Justification and Approval (J&A) For Other Than Full and Open Competition (>SAT)
Acquisition Plan Action ID:__36C247-19-AP-1703___________________________
1. Contracting Activity: Department of Veterans Affairs, VISN 07, Station 544, WJB Dorn VA Medical Center Business Office Beneficial Travel Services, along with the all Community-Based Outpatient Clinics (CBOC’s) intends to make a Sole Source award for Non-Emergent Ambulance Transportation Services to Professional Staffing Associates from Boston, MA; beginning on FEBRUARY 1, 2019 through FEBRUARY 28, 2019 with a one-month option period.
544-19-2-825-0031 in the amount of $313,002.76 for the month of February.
The potential option month would be in the amount of $313,002.76 for a total of $626,005.52.
2. Nature and/or Description of the Action Being Processed:
The Government intends to award a Sole-Source contract award for Non-Emergent Ambulance Transportation Services covering a one-month period. The period of performance for the Short-Term contract will be from FEBRUARY 1, 2019 through FEBRUARY 28, 2019. This Short-Term contract will have the provision of a one-month option period in case it is required to continue service without disruption. The purpose of this requirement is to provide continuity of services for the Ambulance Services to the beneficiaries of the WJB Dorn VA Medical Center which includes the lower state CBOC’s (Florence, Charleston, Augusta); and Non-Emergent Ambulatory and Special Mode Transport for the upstate CBOC’s which includes; Anderson, Greenville, Spartanburg, and Ashville NC clinics. Veterans will be transported “to and from” their scheduled appointments with the Primary Service Area (PSA) of the WJB Dorn VA Medical Center and CBOC locations.
FAR 13.5 Simplified Procedures for Certain Commercial Items: This procurement will be processed in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2.
3. Description of Supplies/Services Required to Meet the Agency’s Needs:
The WJB Dorn VA Medical Center anticipates making a Sole Source award for a Short-Term contract for one (1) month with a one (1) month option period for Ambulance Services for the Veterans at the WJB Dorn VA Medical Center and the Upstate/Lower State CBOC’s. The Short-Term contract will provide continuity of services pending the award of the Long-Term contract. Ambulance Services under the terms of this contact involve transporting Veterans requiring special mode transportation, to and from their perspective medical appointments. Many Veterans are transported to the WJB Dorn VAMC or to other hospitals and/or clinics for hospitalization or treatment. Based on previous year’s utilization data, the estimated cost for this Short-Term contract will be $313,003.76.

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
The current Contractor, Professional Staffing Associates, has a solid working knowledge of the routes “to and from” the Veteran’s schedule appointments; they have followed the required notifications procedures for scheduled appointments and have been able to meet the daily demand of transports required for the Medical Center as well as the CBOC’s. They have been diligent with ensuring that the Veterans are transported safely and timely to their perspective medical appointments.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
Solicitation number 36C247190033 was submitted to FBO on October 12, 2018. The requirement will provide Non-Emergent Ambulance Services for a Base Year and Four Option Years. The Long-Term solution will provide service for Veterans at the WJB Dorn VA Medical Center and the surrounding CBOC’s for VISN7.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable:
The current contract number 36C24718C0018; provides Ambulance Services for Veterans at the WJB Dorn VAMC and surrounding CBOC’s. The contract was awarded on November 1, 2018 for three (3) months. The period of performance was November 1, 2018 through January 31, 2019. The total cost of the current Short-Term contract is $641,319.33.
The anticipated cost of the “new” Short-Term contract; which is scheduled to begin on February 1, 2019 will be $313,002.76 with the potential one-month option year at $313,002.76 for a total of $626,005.52 for both months. The cost was derived from historical data which included; the actual number of transports that were completed within the past three months to include an increase in Mental Health transport as well as updated cost covering allowable Medicare costs for each transport. The proposed pricing amount of $626,005.52 is therefore found to be fair and reasonable.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted:
Market Research was conducted via the Vendor Information Portal (VIP), System for Award (SAMS); Federal Business Opportunities (FBO); Small Business Administration (SBA); General Services Administration (GSA), and Federal Procurement Data System-Next Generation (FPDS-NG). The Short-Term contract will provide continuity of services pending the award of the Long-Term contract. Historical data of previous contracts for similar services.
Market Research results include; the Vendor Information Page (VIP); forty-one (41) potential sources were found that could support this requirement. Technical Capabilities Statements were reviewed and found that there were at least nine (9) identified sources that are capable of providing the transportation services required.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:
There are no other facts other than those previously mentioned that will support the use of other than full and open competition.
10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:
There were no sources that expressed in writing, an interest in the acquisition. Information reviewed from previous contract awards was utilized to identify the best strategy for the requirement. Continuity of services for Non-Emergent Ambulance Services is required and making an award to a new Contractor will require a minimum of thirty (30) days to complete the transition. A Sole Source award to the incumbent will ensure services are not negatively impacted due to delays associated with the transition phase that is re2quired if the award was made to a new Contractor.
11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:
Solicitation number 36C24719R0033 was submitted to the Federal Business Opportunities website on October 12, 2018 for a Long-Term requirement for Non-Emergent Ambulance Tripartition Services. The Long-Term requirement will be for twelve (12) month Base Year and Four (4) Twelve (12) month Option Years. The anticipated awarded date of the new contract is February 01, 2019.
12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
13. Approvals in accordance with the VHAPM Part 806.3 OFOC SOP:
a. Contracting Officer or Designee’s Certification (required): I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
b. One Level Above the Contracting Officer (Required over SAT but not exceeding $700K): I certify the justification meets requirements for other than full and open competition.
