VHAPM Part 813.106 Simplified Acquisition Procedures: Soliciting Brand Name Only Attachment 1: Brand Name Justification for SAP under the SAT
DEPARTMENT OF VETERANS AFFAIRS
Justification for Brand Name Only IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

1. Contracting Activity: Department of Veterans Affairs, VISN 06, Durham VA Medical Center NCO 6/RPO East PR# 558-19-3-122-0287
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: The Situate Detection System uses modern RF technology to detect misplaced surgical sponges through blood, dense tissue, bone and near metal. Surgical lap sponges, gauze and towels are embedded with the proprietary RF tag used as part of the RF Assure detections system.
3. Unique characteristics that limit availability to only one brand name, with the reason no other supplies or services can be used: The Situate detection system X provides real-time feedback for proactive compliance. The console and user interface provide on-screen prompts that guide workflow and generate unique confirmation codes of each scan for convenient EMR entry during the procedure. This allows OR staff to reconcile any inaccuracies before the case is closed, as an adjunct to manual counting. Situate detection system X technology utilizes sensors to transmit non-ionizing, low frequency radio waves to detect tagged cotton, to help ensure no cotton is left behind. When the tagged cotton is stimulated by the device’s signal, it transmits its own signal back to the detector, identifying its presence. The reliable communication between the detector and the tag enables the quick identification of missing sponges. This product meets the needs of OR and is vital in eliminating retained foreign body retention in surgical procedures. No other FDA approved product has been found to provide this specialized function.
4. Description of market research conducted and results or statement why it was not conducted:
Sources sought determined set-aside for SDVOB’s. FPDS was utilized for procurement history. VIP was searched and correspondence was sent to SDVOSB’s. GSA Advantage and eLibrary were searched and did not yield any companies able to provide the product. Mandatory source listing yielded no results.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
