NOTICE OF INTENT TO SOLE SOURCE This notice is being published in accordance with Federal Acquisition Regulation (FAR) Subpart 5.101 requiring dissemination of information for proposed contract actions. This is a notice of intent to award a sole source contract and is not a request for competitive quotes/proposals.

The Department of Veterans Affairs, Network Contracting Office 7 located in Charleston, SC is issuing this Notice of Intent (NOI) to inform industry contractors of the Government’s intent to execute a Sole Source Purchase Order under FAR Part 13.5 Simplified Procedures for Certain Commercial Items: The authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. 1901 and is implemented for restricting competition on this procurement via FAR 13.106-1(b)(2). Far Part 13.501(a) Sole Source (including brand name) acquisitions. This notice satisfies the posting requirements at FAR Part 5.101.

The intended contractor is Nihon Kohden America, Inc. The contract will be to supply a PSG 1100 system. The Ralph H. Johnson VA Medical Center requires the PSG 1100 system to expand the current PSG 1100 systems currently in use in the sleep study lab. This procurement is being conducted in accordance with FAR 13.106-1(b) (1)(ii), Soliciting from a Single Source. The NAICS code utilized for this procurement is 334510 Electromedical and Electrotherapeutic Apparatus Manufacturing with a Small Business Size Standard of 1,250 Employees.

THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTES. No solicitation document is available and telephone requests will not be honored. No award will be made on the basis of unsolicited quotations or offers received in response to this notice. Any response to this notice must show clear, compelling, and convincing evidence that competition will be advantageous to the Government. The intent of this synopsis is for informational purposes only. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete this action based on this notice is solely within the discretion of the Government.

All inquiries and concerns must be received no later than June 12, 2023, by 16:00 PM EST. Forward responses by e-mail to Contract Specialist, Darius Crane at darius.crane@va.gov with the following information in the subject line 36C24722Q0772 PSG SYSTEM. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses received to this notice is solely within the discretion of the Government.
