38 U.S.
Code § 8127(c), as implemented by FAR 6.302-5 (Authorized or Required by Statute). COs may use the non-competitive (sole source) procedures authorized in VAAR 819.7007 or 819.7008 up to $5,000,000. Check the specific VAAR clause used below:
(X) 819.7007 Sole source awards to a verified service-disabled veteran-owned small business; or ( ) 819.7008 Sole source awards to a verified veteran-owned small business
5. Demonstration that the Contractor’s Unique Qualifications and/or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): In accordance with (IAW) 38 U.S.C. 8127(c) Public Law (PL) 109-461 and in support of Veterans First the CO initially searched for Service Disabled Veteran Owned Small Business (SDVOSB) authorized distributors. Only one SDVOSB was found in the open market. 1st American Medical Distributor (AMD) is an authorized distributor of Steris products to Federal Government Customers. AMD is a responsible source with active VIP registration and SAM. IAW VAAR 819.7007 the CO may award contracts to responsible SDVOSB on a sole source basis provided the price can be determined fair and reasonable.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable, including whether a notice was or will be publicized as required by subpart
5.2 and, if not, which exception under 5.202 applies: Sources sought to all 319 SDVOSB/VOSB under NAICS 339112. GSA search under SIN 65 II A Medical Equipment A-88 Ultrasonic Cleaning Systems found three SDVOSB’s. CO emailed inquiry to VOSB’s under SIN to find resellers/distributors.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost will be determined fair and reasonable by evaluating the quoted price against market prices and past purchases within the VA system.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research conducted online, FSS, NAC, GSA, FPDS, SAM, FBO, VetBiz and dynamic small business searches. Results of market research shows that some of the InnoWave cleaner items are available under the manufacturer Steris Corp (Large business DUNS # 177360039) VA FSS Contract# V797D-60613 (expiration date May 31st, 2021). CO emailed Steris to find SDOVSB/VOSB/SB authorized resellers. Steris confirms AMD as the only SDVOSB reseller, there are no other SDVOSB, no VOSB and no SB resellers. VIP identified 265 SDVOSB vendors and only one known source that can distribute Steris and that is AMD (DUNS 802239751 an SDVOSB). Based on unofficial pricing/market research from AMD, items are open market and not on the formulary. AMD met the eligibility criteria outlined in VAAR 819.7003, they are verified in VIP and the action is below the $5M threshold.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition: Steris is the brand currently in use at the JAHVH. Authority IAW 38 USC 8127(c) Public Law (PL) 109-461 and in support of Veterans as implemented by FAR 6.302-5 (Authorized or Required by Statute).
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: AMD and Steris.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The justification will be posted on FedBizOpps (FBO) for 30 days in accordance with FAR 6.305 allowing interested sources an opportunity to respond. The Government will continue to conduct market research to ascertain if there are changes in the market place for future requirements.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
