Notice of Intent to Sole Source
The Department of Veterans Affairs, NCO 6 intends to award a sole source, FFP, Purchase Order to Biofire Diagnostics, LLC., for the procurement/purchase of Filmarray Torch Module Box to be supplied at the Asheville VAMC, 1100 Tunnel Rd, Asheville, NC 28805. The North American Industry Classification System (NAICS) for this requirement is 334516 with a small business size standard of 1000 Employees.

The government intends to solicit from only one source under the authority of FAR 13.106-1(b), Soliciting from a Single Source. This notice of intent is not a request for competitive quotes; however, interested parties may identify their skill and ability by sending capability statements in reference to this requirement no later than Wednesday, June 14, 2023 by 2:00p.m. EST to Aleshia.Hines-Best@va.gov.
Interested firms must indicate whether they are a large, small, small-disadvantaged, 8(a) or woman owned business. If your firm is a Service-Disabled Veteran Owned or Veteran Owned Small Business, you must be CERTIFIED in VetBiz (see internet site: http://vip.vetbiz.gov). Also indicate whether the vendor is U.S. or foreign owned (in compliance with the Buy American Act).
Respondents who submit proprietary data shall clearly mark the data with appropriate markings. The Government will not pay for any information submitted as a result of this notice. This notice shall not be construed as an obligation on the part of the Government to acquire any products or services.
A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.

Justification for Single Source Awards IAW FAR 13.106-1 For Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The BioFire BCID Panel is a qualitative multiplexed nucleic acid-based in vitro diagnostic test intended for use with BioFire Systems. The BioFire BCID Panel is capable of simultaneous detection and identification of multiple bacterial and yeast nucleic acids and select genetic determinants of antimicrobial resistance. The BioFire BCID Panel test is performed directly on blood culture samples identified as positive by a continuous monitoring blood culture system. Results are intended to be interpreted in conjunction with Gram stain results.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Biofire, a BioMerieux company, is the only manufacteuer that makes panels compatible with the instrumentation currently available in the Microbiology Section, at the Asheville VA Medical Center. Biofire, by BioMerieux, is the sole manufacturer of a panel that is compatible with the instrumentation in use, in Microbiology lab. This test will expand the laboratory’s capability for testing and workflow to assist in improved patient turn-around-times and hospital costs. Reagents from other manufacturers are not compatible with Biofire analyzers currently in use in the laboratory.
4. Description of market research conducted and results or statement why it was not conducted:
Territory Sales Manager from BioFire Diagnostics, LLC responded to the Sources Sought stating that Biofire, a BioMerieux company is the only supplier of the Filmarray Torch Duplex Module. It is proprietary equipment being added to an existing testing platform. No further market research is needed.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
