B.1 PERFORMANCE WORK STATEMENT

Housekeeping/Janitorial Services at the Franklin (CBOC) Annual Contract Purpose: Contractor shall provide for all management, supervision, tools, supplies equipment, material, transportation and labor to develop and implement housekeeping tor Franklin Outpatient Clinic, Wayah St. Franklin NC 28734.

The contractor shall ensure that all work is accomplished in accordance with all applicable federal, state, local laws and regulations.

Contractor personnel will sigh in at the beginning of their scheduled work shift and sign out at the end of their shift. Contractor is responsible for supplying, completing and submitting Material Data Sheets (MDS), monthly progress and associated reports to Environment Management Services (EMS) as requested by Federal State, Occupational Disease Statues and local Ordinances, which pertain to any duties, contained herein during the contract performance period.

General Requirements: Housekeeping duties to be performed: cleaning of all offices, exam rooms, conference rooms, corridors, entrances, restrooms, patient care areas, waiting rooms, storage rooms (6500 sq. ft.). Services require high dusting, washing walls, floors, vents, glass doors, windows, carpet cleaning.

All cleaning supplies to be Hospital grade cleaning materials. Having material. data sheets (MSDS) available on all cleaning supplies at all times. Contractor shall be required to furnish the Government prior the trade names (if any) and chemical names used.

All cleaning procedures to comply with all infection control and safety regulations of the Asheville VA Medical Center.

Contractor is responsible for removal of all waste in each room and/or area to the appropriate containers for disposal. Also clean all containers.

Contractor is responsible for furnishing all tissue, towels and hand soap for all dispensers.

Contractor to provide a quality control plan with a performance check list for all required task and duties involved in janitorial services at the VA Franklin CBOC.

1. CLEANING ELEMENTS (DAILY): Minimum daily routine cleaning consists of:

Exam rooms, sweep/dust mop all exam rooms. Damp mop all exam rooms.

Ceilings, vents, light fixtures (clean, no flies inside cover and dust free).

Walls, wall fixtures, pictures, bulletin boards, view boxes, door frame (clean and dust free).

Exam tables, chairs, desk, stools, file cabinets (fronts, sides, tops clean and dust free). Waste containers (empty and clean inside and out). Medical waste emptied into appropriate storage container, medical waste containers (clean bag, inside and outside of container clean).

Sinks, pipe fixtures, wall around and under sink (clean and dust free).

Needle boxes checked daily emptied when 2/3 full. Floors, baseboards, corners (under, beside and behind exam tables and all furniture (clean and dust free).

2. BATHROOM:

Clean all sinks, commodes, urinals, mirrors, in all restrooms.

Ceilings, vents, light fixtures (clean, no flies inside cover and dust free).

Sinks, pips fixtures, wall around and under sink (clean and dust free).

Waste containers (empty and clean inside and out).

Dispensers, tissue, towel, soap, etc., (clean and filled).

All pipe fixtures (clean around and underneath).

Floor, under commode, baseboards, corners etc. (clean and dust free).

Needle boxes checked daily emptied when 2/3 full).

3. ENTRANCES AREA LOBBY, CORRIDORS, WAITING AREAS:

All doors, windows at entrances (dust free and clean).

Ceiling, vents, light fixtures (clean, no flies inside cover and dust free).

Wall, all fixtures, pictures, bulletin boards, view boxes, door frame (clean and dust free).

Waste containers (empty and clean inside and out).

Floors, baseboards, corners (under, beside and behind exam tables and all furniture (clean and dust free).

Carpet areas vacuumed daily.

4. CLEANING ELEMENTS (WEEKLY): Weekly cleaning consist of:

Furniture to be cleaned damp cleaning, legs, wheels, sides, back front etc.

Window sills in all rooms clean and dusted.

Mini blinds cleaned and dusted Exam tables skids, fronts, stands, cleaned and dusted.

Trash containers cleaned inside and out.

Pictures, displays, wall fixtures etc. cleaned and dusted.

Vents, cubical curtain tracks cleaned and dusted.

5. CLEANING ELEMENTS (MONTHLY): Monthly cleaning consist of:

Clean and dust scales.

Clean and wipe out refrigerators (sides, top, back, front etc.).

Counters in work rooms (fronts, sides tops).

Burnish all floors.

6. CLEANING ELEMENTS (QUARTERLY/SIMI-ANNUAL/YEARLY):

a. Quarterly Cleaning:

Windows, inside and out.
Remove cubical curtains and hang clean ones (also must remove and change as soiled).
Pressure clean outside entrance and canopy areas.

b. Simi-Annual:

Provide top coating of all required floors, clean carpets to maintain a clean, safe, satisfactory environment.

c. Yearly:

Strip and refinish all wax floors.

7. GOVERNMENT FURNISHED EQUIPMENT:

The government will provide supply hand sanitizer to the contractor for refilling sanitizer containers throughout the Clinic as needed.

8. SPECIAL CONTRACT REQUIREMENTS

Work Hours:

The service covered by this contract shall be furnished by the contractor as defined herein. The contractor shall not be required except in case of emergency, to furnish services on Federal Holidays or during off duty hours as described below.

a. The following terms have the following meanings:

Normal workings hours: Daily, Monday through Friday from the hours of 4:30pm to 12am, excluding federal holidays.

b. The 10 holidays observed by the Federal Government are:

Martin Luther King Day
President Day
Memorial Day
Independence Day
Labor Day
Columbus Day
Veterans Day

Christmas Day

Any other day specifically declared by the President of the United States to be a federal holiday.

When one of the holidays falls on Sunday, the following Monday shall be observed as a Federal Holiday. When a holiday falls on a Saturday, the preceding Friday shall be observed a s a Federal Holiday.

Contractor personnel will sign in at the beginning of their scheduled work shift and out at the end of their shift. Contractor is responsible for supplying, completing and submitting all reports required to EMS as requested by Federal, State and local ordinances, which pertain to any duties, contained in the contract.

Contractors are required to comply with the applicable Federal and State Worker Compensation and Occupational Disease Statutes.

Contractors are required to provide license to Government prior to start of work.

Contractors are required to have Bodily Injury Liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence.

Contractors are required to have Property Damage Liability insurance coverage of at least $500,000.

Before commencing work under the contract, the Contractor shall furnish to the Contracting Officer a certificate of insurance stating that coverage may not be changed or cancelled unless 30 days advance written notice is provided to the contracting Officer.

In the event of inclement weather, the entire work shall be rescheduled to a date and time satisfactory to the contractor and the Chief, Environmental Management Service. Postponement will not reflect any penalties assessed to the contractor, nor shall there be an additional cost to the government.

This is a hospital environment. The Contractor and his personnel are expected to be appropriately dressed (preferably uniformed) and to conduct themselves professionally.

This is a federal facility as well as a medical center. As such, there is NO tobacco usage allowed inside any federal building or on the grounds except in designated areas. The COR will brief the Contractor as to designated smoking areas prior to commencement of the contract. Failure to follow these regulations can result in removal of the worker or Contractor from the facility and/or a US Magistrate’s ticket and fine.

Compliance Awareness Training shall be completed by vendor prior to access to Franklin CBOC. Vendor has responsibility for “Duty to Report” any fraud, waste and abuse witnessed while on VA premises to the Compliance Officer.

9. CONTRACTOR EMPLOYEES

The contractor personnel shall maintain a valid license, training and certification to perform the required tasks associated with providing Janitorial Services. The Contracting Officer may authenticate the training requirement, review certificates or credentials from the contractor at any time for any personnel who are servicing or performing on this contract.

10. GOVERNMENT FURNISHED FACILITIES

The Government will not provide office space of operational facilities to the Contractor. The Contractor shall secure and maintain the necessary office space and other facilities required for the performance of this contract at his/her own expense.

11. QUALITY CONTROL PLAN

The Contractor shall develop and Quality Assurance Plan (QAP) which will provide the Contractor’s strategy for monitoring performance internally, providing performance information to the Government, and reporting in compliance with the PWS. Within the QAP, the contractor shall propose and maintain an established reporting system promptly notifying VA of any problems, issues, risks, or concerns with workflow performance, programmatic improvement, security, and schedule adherence. Quality control is the exclusive responsibility of the Contractor.

12. QUALITY ASSURANCE SURVEILLANCE PLAN

The Government intends to utilize a Quality Assurance Surveillance Plan (QASP) to monitor the quality of the contractor’s performance. The oversite provided for in the order and in the QASP will help to ensure that service level reach and maintain the required levels throughout the contract term. Further, the QASP provides the COR with a proactive way to avoid unacceptable or deficient performance, and provides verifiable input for the required Past Performance Information Assessment. The QASP will be finalized immediately following award and a copy provided to the Contractor after the award. The QASP is a living document and may be updated by the Government as necessary.

C.2 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

C.3 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed five (5) years and 6 months.

(a) Definition. For the Department of Veterans Affairs, “Service-disabled veteran-owned small business concern or SDVSOB”:

(1) Means a small business concern:

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans or eligible surviving spouses (see VAAR 802.201 Surviving Spouse definition);

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

C.7 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—COMMERCIAL ITEMS (OCT 2018) The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

(a) Definitions. As used in this provision— Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that—

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned business concern means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

Women-owned small business concern means a small business concern—

(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United…
