Justification and Approval (J &A) For

Other Than Full and Open Competil:ion (>SAT)

Acquisition Plan Action ID: 36C246-18-AP-2218

1. Contracting Activity: Department of Veterans Affairs, VISN Of,, Charles George VA Medicc1 I Center, VISN 06, Network Contracting Office 6, 637-18-4-996-0076.

2. Nature and/or Description of the Action Being Processed: n is requirement is for a brand name only request to supply the Charles George Asheville VAMC with an GE Healthcare Carescape Central Station Operating System Upgrade. This requirement will replace several monitors in the Day Surgery Suites and aid in the continuation efforts at the Asheville VAMC to upgrade all Central Stations that currently use Windows XM as the OS.

3. Description of Supplies/Services Required to Meet the Agem:y's Needs: This requirement includes the procurement of; 10 EA Carescape Monitor B450, 10 EA Ca:·escape Patient Data Modul,e, 4 EA Carescape Gateway G9, 1 EA Muse v9, 1 EA Carescape Netwmk, 1 EA CGW ITPS, I JB Configuration and Education Services. The anticipated dollar value for this acquisition is; $260372.80.

4. Statutory Authority Permitting Other than Full and Open Co111petition:

FAR13.5 Simplified Procedures for. Certain Commercial Items: The authority for applying the

Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S. C. 1901 and is implemented by for restricting competition on this procurement via FAR 13.106-1{Ii}{2).

5. Demonstration that the Contractor's Unique Qualifications c,r Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authori,tvl: The Carescape Central! Stations being replaced are proprietary to GE Healthcare and currently operate on the Windows XP OS while the replacements will operate on the Windows 7 OS. The Ash1,iville VAMC has standardized throughout the facility on the Carescape platform and only the GE Healthcare monitors will be compatible with the current platform. Replacing the monitors and Central Stations with the current Vendor will maintain standardization within the facility and will ensure communication with the CareScape Gateway from the monitors to the Central Stations on the unit and in the Telemetry War Room. The staff of the facility are familiar with the Physiological Monitors supplied by the vendor and this will maintain uniformity throughout the facility. This will also reduce the workload on the constrained availability of Biomedical Engineering staff and reducing waste by that department storing parts and knowledge for two separate Physiological M Jnitor vendors.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The items needed for this acquisition are proprietary to GE Healthcare.

Market research efforts have determined that GE Healthcare has 4 authorized Small Business resellers/distributors, two of which are VOSB's. Pursuing this acquisition as a 100% VOSB set-aside will satisfy the VA Rule of Two and ensure maximum effort regarding competition for this acquisition.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The contracting officer will ensure that fair and reasonable prici,ng is obtained for this acquisition. The contracting officer believes that the 100% VOSB set-aside is the most advantageous

· avenue to take regarding receiving fair and reasonable pricing. Fair and reasonable pricing will be determined prior to award based on competition.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research efforts involved confirming that GE Healthcare was the proprietor/manufacturer of the items in need and determining if they had any authorized distributors/resellers. Once it was determined that GE Healthcare had several small business resellers, the contracting officer examined each vendor's socioeconomical status to see if the VA Rule ofTwo would apply. Once it was determined that the VA Rule of Two would apply, the contracting officer decided to pursue a 100% VOSB set-aside.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: The Asheville VAMC has standardized on the GE Carescape platform and thus, no actions have been taken to overcome or remove barriers to competition. Switching to another brand of monitors would require a complete system overhaul which would result in a training burden and increased costs that are not anticipated to be recouped through a competitive acquisition for a new platform.
