Justification for Single Brand Name Only Awards IAW FAR 13.106‐1 (b) (3) For

Over Micro‐Purchase Threshold but Not Exceeding the SAT ($250K)

Acquisition Plan Action ID: 36C24619AP2215

1. Contracting Activity: Department of Veterans Affairs, VISN 6, for the Durham VA Medical Center plans to contract by means other than full and open competition in response to procurement request 558‐19‐2‐ 122‐0086.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount: This procurement request is for: Philips IntelliVue MP5; CBL 5 Lead ECG Trunk, AAMI; CBL 5 Leadset, Grabber, AAMI, ICU; Adult NIBR Air Hose; Easy Care Cuff, 1 Hose, Adult; LNC MP‐10 Philips Dual Keyed Cable; Installation Site Service and Clinical Config. & Impl Services.

3. Unique characteristics that limit availability to only one Brand Name, with the reason no other supplies or services can be used. Equipment is standardization and currently in use at the medical center. Currently, electronic data flows automatically from the fixed Philips monitoring systems located in all critical care areas into either the electronic anesthesia record keeping system (ARK) or the electronic ICU record (CIS). In the event of sudden failure of one of these systems, either in an operating room or a critical care area, one of these portable units would serve as the emergency backup monitoring unit. Any attempts to interface another vendor’s product with the current electronic record systems would be tremendously difficult and disrupt clinical documentation.

4. Description of market research conducted and results or statement why it was not conducted:

Market researched was conducted and found five SDVOSBs available thru VIP and no VOSB. GSA & NAC resulted in five of the eight items request was on scheduled. Out of the five SDVOSBs two were authorized distributors for Philips Healthcare Inc.

5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106‐1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
